On behalf of RBV Investments, LLC,we are requesting authorization from the USACE to use NWP
29 for 0.23 acres of permanent wetland impacts and 146 If of permanent stream impacts for
construction of the proposed project. We are also requesting a 401 WQC from NCDWR for the
above referenced impacts. Impacts to Neuse River Riparian Buffers will be permitted through
Johnston County as the delegated municipality.
The project is ±67.69 acres in size and comprised of 5 parcels located south of NC Hwy 210
between Black Creek Road and Lassiter Pond Road, north of Long Branch Road in Smithfield,
Johnston County (Latitude: 35.502798°N; Longitude: -78.432473°W). The project is located in
the Neuse River basin and onsite waters drain to Sassarixa Creek. The Water Quality Classification
for Sassarixa Creek is C; NSW and the Stream Index Number is: 27-45-13. The hydrologic
cataloging unit for the site is 03020201.
Proposed Project
The purpose of the proposed project is to construct a residential subdivision to meet the existing
demand for single family housing in the Johnston County area.
The overall proposed project consists of the construction of 68 single family dwellings and
associated infrastructure including roads, utilities, stormwater management. Standard commercial
construction equipment and techniques will be used to construction the proposed project.
Project History
Charles Pender of Johnston County issued a Buffer Determination (NBR# 19-003) for the project
area on 03/30/2019.A copy of the Buffer Determination Letter has been provided as an appendix.

A preliminary Jurisdictional Determination (SAW-2018-02289) was submitted on 11/19/2018
and USACE Regulatory Specialist Ross Sullivan field verified the delineation and jurisdictional
status for the project area on 01/09/2019. WR is not requesting issuance of the Jurisdictional
Determination in conjunction with the issuance of the NWP as all proposed impacts will be
completed prior to expiration of the NWP 29. A copy of the delineation concurrence email from
Ross Sullivan has been provided as an appendix.
Proposed Impacts
The proposed impacts consist of:
• 0.23 acres of permanent wetland impacts
• 146 If of permanent stream impacts
Proposed impacts have been limited to only those necessary to cross the stream and wetlands
which bisect the property in order to access developable uplands in the southern portion of the
project.The construction of Street 1 will result in 0.23 acres of permanent wetland impacts(Impact
#1A) and 103 If of permanent stream impacts (Impact #1D) for installation of twin 48" culverts.
Installation of the rip-rap dissipaters above and below the culvert will result in 43 If of permanent
stream impacts (Impacts #1B & #1C). The twin culverts will be buried 12" below the stream bed,
with the southern culvert carrying baseflow and the northern culvert being grouted to only carry
flood flow.
The rip-rap dissipaters are required to reduce flow velocity and prevent erosion of the stream and
undercutting of the culvert and headwalls. A plunge pool will be constructed on the downstream
end of the culverts (Impact #1B). The rip-rap will be installed by burying the rip-rap such that the
top of the rip-rap matches the pre-construction contours of the natural stream bed, allowing for
the passage of aquatic life and preventing a loss of function of this section of stream channel. The
rip-rap apron on the upstream end of the culvert is necessary to divert flow into the southern
culvert and armor the area above the headwall to prevent scour and undercutting (Impact # 1C).
A channel will be created within the rip-rap apron to carry flow into the southern culvert. The rip-
rap will be installed by burying the rip-rap such that the top of the rip-rip is at the surface of the
channel, allowing water to flow over the rip-rap to maintain aquatic life passage. While a stream
channel will be constructed within the rip-rap apron, this impact is being assessed as a functional
loss since the existing stream channel will be filled and relocated.
Avoidance and Minimization
Prior to site plan design,the applicant requested that a detailed wetland delineation be conducted
so that impacts to wetlands and "waters" could be minimize.
Due to limited access to NC Hwy 210 and the location of the streams and wetlands which bisect
the project,impacts to wetlands and streams are required to access adjacent uplands and therefore
impacts could not be avoided entirely. To minimize impacts Street 1 has been designed to cross
the stream and wetlands at a perpendicular angle and backslopes have been designed at 3:1 slopes
to transition road fill to natural grade, which is the minimum allowed by Johnston County.
Additionally, Street 1 has been designed downstream of the confluence of Stream 1 and Stream 2

(see Approved Wetland/Buffer Delineation Exhibit) minimizing stream and wetland impacts to the
maximum extent possible.
Additionally, the rip-rap dissipators will be installed by burying the rip-rap such that the top of the
rip-rap matches the pre-construction contours of the natural stream bed,allowing for the passage
of aquatic life and prevent a functional loss.
Construction techniques used to avoid or minimize the proposed impacts include the installation
of erosion and sedimentation control devised prior to construction. Additionally, access to impact
areas will be from high ground.
Mitigation

in functional loss as depicted in the table below.

The proposed permanent stream impacts (with functional loss) are 116 If; therefore, mitigation is

Wetland Mitigation
The applicant proposed to mitigate the 0.23 acres of permanent wetland impacts through the
purchase of offsite migration credits at a 2:1 ratio, resulting in the purchase of 0.46 acres of
riparian wetland mitigation. The applicant proposes to provide the 0.46 acres of riparian wetland
mitigation through the purchase of credits from RES within the Neu-Con Wetland & Stream
Umbrella Mitigation Bank - Hannah Bridge Site. A Copy of the Statement of Availability from RES
has been provided as an Appendix.
Stormwater Management Plan
The proposed Stormwater Management Plan will be reviewed and approved by Johnston County
as the certified municipality.
The current request is for 0.23 acres of permanent wetland impacts and 146 If of permanent
stream impacts (see the attached maps and PCN for details).

