The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. All work authorized by this permit must be performed in strict compliance with the permit plans. b. The bulkheads will be positioned in strict accordance with permit plans. To prevent an unintentional violation of this authorization, representatives of the North Carolina Division of Coastal Management and the Corps of Engineers will be avaialble to stake bulkhead alignments prior to construction. C. All backfill materials will be obtained from a highground source and confined landward of the permitted bulkhead. d. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. e. All excavated materials will be confined landward of the normal water elevation contour and any wetlands. 1k -2- f. No excavated or fill materials will be placed at any time in any vegetated wetlands or waters. g. No vegetated wetlands will be excavated or filled. h. Excavation will not exceed eight (8) feet below the elevation of normal water. i. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. j. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. k. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 1. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less are not considered significant. PROJECT SUMMARY: The applicant is proposing to upgrade an existing marine railway by performing maintenance excavation and by constructing various piers and bulkheads. Vic Cox - Cox Marine Railways Beaufort County Environmental Setting The project site is Cox Marine Railways which is located on a ±1 acre site on East Front Street in the Town of Belhaven adjacent to the north side of Pantego Creek in Beaufort County. The site has been utilized as a marine railway for many years, however, Mr. Cox purchased the property in 1992 an immediately began restoring the site. Located on the property at this time is a newly constructed office building and two renovated railways which extends from the head of a manmade basin to highground. The business office is being served by the Town of Belhaven's sewage disposal system. Also located on the property is a ±330' long manmade canal which provides access from Pantego Creek to the railways. The canal has an average width of ±34' and has an average depth of -6' at normal water. Pantego Creek has a depth of -10' at normal water immediately offshore of the canal. Located at the site is a variety of deteriorated piers and bulkheads. The southwest corner of the property is experiencing severe erosion. A deteriorated historical bulkhead is present at the southwest corner, however, it is not functioning at all as a bulkhead. The area between this deteriorated structure and the normal water line is covered by remnants of rusted cars and other marine debris. No wetland vegetation is located on the property, which is presently vegetated with various upland grasses. Project proposal. The applicant is proposing the following: (1) To add a hand rail to the existing 3' wide pier which is located on the southside of the existing basin. Also, the pier will be reinforced by adding new pilings every 81. (2) Extend the existing bulkhead on the northern side of the basin 20' into highground. (3) Replace the existing bulkhead and deck which is located on the northern side of the basin from where the dock begins to where it turns in a southern direction. This section of bulkhead will approximate the normal water line. (4) Extend a new bulkhead and dock along the same alignment as described in No. 2. This bulkhead and dock will be constructed within an area which is now highground. (5) The excavation of the highground and the removal of the existing dock which will be southwest of the bulkhead and dock described in No. 4. The area excavated will be incorporated into the existing basin. Vic Cox _ Cox Marine Railways " Beaufort County Page -_2 r' (6) The construction of a 4' wide by 75' long pier into Pantego Creek. The pier will be an extension of the dock which was described in No. 4. (7) The construction of a new bulkhead at the southwest corner of the property along an alignment which approximates the previously described deteriorated structure. The bulkhead will turn in a northeast direction which approximates the applicants property line. This section of bulkhead will encompass the area of rusty cars and other debris and will average 32' beyond the normal water line. The bulkhead will be 55' beyond the normal water line at the furthest point. (8) The construction of a 53' long by 8' wide dock waterward of the proposed bulkhead at the southwest corner. This dock will be placed atop deteriorated pilings and other debris existing in Pantego Creek. (9) The maintenance excavation of 235' of the existing basin. The average width of the area excavated will be ±34' and the final project depth will be -8' at normal water. This will mean the excavation of an average of ±3' of material within the basin. All spoils. will be removed to a highground site away from the property on which the project is located. (10) The landscaping of the highground portion of the property. Environmental impact The following environmental impacts will occur: (1) The filling of ±5,742 sq. ft. landward of the proposed bulkhead. This is thd.area that has the miscellaneous debris present. (2) The excavation of ±7,990 sq. ft. of area within the existing boat basin. This area contains the accumulation of various marine paints, engine oil, etc. that have accumulated with time. Measures have already begun to reduce these accumulations in the future. All excavated material will be removed to an approved highground site off of the property. (3) No wetland vegetation will be excavated and/or filled. David L. The Project site is located on 308 East Front Street along the shore of Pantego Creek. There are two existing railways on the site that terminate into a manmade mooring basin. Both sides of this basin are bordered by existing piers and docks that are mostly in need of repair or replacement. Mr. Cox proposes to add 6"-8" treated wood pilings every 8' with handrails along the narrow 3' wide pier on the south side of the basin. The March'93 storm weakened the pier. The dilapidated "side pier" attached to this pier will be removed. On the northern side of the basin, Mr. Cox proposes to extend the existing bulkhead some 20' landward from the existing landward end. The