Dear Mr. Parker:
Reference the State permit issued to Ocean Isle Partners, Incorporated,
represented by Mr.. John Sutton, which authorizes the constrcution of
approximately 2,700 linear feet of paved roadway and installation of
underground utilities on property adjacent to Old Sound Creek, Ocean Isle
Beach, Brunswick County, North Carolina. Also, reference Mr. E. F. Brook's
September 30, 1993 memorandum regarding the permittee plans to modify his
State permit to construct an 800-foot-long bulkhead aligned landward of the
mean high water (MHW) elevation contour and outside any areas subject to our
jurisidiction purusuant to Section 404 of the Clean Water Act.
The work, as described by Mr. Brook, does not require Federal
authorization; and therefore, we have no objections to modification of the
State permit.

This letter confirms the May 28, 1993 meeting between your agents,
Messrs. Jay Houston and Don Covil, and Mr. Mickey Sugg of my staff on your
property located on S.R. 1144 (West First Street), adjacent Old Sound Creek,
Ocean Isle Beach, 0-xurii*yy North Carolina. The purpose of this
meeting was to inspect the property for waters and wetlands subject to
Department of the Army (DA) permitting authority and to discuss your proposed
plans to construct Ross and Summer Place Subdivisions.
The site investigation revealed that waters and wetlands subject to DA
permitting authority exist only along the north property line, adjacent old
Sound Creek. No interior jurisdictional wetlands are present on the
approximately 16-acre tract of land. Mr. Sugg established the wetland/upland
boundary along the shoreline by using pink flagging. Any activity that takes
place landward of the boundary would not require any Federal permits.
However, issuance of Department of the Army authorization must precede any
placement of excavated or fill material in Section 404 wetlands waterward of
the pink flags on your property. Any unauthorized activity would be a
violation of Federal law.
Before you undertake any work, we strongly suggest that the wetlands be
surveyed and platted on a property map. Such mapping would help you avoid any
unintentional disturbance of wetlands on the site and would assist your
planning and be essential to any application for a permit which you might
submit. Surveyed wetland lines, shown on property maps, must be field
verified and confirmed in writing by our staff to be acceptable.
Enclosed is a copy of a Wetland Determination Form, providing specific
information obtained at stations on your property. The data on this form
support the delineation of wetlands on your property in accordance with the
criteria set forth in the 1987 U.S. Army Corps of Engineers' Wetland
Delineation Manual.

and utilities) for a new subdivision, consisting of 88 single-family lots.

The project site is located approximately 1/2 mile west of the causeway that enters the
Town of Ocean Isle Beach, after crossing the Atlantic Intracoastal Waterway (AIWW).
The sixteen (16) acre site is bordered on south by West 1st Street, and on the west by
Duneside Drive. The tract is 800 feet wide along W. 1st ST. and averages 900 feet in
depth to Old Sound Creek, which borders the site along its north side. The tract consists
primarily of large dunes, reaching elevations of 34 feet MSL. The dunes are vegetated
with Sea Oats, cactus, and other grasses. The dune troughs, or low areas are more
densely vegetated with shrubs, primarily Wax Myrtle. The USACOE has completed field
investigation of these low areas and verbal confirmation has been received that there are
no federally regulated wetlands within the interior of this tract. The elevation of the
north side of the property drops sharply, from approximately 20 feet MSL to a coastal
marsh border along Old Sound Creek at 3-5 feet MSL. Adjacent to the highground, there
is a transition area of irregularly flooded, high coastal wetlands, varying in width from
20 to 60 feet along the shoreline variegations. Coastal wetland species include: artin
patens, Distichlis Micata, Limomium, spp., and alicorni , spp. A border of artin
glterniflora completes the vegetation to open water. This smooth cordgrass border is
narrow on the northeast corner of the property, but expands to over 200 feet wide along
the reminder of the creek-front shoreline.
Although the proposed project is not oceanfront, the southern portion of the subdivision
is within the Ocean Hazard Area of Environmental Concern, designated by the North
Carolina Coastal Resources Commission. In the project area, the long term average
annual erosion rate is 2 feet/year. The Ocean Hazard AEC extends landward from the
Atlantic Ocean, 420 feet from the first line of stable, natural vegetation. The waters of
Old Sound Creek (Eastern Channel) are classified as SA by the N.C. Division of
Environmental Management, and are OPEN to the harvest of shellfish. The N. C.
Division of Marine Fisheries have not designated Eastern Channel as a Primary Nursery
Area, however, the extensive marshes from the north side of the creek to the AIWW,
are designated as PNA.
The applicants propose to establish three residential subdivisions on the 16 acre tract.
Crouse subdivision will consist of the oceanfront and second row lots. These lots were
previously platted and are currently being developed on the ocean side of the property.
Summer Place Subdivision consists of the middle portion of the tract, and Ross
Subdivision occupies the third of the property adjacent to the sound. The applicants
propose to grade the entire tract to a finish elevation of approximately 12 feet MSL.
Grading of the high sand dunes to that elevation would provide adequate fill material for
the low areas. Soil disturbance would be terminated 40 - 60 feet landward of mean high
water on the northern side (creek side) of the property and temporary silt fences would
be installed along the perimeter of graded area. Approximately 2700 L.F. of paved road

