This correspondence is to request a minor modification of a previously issued permit verification for the
project referenced above and per our recent discussions with yourself and Mr. Andy Williams.
This modification is a result of the impending design and development of the 'Firmage Tract', which was
included in the revised project limits at the time of the permit renewal that was requested in 2016. As
this parcel was not included in the originally contemplated Briar Chapel project limits, a delineation of
Waters of the US had not been previously been done. Wetlands & Waters, Inc. delineated the subject
parcel and requested a Jurisdictional Determination in spring of 2018, for which a site visit was
conducted by your office on 05/10/18. The revised Approximate Depiction of Waters and Wetlands for
this parcel is included with this request.
At the time of the permit renewal in 2016 specific plans for the development of the Firmage Tract had
not yet been contemplated, thus impacts to regulated features were not known. Development of this
parcel will utilize the low density, conservation subdivision process in order to minimize disturbance and
impacts to greatest extent practicable while still meeting the economic pro forma of NNP Briar Chapel.
Proposed permanent impacts include a small, linear wetland feature (191 square feet), as well as
temporary impacts to an intermittent tributary (29 linear feet). The permanent wetland impacts are
necessary for construction of the primary roadway through the property, with the temporary stream
impacts necessary for riprap outlet protection of a culvert. Previous iterations of the concept plan did
not include the temporary stream impacts; however it was determined that in order to meet DOT
specifications regarding outlet protection the riprap dissipator was required. This riprap will be keyed
into the stream bed such that it is consistent with the current elevation in order to facilitate aquatic life
passage and preserve aquatic function. These new proposed impacts are labeled 'Impact AA' and
'Impact BB', respectively, on the attached Revised Briar Chapel Overall Site Plan. All other impacts to
jurisdictional features have been avoided.
In order to offset losses associated with the planned development of the Firmage Tract the applicant
proposes to eliminate 'Impact X', which was previously authorized as part of the 2016 Permit renewal
process. This impact totaled 240 square feet, meaning approval of this modification would result in
overall impacts to regulated wetlands being reduced by approximately 50 square feet. These features

are assessed to be of similar quality as both are small, headwater wetlands associated with similar
landscape positions. Further, in order to offset the temporary stream impacts the applicant will
eliminate permanent impacts to 29 linear feet of 'Impact V, which was also previously authorized under
the 2016 Permit renewal.

AS TDD'S) SHALL BE REVIEWED AND REMOVED IF THEY ARE IN CONFLICT WITH STAGE 2 WORK
SO LONG AS THE AREAS CAN BE IMMEDIATELY STABILIZED OR ADDITIONAL MEASURES INSTALLED
TO PREVENT SEDIMENT LADEN RUNOFF. REMOVAL OF BASINS SHOULD ONLY BE COMPLETED WITH
APPROVAL FROM CHATHAM COUNTY.
10. CONTRACTOR SHALL ENSURE THAT ALL SEDIMENT LADEN RUNOFF IS DIRECTED TO APPROVED
MEASURES AND AREAS OF NON-ACTIVE CUT AND FILL SHOULD BE STABILIZED AS THE SITE IS
REACHES FINAL GRADES.
11. ANY AREAS WITH FINAL GRADES OF 3:1 OR GREATER AND OVER 10' IN HEIGHT SHALL BE
TREATED WITH MATTING INSTALLED PER DETAIL ON SHEET D1.3.
12. PERFORM SEEDING AND MULCHING AS REQUIRED IN ACCORDANCE WITH THE TEMPORARY AND
PERMANENT SEEDING SCHEDULES LOCATED ON SHEET D1.2 AND NOTE #5 OF THIS SEQUENCE.
13. UPON REMOVAL OF ANY TEMPORARY DEVICE, CONTRACTOR SHALL IMMEDIATELY STABLIZE ANY

The North Carolina Natural Heritage Program (NCNHP) appreciates the opportunity to provide
information about natural heritage resources for the project referenced above.
Based on the project area mapped with your request, a query of the NCNHP database, indicates
that there are no records for rare species, important natural communities, natural areas, and/or
conservation/managed areas within the proposed project boundary. Please note that although there
may be no documentation of natural heritage elements within the project boundary, it does not
imply or confirm their absence, the area may not have been surveyed. The results of this query
should not be substituted for field surveys where suitable habitat exists. In the event that rare
species are found within the project area, please contact the NCNHP so that we may update our

records suggests that these natural heritage elements may potentially be present in the project area

If a Federally -listed species is found within the project area or is indicated within a one -mile radius of
the project area, the NCNHP recommends contacting the US Fish and Wildlife Service (USFWS) for
