Upon review of your request for 401 Water Quality Certification
to place fill material in less than one acre of wetlands or waters
which are tributary to New River for supply raw water for treatment
plant located 1000' upstream of Naked Creek in Ashe County as
described'in your submittal dated 1 July 1993, we have determined that
the proposed fill can be covered by General Water Quality
Certification Nos. 2664 & 2733 issued January 21, 1992. Copies of the
General Certifications are attached. These Certifications may be used
in qualifying for coverage under Corps of Engineers' Nationwide Permit
Nos. 12 & 18.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

Dear Ms. Ballou:
Through coordination with Mr. Vann Waters of McGill Associate (consultant
for project), we have learned of your plans for the proposed construction of a
raw water intake structure located off S.R. 1587 adjacent to South Fork New
River, Jefferson, Ashe County, North Carolina. Reference is also made to
Mr. Joe Mickey's letter of July 6, 1993, in which the North Carolina Wildlife
Resources Commission expressed no objections to the planned raw water intake
structure project provided that:
a. The intake structure will include a three-fourths inch mesh screen to
prevent fish impingement and entrainment.
b. The intake structure intake velocities will below 1.5 feet per second.
c. Erosion control measures should be implemented where soil is disturbed
and maintained until project completion.
Final reference is made to Mr. Jonathan F. Wild's letter of July 23, 1993,
in which the North Carolina Department of Parks and Recreation stated that the
proposed raw water intake location is upstream (not within the regulated area)
of the southernmost beginning point of the Wild and Scenic River section of
South Fork New River. The identified beginning point of this regulated.area
is at the confluence of Dog Creek and South Fork New River.
The plans / profiles for the aforementioned project provided with a
notification application form shows that you propose construction for the raw
water intake structure on the bank of South Fork New River. Included with
this structure is a 12' by 12' reinforced concrete pad that results in the
discharge of approximately 6 cubic yards of fill (reinforced concrete) in the
aforementioned river.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization,
pursuant to Section 10 of the Rivers and Harbors Act and Section 404 of the
Clean Water Act, was provided for discharges of dredged or fill material into
all waters of the United States provided:

a. The discharge does not exceed 25 cubic yards;
b. The discharge will not cause the loss of more than 1/10 acre of a
special aquatic site, including wetlands. For the purposes of this nationwide
permit, the acreage limitation includes the filled area plus special aquatic
sites that are adversely affected by flooding and special aquatic sites that
are drained so that they would no longer be a water of the.United States as a
result of the project;
Special conditions of this permit state that before discharging dredged or
fill material into waters of the United States occurring within the 25
mountain counties of North Carolina that contain trout waters, the applicant
will obtain a letter of approval from the North Carolina Wildlife Resource
Commission. Review of the information you have provided, and the comments
submitted by the North Carolina Wildlife Resources Commission, reveals that
your proposed work on the aforementioned river, is authorized by nationwide
permit provided it is accomplished in strict accordance with the enclosed
conditions and the recommendations.set forth by the Wildlife Resources
Commission. This nationwide permit does not relieve you of the responsibility
to obtain any required State or local approval. You should contact Mr. John
Dorney, North Carolina Division of Environmental Management, (919).733-1786,
to obtain the necessary Section 401, Water Quality Certification prior to
starting work.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization.
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain
authorized provided the activity is completed within 12 months of the date of
the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.

ggWe Co. A.A North Carolina. Reference is also made to Mr. Joe Mickey's
letter of July 6, 1993, in which the North Carolina Wildlife Resources
Commission expressed no objections to the planned raw waterline project
provided that:
a. Cofferdam construction required in the construction for the proposed
raw waterline creek crossings will be built in a manner whereby 1/2 of the
stream channel will remain open at all times.
b. Erosion control measures should be implemented where soil is disturbed
and maintained until project completion.
The plans/profiles for the aforementioned project provided with a
notification application form showed that you propose construction for the raw
waterline below natural grade within a 40-foot construction easement adjacent
Naked Creek.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits (NWP).
Authorization, pursuant to Section 404 of the Clean Water Act, was provided
for the discharge of material for backfill or bedding for utility lines,
including outfall and intake structures, provided there is no change in
pre-construction contours.
Special conditions of this permit state that before discharging dredged or
fill material into waters of the United States occurring within the
twenty-five mountain counties of North Carolina that contain trout waters, the

applicant will obtain a letter of approval from the North Carolina Wildlife
Resource Commission. Review of the information you have provided, and the
comments submitted by the North Carolina Wildlife Resources Commission,
reveals that your proposed work on the aforementioned creek, is authorized by

Dear Mr. Thomas:
Please find enclosed a signed Nationwide Permit application form and a set of plans on 81" X 11"
sheets on the above referenced project for your review. The project will involve construction of a new water
treatment plant on S.R. 1587 and intake on the New River for the Town of Jefferson in Ashe County.
A 12-inch raw waterline will supply water from the intake to the water plant and a 12-inch finished
waterline from the water plant to the Town's existing water system.
The Town of Jefferson wishes to apply for a Nationwide Permit No. 18 for the proposed intake
structure and a Nationwide Permit No. 12 for two creek crossings on the raw waterline involving Naked
Creek and Potter Branch. The plans include coffer dam details for the creek crossings. A similar coffer dam
will be required for construction of the intake structure.
Seven (7) copies of this application and the plans are being sent to Mr. John Dorney with the North
Carolina Department of Environment, Health, and Natural Resources and one (1) copy to Mr. Joe Mickey
of the Wildlife Resources Commission.