WR reviewed the NC Natural Heritage Program database, located at http://www.ncnhp.orq/web/nhp/home, as well as
NCNHP GIS data to identify if there were any known occurrences of endangered species on or near the proposed project.
The review of the NHP data did not identify any recent occurrences of federally listed threatened or endangered species
or critical habitat on the subject property or within 1.0 miles of the project, see attached NCNHP project review letter.
Furthermore, site reviews did not identify any potential habitat for any federally protected species known to occur in
except for Michaux's sumac.
The project site is not located within the known range of the yellow lance, dwarf wedgemussel and Tar River spinymussel.
Site reviews did not identify any potential habitat for bald eagle or red-cockaded woodpecker.
The edge of the wood line and the agricultural fields were determined potential habitat for Michaux's sumac; However, no
sumac species were identified during the pedestrian survey.
Stream 1 is an intermittent stream with a substrate consisting almost entirely of sand. Therefore, Stream 1 was not
considered suitable habitat for the Atlantic pigtoe (proposed for listing).
Based on the lack of suitable habitat and lack of nearby records, WR concludes that the project will have "no effect"on
federally protected species or their critical habitat.

Riparian Buffer Ordinance (Section 14-393 Johnston County Code of Ordinances) has or have been

recent version of the 1:24,000 (7.5 minute) quadrangle topographic maps prepared by the United States
Geologic Survey(USGS), and have been located on the property and possess characteristics that qualify

I conducted a site visit with you at the above referenced property on 1/9/2018 to verify the limits of
any potentially jurisdictional waters of the United States (WoUS) within the project area. I have

Landing, located at to the south of NC Hwy 210 between Black Creek Road and Lassiter Pond Road,
North of Long Branch Road (Lat: 35.502798°N; Long: -78.432473°W) in Smithfield,Johnston County,
NC. I have updated the delineation per our site review and the attached Approved Delineation
Exhibit depicts the verified delineation. I've also attached the aquatic resources table.
Will you please respond to this email concurring with the results of the site meeting so that we have
documentation for upcoming submittals. We understand that due to your current workload, the JD
will be issued during permitting.

I've attached a request for Preliminary JD for Redhawk Landing, located at to the south of NC Hwy
210 between Black Creek Road and Lassiter Pond Road, North of Long Branch Road (Lat:

This site is± 67.69 acres and comprised of undeveloped woodlands and agricultural fields.
During the site review WithersRavenel identified 3 Streams, 2 wetlands and 3 ponds.
Please take a look at the attached request and let me know your availability for a site visit. A review
of the site would require approximately 2.5 hours. The site can be accessed from the driveway in the
northeastern corner of the review area.

This document confirms that RBV 210,LLC. (Applicant)for the Redhawk Landing(Project)has
expressed an interest to utilize 0.48 Riparian Wetland Mitigation Credits from the EBX-Neuse
sponsored Neu-Con Wetland& Stream Umbrella Mitigation Bank,specifically 0.48 from the Hannah
Bridge Site in the Neuse HUC 03020201. As the official Bank Sponsor, EBX-Neuse I, LLC, attests to the
fact that mitigation is available for reservation at this time.
These mitigation credits are not considered secured, and consequently are eligible to be used for alternate
purposes by the Bank Sponsor,until payment in full is received from the Applicant resulting in the
issuance of a Mitigation Credit Transfer Certificate by the bank acknowledging that the Applicant has
fully secured credits from the bank and the Banker has accepted full responsibility for the mitigation
obligation requiring the credits/units.
The Banker will issue the Mitigation Credit Transfer Certificate within three(3)days of receipt of the
purchase price. Banker shall provide to Applicant a copy of the Mitigation Credit Transfer Certificate and
a documented copy of the debit of credits from the Bank Official Credit Ledger(s), indicating the permit
number and the resource type secured by the applicant.A copy of the Mitigation Credit Transfer
Certificate,with an updated Official Credit Ledger will also be sent to regulatory agencies showing the
proper documentation.

The North Carolina Natural Heritage Program (NCNHP) appreciates the opportunity to provide
information about natural heritage resources for the project referenced above.
Based on the project area mapped with your request, a query of the NCNHP database indicates that
there are no records for rare species, important natural communities, natural areas, and/or
conservation/managed areas within the proposed project boundary. Please note that although there
may be no documentation of natural heritage elements within the project boundary, it does not
imply or confirm their absence; the area may not have been surveyed. The results of this query
should not be substituted for field surveys where suitable habitat exists. In the event that rare
species are found within the project area, please contact the NCNHP so that we may update our
records.
The attached 'Potential Occurrences' table summarizes rare species and natural communities that
have been documented within a one-mile radius of the property boundary. The proximity of these
records suggests that these natural heritage elements may potentially be present in the project area
if suitable habitat exists. Tables of natural areas and conservation/managed areas within a one-mile

If a Federally-listed species is found within the project area or is indicated within a one-mile radius of
the project area, the NCNHP recommends contacting the US Fish and Wildlife Service (USFWS) for

Please note that natural heritage element data are maintained for the purposes of conservation
