Youngblood for a modification to his Department of the Army (DA) permit which authorizes the construction of three docks in a manmade boat basin off Bogue Sound, Asbury Beach Subdivison, Atlantic Beach,rrteret County,"?North Carolina. The proposed modification involves dock and pier reconfiguration, installation of pilings, construction of a wooden walkway and maintenance of a basin. We have reviewed the proposed modification, as presented by Mr. David Noble's memorandum of July 26, 1993, and we recommend that the following conditions be included in the State authorization: a. All work authorized by this permit must be performed in strict compliance with the permit plans. b. All excavated materials will be confined landward of the mean high water (MHW) elevation contour and any regularly or irregularly flooded vegetated wetlands. c. No vegetated wetlands will be excavated or filled. d. Excavation will not exceed three (3) feet below the elevation of mean low water (MLW). e. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. f. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. AUG 18 10 11 , . _ -2- g. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. h. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 25 NTU's or less are not considered significant. NARRATIVE DESCRIPTION: The applicant's project, known as Asbury Beach Subdivision, is located on a man-made canal, off Bogue Sound, on E. Fort Macon Road, in Atlantic Beach, Carteret County. The applicant received CAMA Major Permit #53-88 in 1988. The applicant dredged an existing canal to a water depth of -3'/s' MLW and constructed 7 docks. The applicant originally received a permit for the construction of 10 docks, but, the permit has subsequently expired. The applicant proposes to construct the 3 previously permitted docks under this permit application. This will bring the total slips to ten (10). The 3 proposed docks are 6' x 23' and will serve residents of the subdivision. 10. ANTICIPATED IMPACTS: The proposed docks will occupy 414 sq. ft. of Public Trust Waters in a man-made boat basin. The waters of the canal and basin are classified as 'SA' by the Division of Environmental Management and are closed to shellfishing by the Division of Environmental Health and Division of Marine Fisheries. The applicant received CAMA Major Permit #53-88 in 1988. The applicant dredged an existing canal to a water depth of -31/2' MLW and constructed 7 docks. The applicant originally received a permit for the construction of 10 docks, but, the permit has subsequently expired.
