Upon review of your request for 401 Water Quality Certification to place fill material in
1.09 acres of wetlands or waters which are tributary to Rocky River for road construction
located at SR 1445 and Hwy 29 in Cabarrus County, as described in your submittal dated 28
April 1993, we have determined that the proposed fill can be covered by General Water
Quality Certification No. 2671 and 2732 issued January 21, 1992. Copies of the General
Certification are attached. These Certifications may be used in qualifying for coverage under
Corps of Engineers' Nationwide Permit No's. 26 and 14.

Dear Mr. McCrain:
Thank you for your inquiry of July 31, 1992 regarding plans by Interstate
Combined Ventures to construct a 3.2 mile long connector road on a new
location between US Highway 29 and Derita Road (SR 1445) near the Charlotte
Motor Speedway at Concord, Cabarrus County, North Carolina. The proposed road
would cross six separate, headwaters tributaries to the Rocky River.
Mr. Steven Lund of my Asheville staff originally reviewed this proposal
back in November of 1991. At that time it was decided that the work was
authorized by Department of the Army Nationwide Permits No. 14 and 26 for
minor road crossing fills and work above stream headwaters. Since substantial
resources have been already been committed to this project, the grace period
provisions of the 1986 nationwide permits will apply. Work may proceed under
the terms and conditions of the former nationwide permits until January 13,
1993. Any work in waters and wetlands that is not completed by this date
should be reauthorized under the terms and conditions of the 1992 nationwide
permits including applicable notification procedures.
