8. PROJECT SUMMARY: The applicant proposes to transfer the existing permit to
his name, and modify the project to expand the dredging limits by 106,000 square
feet, relocate and upgrade the design of the mooring dolphins, add two additional
mooring dolphins on highground, redesign and relocate the pier, add an additional
pier, and include the repair of the existing bulkhead.

9. PROTECT DESCRIPTION
The project site is on the west side of the Cape Fear River, approximately 1,000 feet
south of the Cape Fear Memorial Bridge, in Brunswick County. The site is accessed
by an unimproved road off the entrance road to the U.S.S. Battleship North Carolina
Memorial.
The existing 8.34 acres marine terminal is bulkheaded along its 800' shoreline
adjacent to the Cape Fear River. The property includes two office buildings, two
work/storage buildings, and a gentry crane and rail system at the waterfront. The
remainder of the site is marled storage yard. The Cape Fear River is approximately
1,000 feet wide in the project area with.a 16 foot water depth at the bulkhead. The
shipping channel of the Cape Fear River is approximately 550 feet wide in the project
area and is located from 290 feet to 340 feet waterward of the bulkhead (near bottom
edge). The channel is maintained at a depth of 40 feet by the U.S. Army Corps of
Engineers. The Cape Fear River is classified SC by the N.C. Division of
Environmental Management, and is a primary nursery area classified by the N. C.
Division of Marine Fisheries.
The applicant is in the process of purchasing project site from Eagle Island Marine,
Inc., and is requesting to transfer the permit to his company name, as well as ,
modify the permit to accommodate his development plan. The applicant proposes to
provide extended berthing for one or two (moored in tandem) large ships (up to 700
ft. long X 100 ft. wide) to facilitate maintenance, repairs, loading, and unloading.
The applicant proposes two additional mooring dolphins on highground and to
upgrade the design of the mooring dolphins to accommodate the load of two vessels
moored in tandem. Engineered specifications include ten (10) pipe or concrete pilings
per dolphin, with concrete caps and dual pipe bollards. The two breasting dolphins
would be located approximately 25 feet waterward of the bulkhead, in the central area
of the property, and would be equipped with fender systems. The two mooring
dolphins would be located on the highground, one on the north and one on the south
side of the property. The applicant proposes two elevated docks adjacent to the
bulkhead. The largest would be located 15 feet off the northern property line, 60 feet
long, extending 15 feet waterward of the bulkhead. This pier will facilitate ingress
and egress to the stern of the moored vessels. A second pier, 20 feet long and 15 feet
wide, is proposed adjacent to the bulkhead, slightly north of the center of the
property. The applicant proposes to expand the area to be dredged, by flaring the
northern and southern ends of the permitted dredge limits, thus, allowing the ships to
maneuver in and out of the mooring facility. The proposed flares would extend north
and south from the landward corners of the existing dredging limits on a 45 degree
angle to the Cape Fear River channel. This would expand the length of the dredging
limit along the channel from 800 feet to 1290 feet. The applicant proposes to reduce
the dredging depth from 32 feet to 30 feet. The applicant has also proposed. the
replacement of the existing bulkhead. The necessity for this work would depend on
the results of an underwater structural survey of the existing bulkhead. Should the
wall require complete replacement, a new steel or concrete sheet pile structure is
proposed two feet water-ward of the existing bulkhead.

10. ANTICIPATED IMPACTS
The proposed project would increase the area to be excavated from the permitted
160,000 square feet to 266,000 square feet. The dredging expansion would create
approximately 15,000 cubic yards of additional spoils material. The proposed mooring
of two ships in tandem, 700 feet in length, would occupy approximately 14,000
square feet of estaurine and public trust waters.

