Wright, for a Department of the Army permit to construct a community pier, dockage and a bridge on Beaver Dam Creek and the Atlantic Intracoastal Waterway (AIWW), Brassie Point, Saint James Plantation, west of Southport,.Brunswick County, North Carolina. The Federal agencies have completed review of the proposal as presented by the.application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. All work authorized by this permit must be performed in strict compliance with the permit plans. b. No vegetated wetlands will be excavated or filled. c. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United States in the public interest. d. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. e. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. f. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is A. -2- not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. g. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. PROTECT DESCRIPTION 6/22/93 The project is located in St. James Plantation, off N. C. Highway 211, approximately 6 miles west of Southport, N.C., in Brunswick County. The project site is a 14.2 acre tract, located in the southeast corner of the St. James Plantation development, at the confluence of Beaver Dam Creek and the Atlantic Intracoastal Waterway. The tract consists primarily of wetlands, with only 8.84 acres above the MHW contour. There is an island-like area of highground, approximately 1.25 acres in size. Elevation of the tract ranges from 2.8 feet MSL to 5.6 feet MSL on the highground portion of the island. The island is wooded in large pines, with a sparse understory of small oaks, red cedar and wax myrtle. The island is encircled by a narrow band of federally regulated wetlands, varying in width from 28 feet on the west side of the island to 90 feet on the southeast side of the island. Vegetation species include, Iva frutescens, Spartina patens, and Borrichia frutescens. This area transitions into a broad expanse of irregularly flooded coastal wetlands. Between the island and the mainland (approx. 300 feet), there is a lush stand of Distichlas spicata, occasionally intermingled with Juncus roemarianus, alic mi , spp., Limonium, spp., and a peripheral occurrence of Spartina cynosuroides. This high coastal marsh plateau reaches widths of 200 feet to the south, exhibiting a more uniform association of D. spicata, alic mia, spp., and imoniun, spp., with patches of J. roemarianus throughout.; The coastal wetlands terminate in a border of Snartina alterniflora, approximately 30-60 feet wide, which runs to the mud flat vertical escarpment along open water of the AIWW. This marsh vegetation pattern continues to the east of the island to Beaver Dam Creek. The width of the coastal wetlands border is narrowed in the area of a shallow cove extending toward the island from the main creek channel. The majority of the cove is dry at low water and numerous oyster clusters were evident throughout the mud bottom. North of the island, marsh width expands to even larger dimensions between the mainland and Beaver Dam Creek. The width of Beaver Dam Creek is approximately 192 feet in the project area, however the width of the waterbody in the area of the cove is extended to 350-390 feet. The waters of the AIWW and Beaver Dam Creek are classified SA by the N.C. Division of Environmental Management, and they are CLOSED to the harvest of shellfish. The AIWW is not considered to be a Primary Nursery Area, but Beaver Dam Creek is a designated PNA by the N.C. Division of Marine Fisheries. The National Flood Insurance Rate Map (Panel 360 of 395) lists the project area as an AE zone with a base flood elevation of 12 feet. The applicants propose to access the highground island from the St. James Plantation Development by constructing a wooden bridge. The bridge would be 310 feet long and 20 feet wide, elevated on pilings. Highground bridge abutments would be piling and girder cap with adjacent bulkhead wingwalls. The bridge would join an oval cul-de-sac with an open median to access seven (7) proposed single-family lots. The paved roadway width would be 18 feet. Wastewater disposal for the development would be provided by St. James Plantation wastewater treatment plant. A duplex grinder pump station is proposed within the open road median. Potable water would be provided to the development by the Brunswick County water system. Except for the wetland crossing Brassie Point Page 3 9. PROTECT DESCRIPTION where a utilities conduit would be attached to the bridge, all utilities would be installed underground. A stormwater retention basin (30 ft. X 30 ft.) is proposed adjacent to the cul-de-sac. The applicants have also proposed a community pier and docking structure. The pier would be located on a common easement between lots 4 and 5. The pier would be 425 feet long and 6 feet wide, terminating with a 25 feet by 15 feet deck. A ramp would connect to h floating dock structure, oriented roughly parallel to the channel of Beaver Dam Creek. The main dock would be approximately 120 feet long and 8 feet wide. Four (4) finger piers (12 feet long and 4 feet wide) would extend perpendicular from the main dock, 30 feet on center. A mooring piling would be placed between finger piers, creating a total of seven boat slips. 