Director Division of Water Quality May 19, 2005 DWQ Project # 05-0045 Mecklenburg County Mr. Stephen Hoots Childress klein Properties 301 South College Street, Suite # 2800 Charlotte, NC.28202 Subject Property: Steele Creek Road River Gate Site APPROVAL OF STORMWATER MANAGEMENT PLAN Dear Mr. Hoots: On May 18, 2005, the Division of Water Quality (DWQ) received the revised storm water management plan prepared by your engineer, Mr. Scott Gregory of GeoScience Group Inc. This Plan has been reviewed and satisfies the storm water management conditions, of the Isolated Wetland Permit Certification issued on February 10, 2005. The structural storm water practices as approved by DWQ as well, as drainage patterns must be maintained in perpetuity. No changes to the structural storm water practices shall be made without written authorization from the Division of Water Quality. Storm water easements shall be recorded for a distance of at least 10 feet on each side of all storm water conveyances on all lots containing these structures including future access for maintenance. The storm water easements shall allow for the ability to maintain the structures, perform corrective actions as described above and shall provide protection of the structures from potential alternations by future property owners. Director Division of Water Quality February 10, 2005 DWQ# 05-0045 Mecklenburg County Mr. Stephen Hoots Childress Klein Properties 301 South College St. Suite 2800 Charlotte, NC 28202 Subject: Isolated Wetlands Permit with Additional Conditions Dear Mr. Hoots: You have our approval, in accordance with the attached conditions, to place permanent fill in 0.4 acre of isolated wetland in order to construct the River Gate retail center in Mecklenburg County, as described in your application received by the Division of Water Quality on January 19, 2004. After reviewing your application, we have determined that this fill is covered by the "State General Permit for Impacts to Isolated Wetlands and Isolated Waters" (IWGP100000). Please note that you should get any other federal, state or local permits before proceeding with your project, including those required by (but not limited to) Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing, and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter; and is thereby responsible for complying with all conditions. In addition to the requirements of the permit, you must also comply with the following conditions 1. Once construction has begun, the Mooresville Regional Office shall be notified in writing. 2. Stormwater discharge points shall be constructed in a manner such that the potential receiving streams (of the discharge) at the site will not be impacted due to sediment accumulations, scouring or erosion of the stream banks. 3 A final written stormwater management plan shall be approved in writing by this Office prior to the construction of any permanent facilities at the subject site. The stormwater facilities must be designed to treat the runoff from the entire project, unless otherwise explicitly approved by the Division of Water Quality. Also, before any permanent building is occupied at the subject site, the facilities (as approved by this Office) shall be constructed and operational, and the stormwater management plan (as approved by this Office) shall be implemented.
