Upon review of your st for 401 Water Quality Certification
to place fill material in 0. acres of wetlands or waters which are
tributary to Little Buffalo Creek for removal of a gravel bar located
at SR 1682 in Ashe County as described in your submittal dated 1
October 1993, we have determined that the proposed fill can be covered
by General Water Quality Certification No. 2733. A copy of the
General Certification is attached. This Certification may be used in
qualifying for coverage under Corps of Engineers' Nationwide Permit
No. 18.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

Reference is made to your request of August 18, 1993, requesting
Department of the Army permit authorization for the placement of fill material
into Little Buffalo Creek in association with the reopening (removal of silts
and-gravel) of the aforementioned creek channel on your property located off
the intersection of NC 88 and NC 194, West Jefferson, Ashe County, North
Carolina. Reference is also made to the site visit conducted on September 1,
1993, by Mr. John Thomas of the Raleigh Regulatory staff at the aforementioned
site. The purpose of the site visit was to review plans for channel work
and to inspect the site for waters and wetlands subject to Department of the
Army permitting authority.
The meeting revealed that the proposed site is located adjacent, and above
the headwaters of, Little Buffalo Creek. The review of your proposed plans
indicates that reopening the creek channel will involve adverse modification
to 0.04 acre of waters and wetlands on the aforementioned tributary.
Final reference is made to Mr. Joe Mickey's letter of August 13, 1993, in
which the North Carolina Wildlife Resources Commission expressed no objections.
to the planned channel work provided that:
a. The channel work is limited to 190 linear feet in length.
b. The channel work is limited to-no more than 1 foot below the existing
stream bottom.
C. No heavy equipment is operated in the live streams in order to
minimize sedimentation and prevent introduction of other pollutants.
d. Temporary ground cover (e.g. hardwood mulch, straw, etc.) should be
placed on all bare soil during construction. Permanent vegetation in these
same areas should be established within 5 days of ground-disturbing activities
to provide longterm erosion control.