10. ANTICIPATED FvIPACTS The proposed bridge would shade approximately 4400 square feet of irregularly flooded coastal wetlands, and 1800 square feet of federally regulated wetlands. Temporary disturbance of wetlands, adjacent to the:bridge alignment, would be expected during the construction process. The proposed community dock would incorporate 3151 square feet of estaurine and public trust waters. An additional 1100 square feet of coastal wetlands would be shaded by the pier construction. There would be approximately 10,000 square feet of soil disturbance on the island's highground area by the installation of the road, cul-de-sac, and stormwater basin. Since highground area is limited on individual lots, the subsequent placement of elevated residencial structures into the island's perimeter of federally regulated wetlands is anticipated. PROJECT SUMMARY: The applicants propose to construct a bridge to a small island of highground to access a seven ('7) lot subdivision. The applicants are also proposing a community, pier and seven slip docking facility. T . Brassie Point Page 2 9. PROTECT DESCRIPTION 6/22/93 The project is located in St. James Plantation, off N. C. Highway 211, approximately 6 miles west of Southport, N.C., in Brunswick County. The project site is a 14.2 acre tract, located in the southeast corner of the St. James Plantation development, at the confluence of Beaver Dam Creek and the Atlantic Intracoastal Waterway. The tract consists primarily of wetlands, with only 8.84 acres above the MHW contour. There is an island-like area of highground, approximately 1.25 acres in size. Elevation of the tract ranges from 2.8 feet MSL to 5.6 feet MSL on the highground portion of the island. The island is wooded in large pines, with a sparse understory of small oaks, red cedar and wax myrtle. The island is encircled by a narrow band of federally regulated wetlands, varying in width from 28 feet on the west side of the island to 90 feet on the southeast side of the island. Vegetation species include, Iva frutescens, Svartina patens, and Borrichia frutescens. This area transitions into a broad expanse of irregularly flooded coastal wetlands. Between the island and the mainland (approx. 300 feet), there is a lush stand of Distichlas spicata, occasionally intermingled with Juncus roemarianus, alic rni , spp., im nium, spp., and a peripheral occurrence of Spartina cynosuroides. This high coastal marsh plateau reaches widths of 200 feet to the south, exhibiting a more uniform association of D. snicata, is rnia, spp., and im niun, spp., with patches of J. roemarianus throughout. The coastal wetlands terminate in a border of Snartina alterniflora, approximately 30-60 feet wide, which runs to the mud flat vertical escarpment along open water of the AIWW. This marsh vegetation pattern continues to the east of the island to Beaver Dam Creek. The width of the coastal wetlands border is narrowed in the area of a shallow cove extending toward the island from the main creek channel. The majority of the cove is dry at low water and numerous oyster clusters were evident throughout the mud bottom. North of the island, marsh width expands to even larger dimensions between the mainland and Beaver Dam Creek. The width of Beaver Dam Creek is approximately 192 feet in the project area, however the width of the waterbody in the area of the cove is extended to 350-390 feet. The waters of the AIWW and Beaver Dam Creek are classified SA by the N.C. Division of Environmental Management, and they are CLOSED to the harvest of shellfish. The AIWW is not considered to be a Primary Nursery Area, but Beaver Dam Creek is a designated PNA by the N.C. Division of Marine Fisheries. The National Flood Insurance Rate Map (Panel 360 of 395) lists the project area as an AE zone with a base flood elevation of 12 feet. The applicants propose to access the highground island from the St. James Plantation Development by constructing a wooden bridge. The bridge would be 310 feet long and 20 feet wide, elevated on pilings. Highground bridge abutments would be piling and girder cap with adjacent bulkhead wingwalls. The bridge would join an oval cul-de-sac with an open median to access seven (7) proposed single-family lots. The paved roadway width would be 18 feet. Wastewater disposal for the development would be provided by St. James Plantation wastewater treatment plant. A duplex grinder pump station is proposed within the open road median. Potable water would be provided to the development by the Brunswick County water system. Except for the wetland crossing Brassie Point Page 3 9. PROTECT DESCRIPTION where a utilities conduit would be attached to the bridge, all utilities would be installed underground. A stormwater retention basin (30 ft. X 30 ft.) is proposed adjacent to the cul-de-sac. The applicants have also proposed a community pier and docking structure. The pier would be located on a common easement between lots 4 and 5. The pier would be 425 feet long and 6 feet wide, terminating with a 25 feet by 15 feet deck. A ramp would connect to a floating dock structure, oriented roughly parallel to the channel of Beaver Dam Creek. The main dock would be approximately 120 feet long and 8 feet wide. Four (4) finger piers (12 feet long and 4 feet wide) would extend perpendicular from the main dock, 30 feet on center. A mooring piling would be placed between finger piers, creating a total of seven boat slips. 10. ANTICIPATED EMPACTS The proposed bridge would shade approximately 4400 square feet of irregularly flooded coastal wetlands, and 1800 square feet of federally regulated wetlands. Temporary disturbance of wetlands, adjacent to the bridge alignment, would be expected during the construction process. The proposed community dock would incorporate 3151 square feet of estaurine and public trust waters. An additional 1100 square feet of coastal wetlands would be shaded by the pier construction. There would be approximately 10,000 square feet of soil disturbance on the island's highground area by the installation of the road, cul-de-sac, and stormwater basin. Since highground area is limited on individual lots, the subsequent placement of elevated residential structures into the island's perimeter of federally regulated wetlands is anticipated.
