This certification was issued with the condition that no permanent ditching be left which "de-waters" the remaining wetlands. As part of an ongoing compliance monitoring and enforcement program for 401 Water Quality Certifications, Ken Averitte from the Division's Fayetteville Regional Office and myself made a compliance inspection of the warehouse facility on January 16, 1997. From our inspection it appears that only Phase One of your project has been completed and no wetlands have been impacted as of yet. Please be aware that your Nationwide Permit from the US Army Corps of Engineers (USACOE) has likely expired and if so, your 401 Water Quality Certification will have expired also. You should contact the USACOE Wilmington field office to see if you need to renew your authorization to impact the wetlands on your project site. Should you need to reapply for USACOE authorization you will also need to reapply for the 401 Water Quality Certification. Your cooperation in adhering to the conditions of your 401 Water Quality Certification is appreciated. As we discussed on the telephone 4/23/93, the Cumberland Commercial Warehouse is expected to "consume" approximately 2.3 acres of a densely shrubbed pocosin. This site is near the Cumberland County Industrial Park, much of which is in wetlands and often the subject of local discussion. Using the new evaluation sheet, the rating came up to a score of only 49, mainly because of the distance to the actual stream and the lack of development upstream. The applicant claims to have cut back substantially on his original plans, which included draining as much area as possible and constructing more warehouses. He has used all of his high ground available to the maximum extent possible and has a storm water basin already in place. I am not sure of the details concerning the retention basin shown at the south end of the project. However, it appears reasonable to assume that water quality impacts will be held to a minimum and that the applicant should be issued the appropriate certification, with the condition that no permanent ditching be left in place to de-water the remaining jurisdictional wetland after the work (fill) is completed. If you have the time, and would be interested in visiting the proposed "canyon fill" at Ft. Bragg, let me know and we will make the necessary arrangements. It is possible, however, that much of the area involved is not a jurisdictional wetland or stream due to the massive amount of sediment. Water flows somewhere underneath the sand and resurfaces downstream in the sediment fan. The current plan is to pipe this canyon and backfill to near original grade, installing drop inlets in the swale in order to prevent a recurrence of the existing situation. The pipe is to discharge onto a fabriform concrete mat set at zero grade in order to slow the flow to a non-erosive velocity. If this is possible, it may prevent movement of the existing sediment further downstream. The drawback is that noticeably less storm flow will be filtered through the sand.
