Blanton 8935 Old Federal Road Ball Ground, Georgia 30107 Dear Mr. Blanton: Reference your application of February 18, 1993, for Department of the Army authorization to retain two culverted stream crossings on Bryson Creek and an unnamed tributary thereof, and to construct a small recreational pond on the tributary at your property off S.R. 1326 in Unaka, Cherokee County, North Carolina. The pond construction will impact 0.18 acre of waters of the United States. The projects have been reviewed by the N.C. Wildlife Resources Commission (WRC). Bryson Creek is a tributary to Beaverdam Creek which is a Designated Public Mountain Trout Water. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits (NWP). Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters provided: a. the discharge does not cause the loss of more than 10 acres of waters of the United States; b. the permittee notifies the District Engineer if the discharge would cause the loss of waters of the United States greater than one acre in accordance with the "Notification" general condition. For discharges in special aquatic sites, including wetlands, the notification must also include a delineation of affected specific aquatic sites, including wetlands; and c. the discharge, including all attendant features, both temporary and permanent, is part of a single and complete project. Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided for fills for roads crossing waters of the United States (including wetlands and other special aquatic sites) provided: I -2- a. The width of the fill is limited to the minimum necessary for the actual crossing; b. The fill placed in waters of the United States is limited to a filled area of no more than one-third acre. Furthermore, no more than a total of 200 linear feet of the fill for the roadway can occur in special aquatic sites, including wetlands; C. The crossing is culverted, bridged or otherwise designed to prevent the restriction of, and to withstand, expected highflows and the movement of aquatic organisms; d. The crossing, including all attendant features, both temporary and permanent, is part of a single and complete project for crossing of a water of the United States; and e. For fills in special aquatic sites, including wetlands, the permittee notifies the District Engineer in accordance with the "Notification" general condition. Your work is authorized by these NWP provided it is accomplished in strict accordance with the enclosed conditions, and those outlined in the attached March 4, 1993 WRC letter. These NWP do not relieve you of the responsibility to obtain any required State or local approval. Information regarding issuance of a Section 401 Water Quality Certification may be obtained through John Dorney, Division of Environmental Management, at (919) 733-1786. This verification will be valid for 2 years from the date of this letter unless the NWP authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the NWP authorization is reissued without modification or the activity complies with any subsequent modification of the NWP authorization. If during the 2 years, the NWP authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the NWP, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the NWP will remain authorized provided the activity is completed within 12 months of the date of the NWP's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization. Davis, Assistant Fisheries Biologist DATE: March 4, 1993 SUBJECT: Review of a 404 permit application by Dr. Jim T. Long to drain a 0.065 acre wetland area in a pasture located off of SR 1448 (N. Jones Creek Road) near Franklin, Macon County- Dr. Jim T. Long (70 Jones Creek Rd. Franklin, NC 28734) is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) in order to obtain a 404 permit from the U. S. Army Corps of Engineers. I have reviewed the information provided by the applicant, and an onsite investigation was conducted on February 23, 1993, for the purpose of assessing potential construction impacts on wildlife and fisheries resources. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Dr. Long proposes to reopen and replace 3 old drainage tiles that are no longer functioning in low lying areas of open pasture. The area to be drained is less than .10 acre and vegetation consists of fescue with several clumps of Juncus sp. The tiles will drain into Jones Creek and its tributaries. The purpose is to enhance the pasture for grazing and improve wildlife habitat in the surrounding area. Jones Creek (LTN 1-40-14) is a tributary to Cartoogechaye Creek which is Designated Public Mountain Trout Water (DPMTW) and managed by the NCWRC as a Hatchery Supported trout stream. This stream has a bankfull width of 8-10 feet and a substrate of boulders, cobble, and sand-silt. It provides good quality habitat and supports a wild trout population as well as '& )."^ t9PA iP#tA `Y='?"5.: { it _.. I s s. populations of other nongame species. The project should not impact any wetlands or habitats that would likely support any endangered, threatened or special concern species. The NCWRC does not object to the issuance of a permi"_., provided the following conditions are met by the applicant: 1) Erosion control measures should be installed prior to the start of construction and maintained until the project site has been stabilized. 2) Temporary ground cover (e.g. hardwood mulch, straw, etc.) should be placed on all bare soil during construction. Permanent vegetation in these same areas should be established within 15 days of project completion to provide long term erosion control. 3) Consult NCWRC Wildlife Biologist concerning wildlife plantings and development of the wetland area adjacent to Jones Creek.
