Bucher Assistant Director Science and Stewardship The Nature Conservancy Suite 223, Carr Mill Mall Carboro, North Carolina 27510 Dear Ms. Bucher: Reference your application of April 12, 1993, for Department of the Army authorization to excavate a 50-foot by 20-foot channel, 3 to 4-foot deep, in an existing borrow pit at your Green Swamp preserve off N.C. Highway 211 north of Supply, Brunswick County, North Carolina. All spoil will be distributed within the existing borrow pit without creating uplands. The purpose of this work is to provide a water source for a helicopter with a water bucket for wildfire suppression. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits (NWP). Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters. Your work is authorized by this NWP provided it is accomplished in strict accordance with the enclosed conditions and provided you receive a Section 401 water quality certification from the North Carolina Division of Environmental Management You should contact Mr. John Dorney, telephone (919) 733-1786, regarding this certification. This NWP does not relieve you of the responsibility to obtain other required State or local approval. This verification will be valid for 2 years from the date of this letter unless the NWP authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if,'during that period, the NWP authorization is reissued without modification or the activity complies with any subsequent modification of the NWP authorization. If during the 2 years, the NWP authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the NWP, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the NWP will remain authorized . . a provided the activity is completed within 12 months of the date of the NWP's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization. A Copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 26. It is our intend to deepen a small section of an existing borrow. pit in our Green Swamp preserve in Brunswick County,; North, Carolina, John, Federal Paper.Board has cootacted`us with a.request`to provide `a water source for a helicopter with a,water bucket in the event of wildfire suppression in the area. Providing this water source would be for the benefit of any agency or company in fighting fires in the area. A map locating our preserve and the borrow pit, within .the area is.attached. The actual deepening of a 50 x 20 feet channel by 3-4 feet- will be undertaken by Federal Paper Board Company. The spoil from the deepening will be distributed within the existing borrow pit` without creating uplands within. The 'borrow pit was originally created to provide fill for NC 211. About 10 to 15 feet of ` the borrow pit rim is sparsely vegetated with Eriocaulon spp., Utriculara spp., and Polygala`spp. Please feel free to cull me if you have any q-qast-1ors regarding this project.
