Gentlemen:
Through coordination with the North Carolina Division of Coastal
Management, we have learned of the modification of your State permit which
authorizes you to construct two piers and a raised walkway and construct and
backfill a bulkhead on Queen Ann's Creek, Edenton Bay, Albemarle Sound, south
of Edenton, Chowan County, North Carolina. The modification provides for
replacement of a bridge and dressing approximately 180 linear feet of
riprapped shoreline.
Your revised proposal has been reviewed and found to be consistent with
the provisions and objectives of general permit No. CESAW-C080-N-000-0291.
Therefore, you may commence construction activity in strict accordance with
your modified State authorization and Coastal Engineering and Surveying,
Incorporated, plan dated January 12, 1993. Failure to comply with the State
authorization or conditions of the general permit could result in civil and/or
administrative penalties.
If any further change in your work is required because of unforeseen or
altered conditions or for any other reason, plans revised to show the change
must be sent promptly to this office and the North Carolina Division of
Coastal Management prior to performing any such change or alteration. Such
action is necessary as revised plans must be reviewed and the authorization
modified.

Certification may be used in qualifying for coverage under Corps.

The agent for the applicant has requested a major modification of CAMA Major Permit
#126-92 issued on January 27, 1993. The applicant desires to replace the existing bridge over
Queen Anne Creek with a new wooden bridge and dress approximately 180 feet of rip rapped
shoreline with additional granite rock.
The owners of Edenton Bay own the tract of land on the south bank of Queen Anne
Creek in the town of Edenton, Chowan County. The bridge crosses Queen Anne Creek at its
confluence with Edenton Bay.
The Edenton town government has approved the subdivision plats for the Edenton Bay
subdivision. A condition of this approval is the issuance of a one year temporary access
easement over the existing bridge and the private lane connecting the bridge to the subdivision
through the property of Gilliam Wood. At the end of one year, the bridge and lane will return
to the private use of the Gilliam Wood family.
Queen Anne Creek is classified as inland waters by the NC Division of Marine Fisheries.
It is part of CAMA's Public Trust Area of Environmental Concern.
The Edenton Bay is classified as SC waters by the NC Division of Environmental
Management and is also classified as part of the Estuarine System Area of Environmental
Concern by LAMA.

The existing wooden bridge is twelve feet wide and approximately 120 feet long. it is
made of treated wood and has approximately a 5.2 foot maximum vertical clearance. The
applicant desires to remove this bridge and replace it with it new wood bridge. The proposed
bridge would have the same dimensions and have a maximum vertical clearance of 8.0 feet. The
applicant desires to construct a 4' x 120' cantilevered walkway along the hew bridge. The
existing bridge is regularly used by pedestrian traffic which must walk on the roadway at this
time.
Crossing Queen Anne Creek upstream from the existing bridge is a sewer/utility line.
The applicant does not intend to make any changes to this existing sealer/utility line crossing.
The applicant would like to place granite rock over existing rip rap along the shoreline
adjacent to the bridge on the north bank. This material would improve the esthetics of the
existing rip rap and reduce the potential for shoreline erosion along the north end of the Queen
Anne Creek bridge.
The proposed work (demolition of the old bridge and construction of the new bridge) will
cause a temporary increase in the turbidity levels of Queen Anne Creek. The depth of the creek
in the vicinity of the bridge is approximately 14 feet. This depth and the prevailing current in
the creek may make the use of a "filter barrier" difficult. The construction of it cantilevered
walkway will create an insignificant increase in shading of the public trust water§. There are
no submerged aquatic plants in the projects vicinity to affect.
The proposed rip rap may result in extending the toe of the existing rip tap waterward
an additional foot. The existing rip rap does not extend more than a maximum of 4 feet
waterward of mean high water. No coastal wetlands will be impacted by the applicant's rip rap
plans.
The bridge site connects to the Gilliam Woods property also know as the historic Mayes
Plantation. There are no know historically important sites in the immediate area of the bridge.
The existing bridge restricts boat navigation up Queen Anne Creek from Edenton Bay. The
proposed bridge will afford approximately 3 feet more clearance then the existing bridge. Boat
navigation up Queen Anne Creek may not be substantially improved by this project but it will
certainly not be reduced.
No SAV's exist with the project area and no remnant species of plant hor animal have
been noted in the area.

