TO WHOM IT MAY CONCERN:
We received a "Notice of Violation and Assessment of Civil Penalty" for Bethany Wastewater Plant
(NC0037001). We had previously requested remission of civil penalty from the violation letter we
received dated May 3, 2019 (February samples).We mailed a remission pack back to the address listed
at the end of the letter.This package has not been received back to our facility.
When our second sample came back high, we changed the bulbs in the UV system before requesting
assistance from NCDEQ. We also purchased an additional two sets of UV bulbs (see attached invoice).
On March 13, 2019, we met with Gary Hudson to discuss higher than normal fecal coliform results as
shown on our March 2019 eDMR report. Per Mr. Hudson's recommendation,we disassembled the UV
system and cleaned the protective sleeves. We have implemented a monthly cleaning schedule for the
protective sleeves at the plant.
After investigation of"What Changed" in our process.We discovered a possible cause. In September
2018, we changed cleaning/sanitation products to a product called Envirox(see attached SDS). I also
attached a summary of Pace Analytical Fecal Coliform results. We stopped using Envirox on May 14,
2019 at that site. We are not yet sure that there is a connection. Our sample that came back on June 12,
2019 fecal coliforms was none detected. We have since moved into summer limits because of flow and
we will be unable to determine if that product caused our issue.

This letter transmits a Notice of Violation and assessment of civil penalty in the amount of$415.13 ($300.00 civil penalty
+$1 15.13 enforcement costs)against Rockingham County Board of Education.
This assessment is based upon the following facts: a review has been conducted of the Discharge Monitoring Report
(DMR) submitted by Rockingham County Board of Education for the month of April 2019. This review has shown the
subject facility to be in violation of the discharge limitations and/or monitoring requirements found in NPDES WW Permit
No.NC0037001• The violations, which occurred in April 2019,are summarized in Attachment A to this letter.
Based upon the above facts, I conclude as a matter of law that Rockingham County Board of Education violated the
terms,conditions or requirements of NPDES WW Permit No. NC0037001 and G.S. 143-215.l(a)(6) in the manner and
extent shown in Attachment A. In accordance with the maximums established by G.S. I 43-215.6A(a)(2),a civil penalty
may be assessed against any person who violates the terms,conditions or requirements of a permit required by G.S.
143-215.1(a).

Pursuant to G.S. 143-215.6A(c), in determining the amount of the penalty I have taken into account the Findings of Fact and
Conclusions of Law and the factors set forth at G.S. 143B-282.1(b),which are:
(1) The degree and extent of harm to the natural resources of the State,to the public health,or to private property
resulting from the violation;
(2) The duration and gravity of the violation;
(3) The effect on ground or surface water quantity or quality or on air quality;
(4) The cost of rectifying the damage;
(5) The amount of money saved by noncompliance;
(6) Whether the violation was committed willfully or intentionally;
(7) The prior record of the violator in complying or failing to comply with programs over which the Environmental
Management Commission has regulatory authority;and
(8) The cost to the State of the enforcement procedures.
Within thirty(30) days of receipt of this notice,you must do one of the following:
(1) Submit payment of the penalty, OR
(2) Submit a written request for remission, OR
(3) Submit a written request for an administrative hearing

Payment should be made directly to the order of the Department of Environmental Quality(do not include waiver

On Wednesday, March 13, 2019, I met with you for a Technical Assistance visit at the
Bethany Elementary School Wastewater Treatment Plant located in Rockingham County.
The visit was at your request concerning some higher than normal fecal coliform results
that you had experienced during the last several months. My observations, and highlights
of our conversation are listed below for your review.
Although nothing conclusive was found to be the cause of the fecal coliform problems,
the following remedial actions were discussed:
o When you took over as Operator in Responsible Charge (ORC), you were unaware
that ultraviolet radiation disinfection systems require the regular dismantling and
cleaning of the protective sleeves on a frequent schedule. It would be helpful to
check with the manufacturer for all suggested maintenance schedules.
o When you did decide to take the unit down and clean the sleeves you noticed an
immediate improvement in your fecal coliform sample results.
