Davis for a Department of the Army permit to construct and backfill a bulkhead on Back Sound, Harkers Island, Carteret County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. All work authorized by this permit must be performed in strict compliance with the permit plans. b. The bulkhead will not be positioned farther waterward than 5 feet from the mean high water (MHW) elevation contour at any point along its alignment. c. All backfill materials will be obtained from a highground source and confined landward of the permitted bulkhead. d. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. e. No vegetated wetlands will be excavated or filled. f. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. g. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or r V -2- construction-related discharge. Increases such that the turbidity in the waterbody is 25 NTU's or less are not considered significant. FIELD INVESTIGATION REPORT: STACY DAVIS, CARTERET COUNTY PAGE #2 NOTE: The applicant originally applied for a General Permit, but due to objections by the western adjacent property owner, a Major Permit is required. 9. NARRATIVE DESCRIPTION: The applicant owns four (4) small lots (#8, #9, #10 and #11) between SR1335 and Back Sound, on Harkers Island, in Carteret County. The property is located near the eastern end of Harkers Island, approximately 1/10 of a mile before Calico Jack's Marina. The lots average approximately 23' x 50'. Lots #9, #10 and #11 were bulkheaded in 1990 and a boat ramp and pier were constructed all of which were authorized under CAMA General Permit #C-5933. Other than the ramp, pier and bulkhead, the property is undeveloped. The applicant proposes to bulkhead the 23' of shoreline on Lot #8 at a maximum of 5' beyond MHW. The applicant is also proposing a 15' wing wall down the western property line. This proposed bulkhead location will be in alignment with the adjacent bulkhead. The shoreline of Back Sound in the vicinity of the project has an erosion rate of 6' per year according to SCS-USDA. 10. ANTICIPATED IMPACTS: The waters of Back Sound are classified as "SA - ORW" by the Division of Environmental Management and are Qp?,n to shellfishing by the Division of Environmental Health and Division of Marine Fisheries. The proposed bulkhead will require filling approximately 115 sq. ft. of shallow intertidal sandy beach with approximately 15 cu. yds. of sand fill material. PROJECT SUMMARY: The applicant proposes to construct 23' of bulkhead. FIELD INVESTIGATION REPORT: STACY DAVIS, CARTERET COUNTY PAGE #2 NOTE: The applicant originally applied for a General Permit, but due to objections by the western adjacent property owner, a Major Permit is required. 9. NARRATIVE DESCRIPTION: The applicant owns four (4) small lots (#8, #9, #10 and #11) between SR1335 and Back Sound, on Harkers Island, in Carteret County. The property is located near the eastern end of Harkers Island, approximately 1/10 of a mile before Calico Jack's Marina. The lots average approximately 23' x 50'. Lots #9, #10 and #11 were bulkheaded in 1990 and a boat ramp and pier were constructed all of which were authorized under CAMA General Permit #C-5933. Other than the ramp, pier and bulkhead, the property is undeveloped. The applicant proposes to bulkhead the 23' of shoreline on Lot #8 at a maximum of 5' beyond MHW. The applicant is also proposing a 15' wing wall down the western property line. This proposed bulkhead location will be in alignment with the adjacent bulkhead. The shoreline of Back Sound in the vicinity of the project has an erosion rate of 6' per year according to SCS-USDA. 10. ANTICIPATED IMPACTS: The waters of Back Sound are classified as "SA; ORW", by the , DiN r?=.ion of Environmental Management and a open to shell; the Division of Environmental Health and Division of Marine Fisheries. The proposed bulkhead will require filling approximately 115 sq. ft. of shallow intertidal sandy beach with approximately 15 cu. yds. of sand fill material. An accurate work plat (including plan view and cross sectional drawings) drawn to scale in black ink on an 8 1/2 x 11 white paper.