Reference your Department of the Army (DA) permit to maintain and enlarge

Cape Fear Memorial Bridge, Wilmington Harbor, .W"runswick County, North
Carolina.
Because of considerations for public safety and through coordination with
Captain of the Port, U.S. Coast Guard, Marine Safety Office, Wilmington, North
Carolina, I have determined a need to further condition your (DA) permit.
Pursuant to 33 CFR 324.7, your DA permit is hereby modified to include the
following special conditions prior to any work authorized by this permit:
- The permittee will provide to the Captain of the Port, U.S. Coast Guard,
Marine Safety Office, Wilmington, North Carolina, any and all information as
may be requested regarding structural stability of facilities, mooring
arrangements, and emergency contingency planning. The permittee will comply
with any and all directives and/or recommendations of the Captain of the Port.
Neither the facility nor any part of any ships moored at the facility shall
extend closer than 50 feet to the bottom edge of the navigable channel.

Reference the application of Atlantic Diving and Marine Contractors,
Incorporated, represented by Mr. Kevin G. Walker, for a Department of the Army
permit to maintain and enlarge a ships' berth, relocate and upgrade mooring
dolphins, install two additional dolphins, relocate a pier, construct a second
pier and replace and backfill a bulkhead on the Cape Fear River, immediately
downstream and southwest of the Cape Fear Memorial Bridge, Wilmington Harbor,
Brunswick County, North Carolina
The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
a. All work authorized by this permit must be performed in strict
compliance with the permit plans.
b. The new bulkhead will not be positioned farther waterward than two (2)
feet from the alignment of the existing bulkhead.
c. All backfill materials will be obtained from a highground source and
confined landward of the permitted bulkhead.
d. The fill material will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials, or unsightly debris will
not be used as fill.
e. All excavated materials will be confined landward of the mean high
water (MHW) elevation contour within adequate dikes or other retaining
structures to prevent spillover of solids into any vegetated wetlands or
surrounding waters.

f. Prior to any placement of excavated material in the Corps of
Engineers' retention area on Eagle Island, the permittee will obtain specific
permission from the Navigation Branch, Construction-operations Division,
Wilmington District, Corps of Engineers.
g. The terminal end of the pipeline from the dredge into the diked
retention area will be positioned at or greater than 50 feet from any part of
the dike and a maximum distance from spillways to prevent dike erosion and to
allow adequate settlement of suspended solids.
h. A water control structure will be installed at the intake end of the
effluent pipe leading from the retention area in order to ensure maximum
settlement of suspended solids.
i. Flow from the diked retention area will be confined by pipe, trough,
or similar device to a point at or below the mean low water (MLW) elevation
contour to prevent gully erosion and siltation.
j. No vegetated wetlands will be excavated or filled.
k. Excavation will not exceed thirty (30) feet below the elevation of
mean low water (MLW).
1. This permit does not authorize the interference with any existing or
proposed Federal project, and the permittee will not be entitled to
compensation for damage or injury to the authorized structure or work which
may be caused from existing or future operations undertaken by the United
States in the public interest.
m. No attempt will be made by the permittee to prevent the full and free
use by the public of all navigable waters at or adjacent to the authorized
work. Use of the permitted activity must not interfere with the public's
right to free navigation on all navigable waters of the United States.
n. If the display of lights and signals on the authorized structure is
not otherwise provided for by law, such lights and signals as may be
prescribed by the U.S. Coast Guard will be installed and maintained by and at
the expense of the permittee.
o. The permittee will maintain the authorized work in good condition and
in conformance with the terms and conditions of this permit. The permittee is
not relieved of this requirement if he abandons the permitted activity without
having it transferred to a third party.
p. The activity will be conducted in such a manner as to prevent a
significant increase in turbidity outside the area of construction or
construction-related discharge. Increases such that the turbidity in the
waterbody is 25 NTU's or less are not considered significant.

q. If the permittee discovers any previously unknown historic or
archeological remains while accomplishing the authorized work, he will
immediately notify the Wilmington District Engineer who will initiate the
required State/Federal coordination.
r. This permit does not grant any property rights or exclusive
privileges.

feet, relocate and upgrade the design of the mooring dolphins, add two additional
mooring dolphins on highground, redesign and relocate the pier, add an additional
pier, and include the repair of the existing bulkhead.

