I have reviewed your responses and have a follow up concern. You state that "the gabions will be placed up to or behind
the limits of the existing north bank of Travis Creek" and "they will be placed in an excavated trench behind the bank
and placed in the wet so no dewatering is proposed". Condition 11.9 of 401 Water Quality General Certification #4134
states that "All work in or adjacent to streams shall be conducted so that the flowing stream does not come in contact
with the disturbed area". Since the trench will be in contact with the natural stream flow and at water level and below
it, constructing it in the wet would not meet the requirements of this Condition. Please provide either a dewatering
sequence which isolates the trench area from the natural stream flow (I understand that groundwater will be present
within the trench and you may not propose to pump groundwater out of the trench but rather install the gabion basket
in the groundwater that fills the trench), or provide a justification for why diverting the natural stream flow is not
feasible, and what additional measures will be taken to ensure that water quality standards, particularly turbidity, are
not violated during the construction of the gabion wall.
Please note that this application will remain on hold until this issue is resolved.

Attached is the revised PCN and Plans with the changes made. Please note the following 2 items:
• We are still submitting under NWP 13 as there will be no excavation in the stream. This is explained in the cover
letter attached.
• Item B -3b. on Page 2 The total stream footage on site is 777 Lft rather than 177 Lft which was an error/typo on
the first submittal.

Thank you for your PCN and attached information, dated 4/9/2019 (received 4/24/2019), for the above referenced
project. I have reviewed the information and need clarification before proceeding with verifying the use of Nationwide
Permit (NWP) 13 (http://saw-reg.usace.army.mil/NWP2017/2017NWP13.pdf). Please submit the requested information
below (via e-mail is fine) within 30 days of receipt of this Notification, otherwise we may deny verification of the use of
the Nationwide Permit or consider your application withdrawn and close the file:
1) The wetland and stream areas shown on Plan Sheets 1-12 do not match those verified for the Approved
Jurisdictional Determination dated 12/20/2016. Please revise these features and resubmit the plan sheets;
2) Given the waste removal proposed from within the stream bed of Travis Creek (per Plan Sheets 5), the proposed
impacts to waters of the US would not all fit under NWP 13. As such, I recommend that the project instead be
proposed under NWP 39, which would cover all proposed impacts to waters of the US;
3) Please itemize the stream impacts proposed for waste removal from within the banks of Travis Creek per Plan
Sheet 5 as a separate line item on Section C.3. (i.e. Impact S2) of the PCN. These impacts would be in addition to
those listed for bank stabilization on line S1 of Section C.3 of the PCN. Please also add a call -out note on Plan
Sheet 5 labeling this separate impact (i.e. Impact S2) with the linear footage and area of impact within Travis
Creek;
4) Please provide the dewatering extent within Travis Creek for the gabion installation and waste removal, and
describe/show the dewatering method. Please also reference the email regarding this topic from NCDWR on
5/21/2019.
5) Please provide all requested information to my attention via email, as my files for this project are electronic.
