SUBJECT: Coastal Area Management Act (CAMA) Permit Application Submittal for
Wanchese Marina in Dare County
Dear Mr. Hatchell:
This letter is in response to the above referenced CAMA permit application, which was accepted
as complete by the Division's Elizabeth City office on May 20, 2019. Processing of the
application is ongoing. However, it has been determined that additional information will be
required prior to the Division taking final action on your application. These required items are
summarized below:
1) In accordance with 15A NCAC 07H.0208(a)(2)(B), it is the policy of this Division that,
prior to taking finalactionon a project of this nature, a Water Quality Certification for
the proposed development must first be approved by the Division of Water Resources
(DWR). Based upon the attached hold for additional information from the DWR dated
July 3, 2019, it appears as though additional information from the applicant will be
required before a final decision on issuance, of a Water Quality Certification can be made.
Therefore, it is necessary that processing of your permit application be placed in abeyance until
such time as the resource concerns are satisfied, the required information is provided to the
DWR, a Water Quality Certification is issued for the project, and a copy of the approval supplied
to this office.

Dear Mr. Hatchell:
0n June 6, 2019, the Division of water Resources (Division) received your application dated June 6, 2019,
requesting a 401 Water Quality Certification from the Division for the subject project. The Division has
determined that your application is incomplete and cannot be processed. The application is on -hold until
all of the following information is received:
1. NCG190000 for Marina Plan:
Based on a review of your application, the Division will require documentation that a NCG190000
application has been submitted to the Division of Energy, Mining, and Land Resources.

2. Wastewater Management System for Onsite Boat Wash and Maintenance Facility:
Please provide plans for the project that outline what permitted waste water disposal options will
be utilized for boat wash- wastewater management to complies with permitting requirements of
15A NCAC 02T .1003(a)(3). In addition, a more detailed Operation and Maintenance plans for the
proposed facility will need to specifically address how all overspray water generated during wash
down will be contained (via curtains to enclose the boats or within a building). Also, the plan will
need to provide specific details regarding the removal of excess residual of the wash down pad to
ensure storm water discharge does not become a waste water discharge. [15A NCAC

Based on a review of your application, fish processing will be taking place on the subject
property; therefore, this Office will require adequate documentation be submitted to the
Division to obtain either a NCG530000 or possible an individual permit (whatever is
applicable. [NCGS 143-215, 15A NCAC 02B.0400 and 15A NCAC 02H .0506(b)(3)]
Pursuant to 15A NCAC 02H .0506(b)(2) and (3), 1.5A NCAC 02T .1003(a)(3), NCGS 143-215, and 15A
NCAC .02B .0400. the applicant shall furnish all of the above requested information for the proper
consideration of the application. If all of the requested information is not received in writing within 30
calendar dates, of receipt of this letter, the Division will be unable to- approve the application and it will be
returned. The return of this project will necessitate reapplication to the Division for approval, including a
complete application package and the appropriate fee.
Please respond in writing within 30 calendar days of receipt of this letter by sending three copies of all of
the above requested information to the 401 & Buffer Permitting Unit, 1617 Mail Service Center, Raleigh,
NC 27699-1617.
Please be aware that you have no authorization under Section 401 of the Clean Water Act for this activity
and any work done within waters of the state may be a violation of North Carolina General Statutes and
Administrative Code.
