Templeton North Carolina Department of Environmental Quality Division of Water Resources 512 North Salisbury Street 1617 Mail Service Center Raleigh,NC 27669-1617 RECEIVED/NODEQ/DWit JUL 10 2019 Re: 90-Day Notice-Incomplete Application Water Quality NPDES Permit NC0005274 Permitting Section Lowell Investments WWTP Gaston County Dear Mr. Templeton: Given the options provided in the 90-Day Notice on the subject permit dated 01/28/2019, Lowell Investments has chosen to pursue option 2, displayed below: 2. Withdraw the current permit appli.ation and request permit rescission,in writing,and remove the effluent discharge pipefor Outfall 001.In choosing this action,your options are to: a. prior to submitting your request,discharge waters from the tanks at Outfall 001 per the current permit and properly dispose of all sludge from the tanks,or b. cease discharge to surface waters and transport the waters and sludges off-site for proper disposal. In options a.or b.,you must also ensue that the tanks,once emptied,can no longer hold water. A 60-day extension request was granted on 04/11/2019, giving Lowell Investments until 5:00 PM on 07/02/2019 to comply with the 90-Day notice or the Division will return the permit, effectively terminating the permit. This letter is to request permit rescission from the Division of Water Resources. The remaining water contained within the facility's tanks has been discharged in accordance with the provisions of the permit as of 07/01/2019 at 4:15 PM.No additional water will be discharged under this permit and the effluent discharge pipe from Outfall 001 will be removed. The sludge is being disposed of under a separate contract directly with the NC DEQ Division of Waste Management division. This work is currently scheduled to begin the week of July 8, 2019. Once sludge removal is complete, Lowell Investments will ensure that the tanks can no longer 90-Day Notice Update page 2 of 2 NPDES Permit NC0005274 July 2, 2019 hold water. After sludge removal is completed and the discharge effluent piping is removed, Lowell Investments will submit a final update for the subject permit and 90-Day notice.
