This letter responds to your letter of April 4, 1994 concerning Eastwood Village, Section 6
located in Fayetteville, NC. The results of my application are unfortunately unacceptable and
will require a modification of the original road and subdivision design to reduce the amount of
impact on wetlands. Another problem with severe topography on lots 208, 211, 212, and 213
has caused the original set of plans to require modification, as well.
You will be receiving another site layout with proposed fill calculations very shortly. Thanks

We have reviewed your request for 401-Water Quality Certification to
place fill material in 0.73 acres of wetlands or waters which are tributary to
Cape Fear River for sewer line and residential development located at Eastwood
village Phase 6 in Cumberland County as described in your submittal dated 16
December 1993. Based on this review, we have determined that the proposed
fill is covered by General Water Quality Certification Nos. 2664 and 2671.
Copies of the General Certification are attached. These Certifications are
necessary for coverage under Corps of Engineers' Nationwide Permit Nos. 12 and
26. This action completes DEM's review under Section 401 of the Clean Water
Act. Fill is not approved for lots 210,211,212,200,199,198,197,205,206, and
207. Fill for lots 208 and 209 is approved but shall leave 50 feet of
wetlands (including the sewer line) in the back of the lot. Storm water shall
be directed to sheetflow across the wetland. A deed restriction shall be
placed on all lots with jurisdictional.wetlands to inform the landowner that
wetlands are present on the lot and should not be filled.
If this Certification is unacceptable to you, you have the right to an
adjudicatory hearing upon written request within thirty (30) days following
receipt of this Certification. This request must be in the form of a written
petition conforming to Chapter 150B of the North Carolina General Statutes and

This letter responds to your letter of February 22, 1994 concerning Eastwood Village, Section 6
located in Fayetteville, NC. My position with regard to the already minimal wetland fill in the
back yard of a lot is that placing a wetland fill restriction on the future homeowner can be
somewhat cumbersome and unpractical in the field-- especially if the wetland is made up of
transition soil, and not easily identified as wetland.
I would certainly like to have designed lots 211, 212, 200, 199, 198, and 197 away from the
wetland; however, the existing sewer outfall dictated the location of these lots more so than my
efforts. Public Works Commission frowns on the construction of new sewer pipe, or extremely
deep sewer pipe, when an existing outfall will serve any proposed development. The quality of
wetland on these lots is that of transition soil from high ground down to the wetland, and is
nowhere near the high quality (axle grease) type wetland your agency strives to protect the most.
The requested stormwater distribution is already planned and is in place in Section 5, as well.
My efforts in the past have clearly demonstrated that I am not trying to carelessly destroy
wetlands, or abuse the permit process in any way. This tract remains well preserved with
quality wetland with over 10 acres of Torhunta soil. Please seriously consider approving the
application as originally applied for.

The Division of Environmental Management, Water Quality Section
has reviewed your plans for wetland fill for 1.08 acres of wetlands at
Eastwood Village, Phase 6 in Cumberland County for lot fill. Based on
this review, we have identified significant uses which would be
removed by this project. These uses are water storage, pollutant
removal and wildlife habitat. Furthermore, insufficient evidence is
present in our files to conclude that your project must be built as
planned in wetlands. Therefore, we are moving toward denial of your
401 Certification. Until we receive additional information, we are
requesting (by copy of this letter) that the U.S. Army Corps of
Engineers and/or the N.C. Division of Coastal Management place your
project on administrative hold.
Please provide us with information supporting your position that
your project must be constructed as planned and that you have no
practicable alternative to fill of these wetlands. Specifically can
you construct your residential development without fill for lots 210,
211, 212, 200, 199, 198 and 197. Fill on lots 205-209 should be
miminized as well. Stormwater shall be sheetflown across the wetlands
in the site. Any documentation such as maps and narrative which you
can supply to address upland alternatives may be helpful in our review
of your 401 Certification. Please respond within two weeks of the
date of this letter by sending a copy of this information to me and
one copy to our Mr. Ken Averitte at the Fayetteville Regional Office
at Wachovia Building Suite 714, Fayetteville, N.C. 28301.

I have enclosed seven copies of the Joint Application for use of
Nationwide Permits 12 and 26 in Phase Six of Eastwood Village in
Fayetteville. The lots shown will be accessing an existing sewer
line at the rear lot lines. Fill totalling .45 acres will be used
across 12 lots for grading and home site preparation. The existing
sewer line has degraded a good portion of the proposed work area.
The more valuable undisturbed heart of the wetland will be avoided
with this plan.
