Upon review of your request for 401 Water Quality
Certification to place fill material in 0.05 acres of wetlands or
waters which are tributary to Hog Island Bay for minor road
crossing located in Carteret County, we have determined that the
proposed fill can be covered by General Water Quality
Certification No. 2732 issued January 21, 1992. A copy of the
General Certification is attached. This Certification may be
used in qualifying for coverage under Corps of Engineers'
Nationwide Permit No. 14.

wetland area.

9. NARRATIVE DESCRIPTION: The applicant's property consists of an
approximately .86 acre tract of land located off NC Hwy. 12 and adjacent to Cedar
Island Bay, in the community of Cedar Island, Carteret County. To reach the
property, one would take the second driveway past the Cedar Island Volunteer Fire
Department Building with the lot being located at the fork in the road.
The lot can be characterized as having two (2) wetland areas. The wetland area closest
to the road is approximately 9,000 sq. ft. in size and is vegetated primarily with pond
and loblolly pine, fern, myrtle, fedder bush, red bay, etc. This area appears to be
physically isolated from the waters of Cedar Island Bay and is impounded only after
excessive rainfall events. The wetland area adjacent to the shoreline is approximately
3,600 sq. ft. in size and is vegetated primarily with SSpartina patens, myrtle and live
oak. An approximately 5-15' wide area of asphalt material has previously been placed
along the waters edge in an attempt to provide shoreline stabilization. A septic tank
has also been placed on the upland portion of the property.
Waters of Cedar Island Bay have been classified as Outstanding Resource Waters
(ORWs) and 'SA' and are open to the harvesting of shellfish.
In order to gain access to an upland building site, the applicant is requesting a permit
to construct an approximately 100' long x 20' wide x 6" to V high access road through
the wetland pocket that is adjacent to the existing driveway.
10. ANTICIPATED IMPACTS: The project as proposed will result in approximately
2,000 sq. ft. of '404' wetlands being impacted. The applicant is eligible for a
Nationwide Permit (#14). A Major Permit is required since development is being
undertaken within 575' of ORWs.

8 ADDITIONAL INFORMATION
In addition to the completed application form, the follow-
ing items must be submitted:
A copy of the deed (with state application only) or other
instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the
deed or other instrument under which the owner claims
title, plus written permission from the owner to carry out
the project.
An accurate work plat (including plan view and cross
sectional drawings) drawn to scale in black ink on an 8
1/2 x 11 white paper. (Refer to Coastal Resources
Commission Rule 7J.0203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 18 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a part
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the
site. Include county road (SR) numbers, landmarks, and
the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit comments
on the proposed project to the Division of Coastal
Management and should be advised by the applicant of
that opportunity.

property, one would take the second driveway past the Cedar Island Volunteer Fire
Department Building with the lot being located at the fork in the road.
The lot can be characterized as having two (2) wetland areas. The wetland area closest
to the road is approximately 9,000 sq. ft. in size and is vegetated primarily with pond
` and loblolly pine, fern, myrtle, fedder bush, red bay, etc. This area appears to be
physically isolated from the waters of Cedar Island Bay and is impounded only after
excessive rainfall events. The wetland area adjacent to the shoreline is approximately
3,600 sq. ft. in size and is vegetated primarily with SSpartina patens, myrtle and live
oak. An approximately 5-15' wide area of asphalt material has previously been placed
along the waters edge in an attempt to provide shoreline stabilization. A septic tank
has also been placed on the upland portion of the property.
Waters of Cedar Island Bay have been classified as Outstanding Resource Waters
(ORWs) and 'SA' and are Qen to the harvesting of shellfish.
In order to gain access to an upland building site, the applicant is requesting a permit
to construct an approximately 100' long x 20' wide x 6" to V high access road through
the wetland pocket that is adjacent to the existing driveway.
10. ANTICIPATED IMPACTS: The project as proposed will result in approximately
2,000 sq. ft. of '404' wetlands being impacted. The applicant is eligible for a
Nationwide Permit (#14). A Major Permit is required since development is being
undertaken within 575' of ORWs.

8 ADDITIONAL INFORMATION
In addition to the completed application form, the follow-
ing items must be submitted:
A copy of the deed (with state application only) or other
instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the
deed or other instrument under which the owner claims
title, plus written permission from the owner to carry out
the project.
An accurate work plat (including plan view and cross
sectional drawings) drawn to scale in black ink on an 8
1/2 x 11 white paper. (Refer to Coastal Resources
Commission Rule 7J.0203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 18 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a part
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the
site, Include county road (SR) numbers, landmarks, and
the like.

9 CERTIFICATION AND PERMISSION

Dear Ms. Panzarella:
Please reference your Nationwide Permit No. 14 (PDN) application received
on January 28, 1993, for Department of the Army authorization to impact
approximately 0.045 acres of jurisdictional wetlands for an access road on
your property. The property is located off Highway 12, Lot No. 36, adjacent
to Cedar Island Bay, Cedar Island, Carteret County, North Carolina.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits (NWP).
Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899
and Section 404 of the Clean Water Act, was provided for fills for roads
crossing waters of the United States (including wetlands and other special
aquatic sites) provided:
a. The width of the fill is limited to the minimum necessary for the
actual crossing;
b. The fill placed in waters of the United States is limited to a filled
area of no more than 1/3 acre. Furthermore, no more than a total of 200
linear feet of the fill for the roadway can occur in special aquatic sites,
including wetlands;
C. The crossing is culverted, bridged or otherwise designed to prevent
the restriction of, and to withstand, expected highflows and the movement of
aquatic organisms;
d. The crossing, including all attendant features, both temporary and
permanent, is part of a single and complete project for crossing of a water of
the United States; and
e. For fills in special aquatic sites, including wetlands, the permittee
notifies the District Engineer in accordance with the "Notification" general
condition.

Your work is authorized by this NWP provided it is accomplished in strict
accordance with the enclosed conditions. This NWP does not relieve you of the
responsibility to obtain any required State or local approval. You should
contact Mr. John Dorney, North Carolina Division of Environmental Management,
(919) 733-5083, to obtain the necessary Section 401, Water Quality
Certification prior to starting work.
This verification will be valid for 2 years from the date of this letter
unless the NWP authorization is modified, reissued, or revoked. Also, this
verification will remain valid for the 2 years if, during that period, the NWP
authorization is reissued without modification or the activity complies with
any subsequent modification of the NWP authorization. If during the 2 years,
the NWP authorization expires or is suspended or revoked, or is modified, such
that the activity would no longer comply with the terms and conditions of the
NWP, activities which have commenced (i.e., are under construction) or are
under contract to commence in reliance upon the NWP will remain authorized
provided the activity is completed within 12 months of the date of the NWP's
expiration, modification or revocation, unless discretionary authority has
been exercised on a case-by-case basis to modify, suspend, or revoke the
authorization.