THE STRUCTURE. THE ENGINEER ESTIMATED THE COST OF REPAIR AND
ALSO REVIEWED A NUMBER OF ALTERNATIVES FOR ACCESS ACROSS THIS
NARROW WATERBODY. OUR FINAL DETERMINATION WAS TO REPLACE THE
BRIDGE WITH A NEW WOOD CONSTRUCTION. BY TAKING THIS APPROACH
TO REPLACEMENT OF THE BRIDGE, WE COULD BRING THE BRIDGE UP TO
A CONDITION WHICH WOULD ENHANCE SAFE PASSAGE, BE IN KEEPING
WITH THE SCALE AND STYLE OF THE AREA,•INCREASE VERTICAL AND
HORIZONTAL CLEARANCES AND PROVIDE FOR 'A SEPARATE WALKWAY.
THE NEW BRIDGE WILL BE PLACED IN THE SAME LOCATION AS THE OLD
AND WILL NOT REQUIRE FILL IN WETLANDS OR WATERS TO PREPARE
THE APPROACH. THE EXISTING ROCK RIPRAP ALONG THE SHORELINE
WILL BE DRESSED TO PROVIDE ADDITIONAL-STABILIZATION OF THE
SHORELINE AND TO PREVENT UNDERCUTTING OF THE EXISTING
CONCRETE ABUTMENTS.

SUBJECT: Major Modification of the Edenton Bay, Inc. Major Permit #126-92, Chowan
County
DATE: February 3, 1993
The agent for the applicant has requested a major modification of CAMA Major Permit
#126-92 issued on January 27, 1993. The applicant desires to replace the existing bridge over
Queen Anne Creek with a new wooden bridge and dress approximately 180 feet of rip rapped
shoreline with additional granite rock.
The owners of Edenton Bay own the tract of land on the south bank of Queen Anne
Creek in the town of Edenton, Chowan County. The bridge crosses Queen. Anne Creek at its
confluence with Edenton Bay.
The Edenton town government has approved the subdivision plats for the Edenton Bay
subdivision. A condition of this approval is the issuance of a one year temporary access
easement over the existing bridge and the private lane connecting the bridge to the subdivision
through the property of Gilliam Wood. At the end of one year, the bridge and lane will return
to the private use of the Gilliam Wood family.
Queen Anne Creek is classified as inland waters by the NC Division of Marine Fisheries.
It is part of CAMA's Public Trust Area of Environmental Concern.
.The Edenton Bay is classified as SC waters by the NC Division of Environmental
Management and is also classified as part of the Estuarine System Area of Environmental
Concern by LAMA.

The existing wooden bridge is twelve feet wide and approximately 120 feet long. It is
made of treated wood and has approximately a 5.2 foot maximum vertical clearance. The
applicant desires to remove this bridge and replace it with a new wood bridge. The proposed
bridge would have the same dimensions and have a maximum vertical clearance of 8.0 feet. The
applicant desires to construct a 4' x 120' cantilevered walkway along the new bridge. The
existing bridge is regularly used by pedestrian traffic which must walk on the roadway at this
time.
Crossing Queen Anne Creek upstream from the existing bridge is a sewer/utility line.
The applicant does not intend to make any changes to this existing sewer/utility line crossing.
The applicant would like to place granite rock over existing rip rap along the shoreline
adjacent to the bridge on the north bank. This material would improve the esthetics of the
existing rip rap and reduce the potential for shoreline erosion along the north end of the Queen
Anne Creek bridge.
The proposed work (demolition of the old bridge and construction of the new bridge) will
cause a temporary increase in the turbidity levels of Queen Anne Creek. The depth of the creek
in the vicinity of the bridge is approximately 14 feet. This depth and the prevailing current in
the creek may make the use. of a "filter barrier" difficult. The construction of a cantilevered
walkway will create an insignificant increase in shading of the public trust waters. There are
no submerged aquatic plants in the projects vicinity to affect.
The proposed rip rap may result in extending the toe of the existing rip rap waterward
an additional foot. The existing rip rap does not extend more than a maximum of 4 feet
waterward of mean high water. No coastal wetlands will be impacted by the applicant's rip rap
plans.
The bridge site connects to the Gilliam Woods property also know as the historic Hayes
Plantation. There are no know historically important sites in the immediate area of the bridge.
The existing bridge restricts boat navigation up Queen Anne Creek from Edenton Bay. The
proposed bridge will afford approximately 3 feet more clearance then the existing bridge. Boat
navigation up Queen Anne Creek may not be substantially improved by this project but it will
certainly not be reduced.
No SAV's exist with the project area and no remnant species of plant nor animal have
been noted in the area.

Reference the application of the Edenton Bay Company for a modification to
the State/Department of the Army permit which authorizes construction of two
piers and a raised walkway and construction and backfill of a bulkhead on
Queen Ann's Creek, Edenton Bay, Albemarle Sound, south of Edenton, Chowan
County, North Carolina. The modification is to replace an existing bridge and
dress approximately 180 linear feet of riprapped shoreline.
The Federal agencies have completed review of the proposal as presented by
the application for modification and Mr. Richard Watts' memorandum of February