landward end of this new bulkhead will taper to the existing ground elevation. The existing bulkhead (under the dock) on the northern side of the basin is fragmented. He would like to repair/replace this bulkhead with an "in place replacement" to a point where the bulkhead/dock turns toward the basin. There are segments along this bulkhead that have been undermined. These areas will be backfilled with an upland source of fill (excavated from adjacent high ground above the 3' plane or trucked in from another site). At the point where the existing bulkhead makes the turn, Mr. Cox proposes to begin a new bulkhead and dock along the same alignment of the previously mentioned northern dock adjacent to the railways (see sheet 2 of 3) and continue it until it meets the old bulkhead (to be replaced) at the waterward property line. From there, and still continuing in a straight line, a new 75'x4' mooring pier is proposed to extend into Pantego Creek (see sheet 2 of 3). The high ground in front of the new bulkhead will be excavated to -8' and will, in effect, create a straight bulkhead/dock alignment beginning in front of the office and ending at the waterward end of the proposed pier. The existing bulkhead and dock from the existing "turn" to the waterward end will be removed. Just waterward of the old bulkhead (to be replaced with an "in place replacement") at the end of the property, there exists a series of pilings with attached automobile tires Out there years ago to abate wave action). Mr Cox proposes to cover this "eyesore" with a 8'x53' mooring dock. Greenville, North Carolina 27858-4353 East Carolina University is a constituent institution of The University of North Carolina. Also, years ago, efforts were made to stabilize this peninsula of land from erosion by the placement of crushed automobiles along the north and westward property lines. These cars (and car parts) extend from the existing NWL under the shallow water to the edges of the property. They are stacked 3 deep on top of each other, thereby making the installation of a bulkhead next to impossible in their midst. Pieces and parts of these old cars lay scattered along the NWL, are unsitely, and offer very little marine habitat potential. For these reasons, Mr. Cox proposes to install a bulkhead just inside the northeastern property line and "wrap-up" this littered area that serves no purpose. Backfill immediately behind this bulkhead (and all others) will come from adjacent high ground on site or trucked in from an approved upland site. A pile of 1200-1600 pound concrete blocks (pilars) have been stockpiled on the site. They will be used to stabilize the northwest corner of the proposed fill area (see sheet 2 of 3). Placed T behind the proposed bulkheads, they will serve to abate wave action until the bulkheads are constructed (which may take up to the three years allocated, since much of the work will be accomplished by the manager and one employee). At present, the existing mooring basin does not provide sufficient depth to accommodate the larger vessels that would otherwise patronize the business. Mr. Cox would like to excavate the basin and a high ground portion adjacent to the basin to a depth of 8', which is considerably less than the 11' receiving waters. In addition, all high ground from the office, waterward, above the 3' plane (above NWL) will be pushed by bulldozer towards Pantego Creek and used as fill behind the bulkheads. On July 21, a meeting took place on site with Debra Sawyer (DEM), Mr. Cox, and myself. Ms. Sawyer was shown the existing dropcloths (to catch the hand sanding debris and chips) and the existing filter system to trap contaminants before they can enter the basin. Mr. Cox uses an industrial vacuum to clean the dropcloths. Curtains will be installed prior to any proposed sandblasting in the future. It was determined at this meeting that because of the heavy metals present in the basin sediment, Mr. Cox will truck the excavated material from the basin to another site off the water and bring in backfill from still another site to be used as fill material. All engine work to be performed will be done on another site across town. (No engine work is presently done on this site.) All materials used for docks, piers, and bulkheads will be of treated wood. Salvageable pilings from docks and piers to be removed will be used, if practicable. There are no coastal wetlands oti this site. When all fill has been placed, Mr. Cox will bring in and spread 3"4" of topsoil from an upland source so that the lot can be seeded and grow satisfactory. It is hoped that the proposed improvements will enhance the function of the basin area, recapture land lost to unabated wave action, stabilize all new work, and provide customers a place to appreciate, when landscaped; thereby resulting in more business. The Project site is located on 308 East Front Street along the shore of Pantego Creek. There are two existing railways on the site that terminate into a manmade mooring basin. Both sides of this basin are bordered by existing piers and docks that are mostly in need of repair or replacement. Mr. Cox proposes to add 6"-8" treated wood pilings every 8' with handrails along the narrow 3' wide pier on the south side of the basin. The March '93 storm weakened the pier. The dilapidated "side pier" attached to this pier will be removed. On the northern side of the basin, Mr. Cox proposes to extend the existing bulkhead some 20' landward from the existing landward end. The landward end of this new bulkhead will taper to the existing ground elevation. The existing bulkhead (under the dock) on the northern side of the basin is fragmented. He would like to repair/replace this bulkhead with an "in place replacement" to a point where the bulkhead/dock turns toward the basin. There are segments along this bulkhead that have been undermined. These areas will be backfilled with an upland source of fill (excavated from adjacent high ground above the 3' plane or trucked in from another site). At the point where the existing bulkhead makes the turn, Mr. Cox proposes to begin a new bulkhead and dock along the same alignment of the previously mentioned northern dock adjacent to the railways (see sheet 2 of 3) and continue it until it meets the old bulkhead (to be replaced) at the waterward property line. From there, and