Upon review of your request for 401 Water Quality Certification to place fill material in
1.29 acres of wetlands or waters which are tributary to Stewarts Creek for road crossings and
residential development located at Brushy Hill and King Roads in Cumberland County, as.
described in your submittal dated 30 April 1993, we have determined that the proposed fill
can be covered by General Water Quality Certification Nos. 2732 & 2671 issued January 21,
1992. Copies of the General Certifications are attached. These Certifications may be used in
qualifying for coverage under Corps of Engineers' Nationwide Permit Nos. 14 & 26. Septic
tank drains fields should be located in natural high ground.

The purpose of this letteris, to request; Nationwide Permits' 14 and
26, and a-Section -401'Water :Quality Certification for the project
to be known as Windsong Subdivision. The proJect is located - near,
Rockfish, NC (Cumberland County) and is bordered, partially by
Brushy Hill Road as shown on the enclosed pllans and vicinity mars.
To the north is King Road (S.R. 1112).
The Corps approved detailed wetland delineation is shown on the
attached map. These delineations have been_approved'by Mr. Scott.
McLendon of the U.S. Army Corps!of Engineers.

Fill in the wetlands will be required to construct a roadway_and.
residential development.

There is-a ro osed fill of 1.06 acres (see map) of_jurisdctional
wetlands above headwaters for placement ofitlie .proposed facilities
utilizing Nationwide 26. .29 ac"res`of thes1.06 requested located
below the'road-crossing do-not appear Co b?e'absolutely essential
for the adjacent lots to be buildable. However, based on previous
experience with similar situations"S.&EC_belleves-this area will
likely be impacted due to the,proximity of the-road crossing and
steep slopes on each side of it. Therefore;. we 'feel it is better'
to be up-front. in addressing the likelihood' of these impacts now
rather than face ,a potential violation later. S&EC would like to
note that the impacted areas are more similar to seepageswales
than flowing streams -and are-; of marginal, quality. In most areas
channels 'are non-existent or vague. The )large high quality
wetland on the southern boundary thathasf'been avoided should be
able to remain.-•a functional 'wetland ,ar-,eaieven though remnants 'of
an old ditch were observed.-:in this area., I'would also like to
note that, considerable redesign has gonejinto this project to
minimize its wetland impacts.. An additional .23 acres (see map)
will be filled for road crossings under,N,jationwide Permit_14
Road crossings, are perpendicular to wetland alignments, in-:order
to minimize impacts.
