Under the administrative rules of our regulatory program, denial of required State authorization precludes favorable consideration of a Federal permit. Accordingly, your Department of the Army application is hereby denied, and your file has been retired. Additionally, by letter of October 14, 1993 (copy enclosed), the U.S. Fish and Wildlife Service (USFWS) recommended denial of your application. Their reaction to your proposal is the result of anticipated significant adverse impacts. I have provided USFWS' comments to alert you to concerns in addition to those identified in the State's denial letter. While appealing the State permit is the next step in pursuing State authorization, you should be aware that the USFWS' comments will be unchanged by the outcome of that appeal. Because of the USFWS' influence on Department of the Army permit decisions, it is unlikely a Department of the Army permit would be available unless your project can be modified to lessen its impacts. Davis for a Department of the Army permit to extend a sandbag bulkhead on the Atlantic Ocean, Bald Head Island, Brunswick County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. By letters of October 14 and 25, 1993 (copies enclosed), the U.S. Fish and Wildlife Service (USFWS) has recommended that authorization be denied. The USFWS anticipates that accomplishment of the work would adversely affect fish, wildlife and plant habitats specifically damaging coquina clams, mole crabs, oystercatchers, numerous gulls, willets and the threatened loggerhead sea turtle and seabeach amaranth. Also, it is a general policy of the USFWS to oppose hardening structures on sand beaches. Additionally, it appears that the length of the sandbag bulkhead that presently exists was constructed without benefit of Federal authorization. This situation is presently being reviewed with regard to what action may be appropriate. At this time, we concur with the recommendation of the USFWS that authorization to extend the sandbag bulkhead be denied. PROJECT SUMMARY: The applicant proposes to extend an existing oceanfront sandbag bulkhead to protect adjacent undeveloped property. r Walter R. Davis Page 2 9. PROJECT DESCRIPTION 8/27/93 The project is located on the oceanfront of Bald Head Island on Sandspur Trail. Bald Head Island is a coastal barrier island located south of Fort Fisher, between Corncake Inlet and the mouth of the Cape Fear River, in Brunswick County. The island is accessed by private ferry from Southport. The applicant owns six (6) lots on Sandspur Trail, however only four (4) of the lots (#1089, #1090, #1091, #1092) are oceanfront. The project area consists of Lots 1089, 1090, and 1092. The applicant maintains a residence on lot 1091, and a sandbag bulkhead was previously permitted to protect that structure (State Permit #127-92, 12/8/92). The project area lots are undeveloped, and exhibit typical dune vegetation, including sea oats, smilax, and yucca. The oceanward side (south) of the project area consists of a man-made dune which was created by bulldozing the beach to cover the previously permitted project with sand. The dune is approximately 40-45 feet wide to its waterward toe. The dune is unvegetated and its crest is approximately 10 feet higher in elevation than the adjacent beach. The dune extends completely across lots 1092 and 1091, and approximately 45 feet across the east side of lot 1090. The applicant's plat indicates that the MHW contour lies approximately 50 feet waterward of the toe of the man-made dune. In the project area, the long-term average annual erosion rate is 3 feet per year (LTAAER pg. 2 of 14). This area of Bald Head Island beach received renourishment in December 1991, however, future renourishment, may or may not, be availible. The waters of the Atlantic Ocean are classified SB by the N.C. Division of Environmental Management. The applicant proposes to expand his existing sandbag bulkhead by extending the structure 85 feet to the east, across lot 1092, and 97 feet west, across lot 1090. The elevation and dimensions of the proposed structure would be the same as the previously permitted sandbag bulkhead, 15 feet wide at the base, three rows of sandbags high (approximately 8 ft. high), stacked in a right triangle configuration. Pilings (8 in. dia. X 8 ft.) would be installed, five (5) feet on center on the ocean side of the structure. The applicant proposes to fill the sandbags by pumping sand from below mean low tide, and then cover the entire structure by bulldozing sand from the beach. 10. ANTICIPATED IMPACTS The proposed project would disturb a total area of approximately 26,390 square feet of unvegetated (14,560 s.f.) and intertidal (11,830 s.f.) beach. A substantial amount of excavation of the existing man-made dune will be required to install the proposed structure. There would be some short-term turbidity associated with the filling of sandbags with sand pumped from below MLW, as well as with the beach bulldozing activity. However no long-term adverse impacts from the ground disturbance are anticipated, as long as the beach bulldozing activity is limited to a timeframe outside of the sea turtle nesting and hatching season. PROTECT DESCRIPTION 8/27/93 The project is located on the oceanfront of Bald Head Island on Sandspur Trail. Bald Head Island is a coastal barrier island located south of Fort Fisher, between Corncake Inlet and the mouth of the Cape Fear River, in Brunswick County. The island is accessed by private ferry from Southport. The applicant owns six (6) lots on Sandspur Trail, however only four (4) of the lots (#1089, #1090, #1091, #1092) are oceanfront. The project area consists of Lots 1089, 1090, and 1092. The applicant maintains a residence on lot 1091, and a sandbag bulkhead was previously permitted to protect that structure (State Permit #127-92, 12/8/92). The project area lots are undeveloped, and exhibit typical dune vegetation, including sea oats, smilax, and yucca. The oceanward side (south) of the project area consists of a man-made dune which was created by bulldozing the beach to cover the previously permitted project with sand. The dune is approximately 40-45 feet wide to its waterward toe. The dune is unvegetated and its crest is approximately 10 feet higher in elevation than the adjacent beach. The dune extends completely across lots .1092 and 1091, and approximately 45 feet across the east side of lot 1090. The applicant's plat indicates that the MHW contour lies approximately 50 feet waterward of the toe of the man-made dune. In the project area, the long-term average annual erosion rate is 3 feet per year (LTAAER pg. 2 of 14). This area of Bald Head Island beach received renourishment in December 1991, however, future renourishment, may or may not, be availible. The waters of the Atlantic Ocean are classified SB by the N. C. Division of Environmental Management. The applicant proposes to expand his existing sandbag bulkhead by extending the structure 85 feet to the east, across lot 1092, and 97 feet west, across lot 1090. The elevation and dimensions of the proposed structure would be the same as the previously permitted sandbag bulkhead, 15 feet wide at the base, three rows of sandbags high (approximately 8 ft. high), stacked in a right triangle configuration. Pilings (8 in. dia. X 8 ft.) would be installed, five (5) feet on center on the ocean side of the structure. The applicant proposes to fill the sandbags by pumping sand from below mean low tide, and then cover the entire structure by bulldozing sand from the beach. 10. ANTICIPATED IMPACTS The proposed project would disturb a total area of approximately 26,390 square feet of unvegetated (14,560 s.f.) and intertidal (11,830 s.f.) beach. A substantial amount of excavation of the existing man-made dune will be required to install the proposed structure. There would be some short-term turbidity associated with the filling of sandbags with sand pumped from below MLW, as well as with the beach bulldozing activity. However no long-term adverse impacts from the ground disturbance are anticipated, as long as the beach bulldozing activity is limited to a timeframe outside of the sea turtle nesting and hatching season.
