Dear Sir/Madam:
Our office received a report from the City of Jacksonville on July 1, 2019 about a sewer spill that occurred
at the subject property on June 30, 2019 after they were contacted by residents about a manhole
overflowing into a storm drain. Their staff they took action to minimize the spill on your behalf after
finding your pump station off-line with no alarms in progress and both pumps tripped which they were
able to get one to operate and stopping the overflow about 2.5 hours after they were notified. They were
able to do so because the station was unsecure and they noted it was not posted with ownership/operator
information along with 24-Hour emergency contact number.
To summarize, Charleston Place, LLC or current ownership is in violation of the following requirements
that can be found in the subject permit issued on August 11, 2006:
1. Failure to properly post the pump station clearly and conspicuously posted using a weatherproof
sign with a pump station identifying name/number, 24-Hour Emergency telephone number, and
name of the owner/operator of the sewer system/pump station and instructions to call the
number in the event of alarm activation or other emergency per Condition 13 and 15A NCAC 02T
.0305(h)(2)
2. Failure to secure the pump station per 15A NCAC 02T .0305(h)(4)
3. Failure to operate the system at all times to prevent a discharge per Condition 3 and 15A NCAC
2T .0403
4. Failure to notify our Division of a spill per Condition 12 and 15A NCAC 2T .0403 (a)(7)

In speaking with Jacksonville staff and based on a Google search, it appears that a Southwood Realty is
either managing this location on your behalf or now owns it. It the property has been sold, then the
permit must be transferred as they are not automatically transferrable as indicated in Condition 4.
Also please provide our office with a summary of how many units and their sizes being served by this
system and information as to whom the pump station's telemetry system notifies in case of alarm.
A Notice of Violation/Intent to Issue Civil Penalty is being issued for the noted violations of North Carolina
General Statute (G.S.) 143-215.1 and the facility's WQCS Permit or its deemed status under15A NCAC 02T
.0403. Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars
($25,000.00) may be assessed against any person who violates or fails to act in accordance with the terms,
conditions, or requirements of any permit issued pursuant to G.S. 143-215.1.
If you wish to provide additional information regarding the noted violation, request technical assistance,
or discuss overall compliance please respond in writing within fifteen (15) business days after receipt of
this Notice. A review of your response will be considered and you will then be notified of any civil penalties
that may be assessed regarding the violations. If no response is received in this Office within the 10-day
period, a civil penalty assessment may be prepared.
