Comments on Draft: From: Chris Bagley Sent: Thursday, March 14, 2019 11:46 AM To: emily.delducokncdenr.gov Cc: Jennifer Bunting <jennifer.buntingksscoop.com> Subject: Public Comment Draft NPDES Permit NCO082821 Dear Ms. DelDuco: Duncklee & Dunham submits this comment on behalf of our client Southern States Cooperative, Inc. regarding the draft NPDES permit NCO082821 for the Southern States Fertilizer Plant (facility). As noted in your cover letter to the draft permit, dated February 20, 2019, hardness sampling of the effluent and of the receiving waters (Fourth Creek) upstream of the facility's discharge is inserted as a new requirement in the draft permit. An additional new requirement is that the instream hardness sampling of Fourth Creek "...shall be representative of the hardness in the receiving stream." Obtaining a representative sample for hardness in the receiving waters upstream of the facility's discharge is not feasible. DocuSign Envelope ID: CE09F386-1C34-4CEB-B476-38E5F37F2553 The discharge of facility wastewater into Fourth Creek is approximately one mile away from the facility's physical location, and is on private property not owned by Southern States, nor does Southern States have a right-of-way allowing access to this area of Fourth Creek. The nearest potential upstream access is from a bridge on Bell Farm Road, which crosses Fourth Creek upstream and to the west of the Southern States outfall. Any sample obtained at this location will not be representative of the in -stream hardness upstream of the Southern States outfall because the Fourth Creek Wastewater Treatment Facility (NPDES Permit NC0031836) is permitted to discharge up to 6.0 MGD of effluent in between the Bell Farm Road bridge and the Southern States outfall. Thus, any sample taken at the bridge will not include the impact on in -stream hardness due to effluent discharge from the Fourth Creek Wastewater Treatment Facility. Duncklee & Dunham requests that the requirement to sample instream hardness upstream of the facility's discharge be removed from the permit because it is not feasible to obtain a representative sample for hardness analysis, as described above. In response to this comment, upstream hardness sampling (and corresponding footnotes) was removed from the final version of the permit. The region was contacted and agreed that there was not a suitable upstream location for sampling. The region also commented that this facility is consistently in violation of its Nitrogen cap for their groundwater wells. We've decided to just remove upstream hardness sampling from the permit. They have not been reporting Cu down to the appropriate PQL, so we can't remove that. As far as nutrient limits, I'm not seeing anything that would trigger that right now. The permit does contain the High Rock Lake reopener, in case of future changes to TMDLs. This permit currently requires that the permittee monitors and report for Cu. I have looked back at this permit to 2004 and there have not been any issues for Cu. The geologic regime where this operation is located is not an area where Cu would be an issue, would removing Cu as a hardness dependent material from the permit also remove the hardness requirement from the permit? Due to the limited access to the stream at this facility, in stream hardness would be difficult for the permittee to collect. Is it possible to calculate hardness from the sample collection point at the plant? Also, the permit draft still only has the monitor and report status for nutrients (Nitrates, Nitrogen & Phosphorus). Have surface water nutrient levels been established under 213? If not, are the establishment of nutrient levels forthcoming? Thanks. Guide to Reading and Understanding Your Laboratory Report The information below is designed to better explain the various terms used in your report of analytical results from the Laboratory. This is not F-1p intended as a comprehensive explanation, and if you have additional questions please contact your project representative. Abbreviations and Definitions FTC] MDL Method Detection Limit. RDL Reported Detection Limit. E Rec. Recovery. RPD Relative Percent Difference. SDG Sample Delivery Group. FC U Not detected at the Reporting Limit (or MDL where applicable). Analyte The name of the particular compound or analysis performed. Some Analyses and Methods will have multiple analytes reported. F If the sample matrix contains an interfering material, the sample preparation volume or weight values differ from the Dilution standard, or if concentrations of analytes in the sample are higher than the highest limit of concentration that the laboratory can accurately report, the sample may be diluted for analysis. If a value different than 1 is used in this field,the E result reported has already been corrected for this factor. These are the target % recovery ranges or % difference value that the laboratory has historically determined as normal Limits for the method and analyte being reported. Successful QC Sample analysis will target all analytes recovered or 0 duplicated within these ranges. Original Sample The non -spiked sample in the prep batch used to determine the Relative Percent Difference (RPD) from a quality control sample. The Original Sample may not be included within the reported SDG. Al This column provides a letter and/or number designation that corresponds to additional information concerning the result Qualifier reported. If a Qualifier is present, a definition per Qualifier is provided within the Glossary and Definitions page and potentially a discussion of possible implications of the Qualifier in the Case Narrative if applicable. FSC The actual analytical final result (corrected for any sample specific characteristics) reported for your sample. Ifthere was no measurable result returned for a specific analyte, the result in this column may state "ND" (Not Detected) or "BDL" Result (Below Detectable Levels). The information in the results column should always be accompanied by either an MDL (Method Detection Limit) or RDL (Reporting Detection Limit) that defines the lowest value that the laboratory could detect or report for this analyte. A brief discussion about the included sample results, including a discussion of any non -conformances to protocol Case Narrative (Cn) observed either at sample receipt by the laboratory from the field or during the analytical process. If present, there will be a section in the Case Narrative to discuss the meaning of any data qualifiers used in the report. Quality Control This section of the report includes the results of the laboratory quality control analyses required by procedure or Summary (Qc) analytical methods to assist in evaluating the validity of the results reported for your samples. These analyses are not being performed on your samples typically, but on laboratory generated material. This is the document created in the field when your samples were initially collected. This is used to verify the time and Sample Chain of date of collection, the person collecting the samples, and the analyses that the laboratory is requested to perform. This Custody (Sc) chain of custody also documents all persons (excluding commercial shippers) that have had control or possession of the samples from the time of collection until delivery to the laboratory for analysis. This section of your report will provide the results of all testing performed on your samples. These results are provided Sample Results (Sr) by sample ID and are separated by the analyses performed on each sample. The header line of each analysis section for each sample will provide the name and method number for the analysis reported. Sample Summary (Ss) This section of the Analytical Report defines the specific analyses performed for each sample ID, including the dates and times of preparation and/or analysis. Qualifier Description E The analyte concentration exceeds the upper limit of the calibration range of the instrument established by the initial calibration (ICAL). J The identification of the analyte is acceptable; the reported value is an estimate. J6 The sample matrix interfered with the ability to make any accurate determination; spike value is low.