still continuing in a straight line, a new 75'x4' mooring pier is proposed to extend into Pantego Creek (see sheet 2 of 3). The high ground in front of the new bulkhead will be excavated to -8' and will, in effect, create a straight bulkhead/dock `alignment beginning in front of the office and ending at the waterward end of the proposed pier.. The existing bulkhead and dock from the existing "turn" to the waterward end will be removed. Just waterward of the old bulkhead (to be replaced with an "in place replacement") at the end of the property, there exists a series of pilings with attached automobile tires (put there years ago to abate wave action). Mr Cox proposes to cover this "eyesore" with a 8'x53' mooring dock. Also, years ago, efforts were made to stabilize this peninsula of land from erosion by the placement of crushed autorriobiles along the north and westward property lines. These cars (and car parts) extend from the existing NWL under the shallow water to the edges of the property. They are stacked 3 deep on top of each other, thereby making the installation of a bulkhead next to impossible in their midst. Pieces and parts of these old cars lay scattered along the NWL, are unsitely, and offer very little marine habitat potential. For these reasons, Mr. Cox proposes to install a bulkhead just inside the northeastern property line and "wrap-up" this littered area that serves no purpose. Backfill immediately behind this bulkhead (and all others) will come from adjacent high ground on site or trucked in from an approved upland site. A pile of 1200-1600 pound concrete blocks (pilars) have been stockpiled on the site. They will be used to stabilize the northwest corner of the proposed fill area (see sheet 2 of 3). Placed T behind the proposed bulkheads, they will serve to abate wave action until the bulkheads are constructed (which may take up to the three years allocated, since much of the work will be accomplished by the manager and one employee). At present, the existing mooring basin does not provide sufficient depth to accommodate the larger vessels that would otherwise patronize the business. Mr. Cox would like to excavate the basin and a high ground portion adjacent to the basin to a depth of 8, which is considerably less than the 11' receiving waters. In addition, all high ground from the office, waterward, above the T plane (above NWL) will be pushed by bulldozer towards Pantego Creek and used as fill behind the bulkheads. On July 21, a meeting took place on site with Debra Sawyer (DEMO, Mr. Cox, and myself. Ms. Sawyer was shown the existing dropcloths (to catch the hand sanding debris and chips) and the existing filter system to trap contaminants before they can enter the basin. Mr. Cox uses an industrial vacuum to clean the dropcloths. Curtains will be installed prior to any proposed sandblasting in the future. It was determined at this meeting that because of the heavy metals present in the basin-sediment, Mr. Cox will truck the excavated material from the basin to another site off the water and bring in backfill from still another site to be used as fill material. All engine work to be performed will be done on another site across town. (No engine work is presently done on this site.) All materials used for docks, piers, and bulkheads will be of treated wood. Salvageable pilings from docks and piers to be removed will be used, if practicable. There are no coastal wetlands on this site. When all fill has been placed, Mr. Cox will bring in and spread 3"4" of topsoil from an upland source so that the lot can be seeded and grow satisfactory. It is hoped that the proposed improvements will enhance the function of the basin area, recapture land lost to unabated wave action, stabilize all new work, and provide customers a place to appreciate, when landscaped; thereby resulting in more business. Vic Cox Cox Marine Railways Beaufort County Environmental Setting The project site is Cox Marine Railways which is located on a ±1 acre site on East Front Street in the Town of Belhaven adjacent to the north side of Pantego Creek in Beaufort County. The site has been utilized as a marine railway for many years, however, Mr. Cox purchased the property in 1992 an immediately began restoring the site. Located or, the property at this time is a newly constructed office building and two renovated railways which extends from the head of a manmade basin to highground. The business office is being served by the Town of Belhaven's sewage disposal system. Also located on the property is a ±330' long manmade canal which provides access from Pantego Creek to the railways. The canal has an averaae width of ±34' and has an average depth of -6' at normal water. Pantego Creek has a depth of -10' at normal water immediately offshore of the canal. Located at the site is a variety of deteriorated piers and bulkheads. The southwest corner of the property is experiencing severe erosion. A deteriorated historical bulkhead is present at the southwest corner., however, it is not functioning at all as a bulkhead. The area between this deteriorated structure and the normal water line is covered by remnants of rusted cars and other marine debris. No wetland vegetation is located on the property, which is presently vegetated with various upland grasses. Pro-iect pronosal The applicant is nroposinc the following: '?) If the applicant is not claiming to be the owner of said property, then forward a copy of the deed or other instrument under which the owner claims title, plus written permission from the owner to carry out the project. An accurate work plat (including plan view and cross sectional drawings) drawn to scale in black ink on an 8 1/2 x 11 white paper. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or other larger plats are acceptable only if 18 high quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the site. Include county road (SR) numbers, landmarks, and the like. A stormwater management plan, if applicable, that may have been developed in consultation with the Division of Environmental Management. A list of the names and complete addresses of the adjacent waterfront (riparian) landowners. These individuals have 30 days in which to submit comments on the proposed project to the Division of Coastal Management and should be advised by the applicant of that opportunity.
