A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 26. The ditch shall be filled in to natural grade for the first 200 feet from the sand ridge once -the trees are at least six feet tall. Adams, Jr. 427 Honeycutt Dr. Wilmington, NC 28403 January 18, 1993 This letter it to accompany the enclosed application for a section 404 permit to construct a temporary drainage ditch through a pocosin wetland near Kelly, Bladen County, North Carolina. The site is part of an 850-acre tract (the Smith Old Place), an on-going silvicultural operation which has been covered by a management plan since 1972. The plan has been revised numerous times, the most recent of which (January 1992) has been approved under the Forest Stewardship Program. The area in question is an irregularly shaped 12-acre pocosin on Lynn Haven soil. Vegetation was originally pond pine-evergreen shrubs, but repeated high-grading over the years, culminating in clear cutting of the residual stand in 1989, has removed the tree component. Our intention is to restore this element (substituting loblolly pine for pond pine), and to that end we entered into a cost-sharing agreement with the North Carolina Division of Forest Resources which included site preparation (chopping and bedding), to be followed by planting bare-root loblolly pine seedlings. Unfortunately, these plans were thwarted by high water levels caused by a combination of unusually heavy rainfall compounded by low evapotranspiration resulting from removal of the pine overstory. As a result, the Forest Service was forced to suspend operations after only about 2 acres had been bedded (the entire area has been chopped, however). We believe that a shallow (1-1'3 ft deep) central ditch, about 1500 ft long, penetrating the surrounding sand rim and emptying into an adjacent branch bottom (attached sketch), would provide temporary relief and permit re-establishment of the pine-shrub system. We would not connect the ditch to any established artificial drainage system, nor do we intend to maintain it in the future. We feel that once the pines have been established and the shrub understory develops, the system will not require any assistance. The enclosed application and plat describe the proposed work in more detail. We feel that our proposal: 1) avoids impacts to waters and wetlands through selection of the least damaging, practicable alternative. A single central shallow channel, unavoidably located within the wetland, is the least damaging means of removing surface water during re-establishment of wetland forest cover. The constructed channel will be of the minimum practicable dimensions and will not connect to a defined natural channel, but will discharge diffuse flow into an adjacent branch bottom system. 2) takes appropriate and practicable steps to minimize impacts to waters and wetlands. Flow from the constructed channel will be diffused through an undisturbed branch bottom wetland forest before entering any other defined channel, and any silt or other pollutants will be removed by the filtering action of branch bottom system. The single, 3-foot deep channel through the pocosin wetland will remove only excess surface water; limited lateral transmissivity of the Lynn Haven soil will prevent lowering of the water table more than a few feet from the channel. Following re- establishment of the wetland forest canopy, the artificial drainage channel will be abandoned. The wetland hydology would then be expected to return to pre-project conditions. The only permanent impact would be a narrow band of fill, resulting from channel excavation, parallel and close to the channel. Because of the organic nature of the excavated material, much of the fill will oxidize and disappear in time. 3) compensates for any remaining unavoidable impacts to the maximum extent practicable and appropriate. The site currently is greatly 3 degraded from its original conditio nc a po pine-shrub pocosin, it had been 16-grad for v many years and eventually clear-cut in 1989. As a result of overstory removal and subsequent chopping of the residual shrub stratum preparatory to reforesting, reduction of evapotranspiration caused an unaturally high water table which prevented completion of site preparation and replanting. If left in its present condition, the area will revert to a dense stand of short shrubby vegetation, with no chance of the original pine overstory becoming reconstituted. If the project is approved, loblolly pine seedlings will be planted at a density of about 500 trees per acre. With this open spacing, and with shrub propagules in place, the resulting system should evolve as nearly as possible into the pine shrub pocosin that once vegetated the area. Thus the increase in biotic diversity and wetland functional value resulting from the project should far outweigh the temporary hydrologic disturbance and small amount of fill resulting. But the answer is like this: they will have to get a stormwater construction permit (Erosion & Sediment Control approval from Land Quality, submit approval to us and they can begin construction, prior to permit receipt from us). `They are a category 11 facility in accordance with the stormwater regs, which means that they will be required to obtain a stormwater permit for the operation of the facility, ONLY if they have materials or manufacturing processes exposed. We have a general permit that covers this type of facility and permitting should be completed quickly. We told them all of this in the meeting. If you need additional information, let me know.
