Per Application Instruction A and 15A NCAC 02T .0106(b)(4), the application shall be signed by an executive officer, elected official in the highest level of elected office, or any authorized employee. Please either submit a delegation letter pursuant to the requirements in 15A NCAC 02T .0106(c) authorizing Pat Ivey to sign on behalf of the Applicant, or resubmit the application with the proper signing official. B. Pronerty Ownership Documentation: 1. Per 15A NCAC 02T .0106(b), provide property ownership documentation for the land containing the proposed temporary containment ponds that demonstrates the Applicant has one of the following: a. legal documentation of ownership, such as a contract, deed, or article of incorporation; b. an agreement of an intent to purchase the property that is written, notarized, and signed by both parties, accompanied by a plat or survey map; or c. an agreement to lease the property that is written, notarized, and signed by both parties, indicating the intended use of the property, accompanied by a plat or survey map. Lease agreements shall adhere to the requirements of 15A NCAC 02L .0107. C. Site Man f 15A NCAC 02T .110440ill1: 1. The submitted site plans do not have a clear reference point that shows the orientation or locations of the treatment units. Per 15A NCAC 02T .1104(a)(1), submit a site _ map for the _proposed_ tempo storage site that includes: a. a scaled map of the site, with topographic contour intervals not exceeding 10 feet or 25 percent of total site relief and showing all facility -related structures and fences within the treatment and storage areas; b. the location of each of the following that are located within 500 feet of a waste treatment, or storage site, including a delineation of their review and compliance boundaries: (i) wells, including usage and construction details if available; (ii) ephemeral, intermittent, and perennial streams; (iii) springs; (iv) lakes; (v) ponds; and (vi) other surface drainage features; c. setbacks as required by Rule .1108 of this Section; and d. site property boundaries within 500 feet of all treatment and storage facilities. Mr. Tim M. Little July 12, 2019 Page 3 of 3 D. Enp-ineerine Plans 115A NCAC 02T .1104(a)(2)(A)I: 1. Per Application Instruction E and 15A NCAC 02T .1104(a)(2)(A), a North Carolina licensed Professional Engineering shall sign, seal, and date the engineering plans. Please resubmit the engineering plans accordingly. 2. Per Application Instruction E, amend the submitted engineering plans to include plan and profile views of the three earthen basins detailing their dimensions and elevations, as well as their associated piping, valves, and equipment. E. Specifications 115A NCAC 02T .1104(a)(2)(B)I: Per Application Instruction E and 15A NCAC 02T .1104(a)(2)(B), a North Carolina licensed Professional Engineer shall sign, seal, and date the specifications. The specifications shall also include a description of the materials to be used, methods of construction, and means for ensuring quality and integrity of the finished product, including leakage testing. The specifications shall also include an explanation as to how the existing erosion control settling ponds will be modified into their proposed use. F. Engineering Calculations 115A NCAC 02T .1104(a)(2)(C)1: 1. The engineering calculations use 25% of the total estimated Wet Slurry Volume and freeboard requirement for stormwater to calculate the required capacity of storage for the basins, but no calculation was provided to determine if this would be adequate. Please provide a water balance that justifies the size of the basins. Please note that the Division of Water Resources requires that open -atmosphere basins have at least two feet of freeboard. G. Wastewater Reuse 115A NCAC 02U1: Section III of the Diamond Grinding Slurry Management Plan, Appendix 1, and the Summary on page 3 of Appendix 2 all indicate that the last pond in the system will be used as a reservoir for clean water that would be collected for reuse in mechanical diffusion and in grinding operations. If wastewater is to be reused in a beneficial reuse operation, the treatment system and effluent shall meet the requirements of 15A NCAC 02U. The requirements include mandatory tertiary treatment, effluent standards requirements listed in 15A NCAC 02U .0300, and the design standards listed in 15A NCAC 02U .0400. If beneficial reuse is considered, an application meeting the requirements of 15A NCAC 02U is required. If beneficial reuse is not considered, the Diamond Grinding Slurry Management Plan, Appendix 1, and Appendix 2 shall be amended to remove the reuse option, and a new method for disposal of the supernatant wastewater shall be added. H. Residuals Mana ement 115ANCAC 02T .1109 a 1 : It is mentioned in Section I1 and Section IV of Diamond Grinding Slurry Management Plan and Appendix 1 of the application that the resulting dry cake from the basins will be incorporated as a beneficial fill in restoring the unlined basins to natural ground and establishing slopes for the roadway. However, this activity would constitute a Surface Disposal Unit (SDU) permit, rather than a Distribution of Class A Residuals permit. Condition III.6. of the current permit dated March 1, 2019 does not permit the use of this Class A residuals as a fill because using in such a manner would exceed agronomic rates and could cause nuisance conditions or contravention of groundwater standards. Dry cake residuals from the basins shall either be applied in accordance with the current permit, landfilled, or an SDU permit shall be obtained from the Division. Please make any applicable changes to the application forms based on how the solids will be handled.
