Dear Mr. Williams:
Reference your application of August i0, 1993, whereby you applied for
Department of the Army (DA) authorization to install a 4-inch, subqueous
conduit with optical cable to span Gallant's Channel, Beaufort, Carteret
County, North Carolina.
On April 1, 1988, we renewed general permit No. 198100049, tcopy
enclosed) that authorizes the maintenance, repair and installation of aerial
and.subaqueous utility lines with attendant structures and the discharge of
excavated or fill materials, within construction/access corridors, associated
with utility line maintenance, repair and installation in navigable waters and
waters of the United States in the State of North Carolina.
Your proposed work is authorized if'you can comply with all general
permit conditions. Please read the enclosed permit to prevent an
unintentional violation of Federal law. As this DA general-permit does not
relieve you of the responsibility to obtain any other required approvals, you
should contact appropriate state and local agencies before beginning work.

Upon review of your request for 401 Water Quality Certification
to place fill material in waters which are tributary to Gallant's
Channel for drilling of a optical cable line located at US 70 in
Beaufort County as described in your submittal dated 10 September
1993, we have determined that the proposed fill can be covered by
General Water Quality Certification No. 2664. A copy of the General
Certification is attached. This Certification may be used in
qualifying for coverage under Corps of Engineers' Nationwide Permit
No. 12.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.
