Lee Energy Complex Toxicity testing for new outfall NPDES Permit: NC0003417 Wayne County Dear Ms. Moore: Upon commencement of discharge (outfall 003), one of the requirements of the facility's NPDES permit is to collect and analyze 5 discrete toxicity samples within 90 days.. Due to unforeseen circumstances, the discharge from this outfall was ceased on February. l; 2013. Wastewater flows are being segregated and are being maintainedonsite in the facility's cooling pond treatment system until such time that additional evaluation and corrective- action can take place.. At the time of the cessation of discharge, the plant had .. not yet taken. any of the Toxicity samples. It was the intent of the plant staff to take those samples beginning at a later date after an;appropriate shakedown period of the new wastewater system had occurred. Staff from Progress Energy's Environmental Services Section have discussed this with staff of the DWQ's Washington Regional office (WaRO) and have kept that office apprised of the status of the wastewater discharge. Mt. Robbie Bullock, of the WaRO indicated to us that he had. discussed this matter with you and that. we should submit this notification to your office for inclusion with the facility's files: Upon resumption of the discharge to outfall 003, facility staff will complete the requirement for toxicity sampling within 90 days. It is unknown at this time when the resumption of discharge will occur however is likely that it will be beyond the 90 days of the original commencement of discharge.