9. PROTECT DESCRIPTION
The project site is on the west side of the Cape Fear River, approximately 1,000 feet
south of the Cape Fear Memorial Bridge, in Brunswick County. The site is accessed
by an unimproved road off the entrance road to the U.S.S. Battleship North Carolina
Memorial.
The existing 8.34 acres marine terminal is bulkheaded along its 800' shoreline
adjacent to the Cape Fear River. The property includes two office buildings, two
work/storage buildings, and a gentry crane and rail system at the waterfront. The
remainder of the site is marled storage yard. The Cape Fear River is approximately
1,000 feet wide in the project area with a 16 foot water depth at the bulkhead. The
shipping channel of the Cape Fear River is approximately 550 feet wide in the project
area and is located from 290 feet to 340 feet waterward of the bulkhead (near bottom
edge). The channel is maintained at a depth of 40 feet by the U.S. Army Corps of
Engineers. The Cape Fear River is classified SC by the N.C. Division of
Environmental Management, and is a primary nursery area classified by the N. C.
Division of Marine Fisheries.
The applicant is in the process of purchasing project site from Eagle Island Marine,
Inc., and is requesting to transfer the permit to his company name, as well as ,
modify the permit to accommodate his development plan. The applicant proposes to
provide extended berthing for one or two (moored in tandem) large ships (up to 700
ft. long X 100 ft. wide) to facilitate maintenance, repairs, loading, and unloading.
The applicant proposes two additional mooring dolphins on highground and to
upgrade the design of the mooring dolphins to accommodate the load of two vessels
moored in tandem. Engineered specifications include ten (10) pipe or concrete pilings
per dolphin, with concrete caps and dual pipe bollards. The two breasting dolphins
would be located approximately 25 feet waterward of the bulkhead, in the central area
of the property, and would be equipped with fender systems. The two mooring
dolphins would be located on the highground, one on the north and one on the south
side of the property. The applicant proposes two elevated docks adjacent to the
bulkhead. The largest would be located 15 feet off the northern property line, 60 feet
long, extending 15 feet waterward of the bulkhead. This pier will facilitate ingress
and egress to the stern of the moored vessels. A second pier, 20 feet long and 15 feet
wide, is proposed adjacent to the bulkhead, slightly north of the center of the
property. The applicant proposes to expand the area to be dredged, by flaring the
northern and southern ends of the permitted dredge limits, thus, allowing the ships to
maneuver in and out of the mooring facility. The proposed flares would extend north
and south from the landward corners of the existing dredging limits on a 45 degree
angle to the Cape Fear River channel. This would expand the length of the dredging
limit along the channel from 800 feet to 1290 feet. The applicant proposes to reduce
the dredging depth from 32 feet to 30 feet. The applicant has also proposed the
replacement of the existing bulkhead. The necessity for this work would depend on
the results of an underwater structural survey of the existing bulkhead. Should the
wall require complete replacement, a new steel or concrete sheet pile structure is
proposed two feet waterward of the existing bulkhead.

10. ANTICIPATED IMPACTS
The proposed project would increase the area to be excavated from the permitted
160,000 square feet to 266,000 square feet. The dredging expansion would create
approximately 15,000 cubic yards of additional spoils material. The proposed mooring
of two ships in tandem, 700 feet in length, would occupy approximately 14,000
square feet of estaurine and public trust waters.

An accurate work plat (including plan view and cross
sectional drawings) drawn to scale in black ink on an 8
1/2 x 11 white paper. (Refer to Coastal Resources
Commission Rule 7J.0203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 18 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is apart
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the
site. Include county road (SR) numbers, landmarks, and
the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit comments
on the proposed project to the Division of Coastal
Management and should be advised by the applicant of
that opportunity.