would be constructed on the property. The paved road width would be 20 feet. Summer
Place Subdivision would be accessed from West 1st Street. A rectangular roadway would
access interior lots and provide utilities distribution. Ross Subdivision would be accessed
by the continuation of West 4th Street from Duneside Drive through the subdivision. All
utilities are proposed underground within the road right-of-ways. Municiple water and
sewer would be provided by the Town of Ocean Isle Beach.
10. ANTICIPATED IMPACTS
The proposed project will result in the loss of some of the largest and highest dunes on
Ocean Isle Beach. The dunes are considered secondary dunes, as frontal and primary
dunes exist on the oceanfront lots. Given the sandy soil characteristics, the soil
disturbance over such a large area will create a serious potential for wind erosion on the
site. It will also be difficult to establish vegetative stabilization without irrigation or the
importation of a more water retentive topsoil.

9. PROTECT DESCRIPTION 6121/93
The project site is located approximately 1/2 mile west of the causeway that enters the
Town of Ocean Isle Beach, after crossing the Atlantic Intracoastal Waterway (AIWW).
The sixteen (16) acre site is bordered on south by West 1st Street, and on the west by
Duneside Drive. The tract is 800 feet wide along W. 1 st ST. and averages 900 feet in
depth to Old Sound Creek, which borders the site along its north side. The tract consists
primarily of large dunes, reaching elevations of 34 feet MSL. The dunes are vegetated
with Sea Oats, cactus, and other grasses. The dune troughs, or low areas are more
densely vegetated with shrubs, primarily Wax Myrtle. The USACOE has completed field
investigation of these low areas and verbal confirmation has been received that there are
no federally regulated wetlands within the interior of this tract. The elevation of the
north side of the property drops sharply, from approximately 20 feet MSL to a coastal
marsh border along Old Sound Creek at 3-5 feet MSL. Adjacent to the highground, there
is a transition area of irregularly flooded, high coastal wetlands, varying in width from
20 to 60 feet along the shoreline variegations. Coastal wetland species include: artina
patens, Distichlis Vicata, Limomium, spp., and alicornia, spp. A border of artina
alterniflora completes the vegetation to open water. This smooth cordgrass border is
narrow on the northeast corner of the property, but expands to over 200 feet wide along
the reminder of the creek-front shoreline.
Although the proposed project is not oceanfront, the southern portion of the subdivision
is within the Ocean Hazard Area of Environmental Concern, designated by the North
Carolina Coastal Resources Commission. In the project area, the long term average
annual erosion rate is 2 feet/year. The Ocean Hazard AEC extends landward from the
Atlantic Ocean, 420 feet from the first line of stable, natural vegetation. The waters of
Old Sound Creek (Eastern Channel) are classified as SA by the N.C. Division of
Environmental Management, and are OPEN to the harvest of shellfish. The N.C.
Division of Marine Fisheries have not designated Eastern Channel as a Primary Nursery
Area, however, the extensive marshes from the north side of the creek to the AIWW,
are designated as PNA.
The applicants propose to establish three residential subdivisions on the 16 acre tract.
Crouse subdivision will consist of the oceanfront and second row lots. These lots were
previously platted and are currently being developed on the ocean side of the property.
Summer Place Subdivision consists of the middle portion of the tract, and Ross
Subdivision occupies the third of the property adjacent to the sound. The applicants
propose to grade the entire tract to a finish elevation of approximately 12 feet MSL.
Grading of the high sand dunes to that elevation would provide adequate fill material for
the low areas. Soil disturbance would be terminated 40 - 60 feet landward of mean high
water on the northern side (creek side) of the property and temporary silt fences would
be installed along the perimeter of graded area. Approximately 2700 L.F. of paved road

would be constructed on the property. The paved road width would be 20 feet. Summer
Place Subdivision would be accessed from West 1st Street. A rectangular roadway would
access interior lots and provide utilities distribution. Ross Subdivision would be accessed
by the continuation of West 4th Street from Duneside Drive through the subdivision. All
utilities are proposed underground within the road right-of-ways. Municiple water and
sewer would be provided by the Town of Ocean Isle Beach.
10. ANTICIPATED IMPACTS
The proposed project will result in the loss of some of the largest and highest dunes on
Ocean Isle Beach. The dunes are considered secondary dunes, as frontal and primary
dunes exist on the oceanfront lots. Given the sandy soil characteristics, the soil
disturbance over such a large area will create a serious potential for wind erosion on the
site. It will also be difficult to establish vegetative stabilization without irrigation or the
importation of a more water retentive topsoil.
