Pursuant to Section 7-5-19 of the City of Asheville Unified Development Ordinance (UDO), remaining or
outstanding work (landscaping, stormwater controls, sidewalk, curbing, paving, etc.) must be installed before a
Temporary Certificate of Occupancy (TCO) may be approved. If any of these items have not yet been installed at
the time a TCO is requested, a bond or letter of credit will be required. The surety must be calculated at (125%)
of the approved cost estimate for all remaining infrastructure that has yet to be installed. If the project requires the
installation of landscaping, all plantings shall meet the minimum planting standards and shall be maintained in

accordance with Section 7-11-3 (f) of the Unified Development Ordinance (UDO). Additionally, all required
landscaping shall meet the minimum size requirements set forth in Section 7-11-2 (i)(2) of the UDO.
Zoning permit approved on April 30, 2019, with the following conditions:
1. The project is subject to the requirements of the NC Building Codes - additional permits issued by the Building
Safety Department are required.
2. Grading/Stormwater/Erosion Control Reviews: Comments are not covered under this zoning review but under
a separate permit.
3. Project specific conditions are recorded in ordinances no. 4722 and 4729.
4. Signage shall be separately permitted and shall meet the standards of Article XIII of the UDO.
5. All required landscaping shall meet the minimum planting standards and be maintained in accordance with
Section 7-11-3(f) of the UDO.
6. At least 10% of the units (12) shall meet the City's standards for affordability at 80% AMI for a period of 10
years from the issuance of the Certificate of Occupancy. The rent and income shall follow the Affordable and
Workforce Housing Standards determined annually by the City of Asheville Community Development
Department. An Affordable Housing Deed Restriction will be provided by the City and shall be filed and recorded
by the applicant/property owner in the Buncombe County Register of Deeds prior to the project receiving the final
zoning permit.
7. The project consists of a maximum of 113 units in ten buildings and a maximum of 222 parking spaces with
bike parking as shown on plans. Twenty additional bike parking spaces will be distributed throughout the site,
both long and short term storage.
8. The sidewalk along Hazel Mill Road will be eight feet in width and setback up to 35 feet from the edge of the
road as shown on the site plan attached. An easement will be granted by the developer/property owner for public
use of the sidewalk but the sidewalk will be privately maintained. An easement is required for the Clayton Road
sidewalk as well, per the TRC conditions. These shall be recorded prior to final zoning approval of the project.
9. The developer will pay the City $14,000 to be used for the construction of sidewalks along Hazel Mill Road.
This money must be provided to the City prior to final zoning approval.
10. Street name and stop signs shall be installed pursuant to the TRC condition prior to final zoning approval.
11. Construction staging shall be confined to the site as noted in the TRC conditions.
12. The developer or property owner shall provide notice to the project's tenants that the private road off Hawkins
Lane, which crosses the Harry's Cadillac Property (PIN 9638-38-4570-00000; Buncombe County Register of
Deeds Book 780, Page 287) is a private road which is not available to access Patton Avenue. This notice should
be printed by using a font and color sufficient to be noticed by the tenants and posted at a conspicuous location
within the community. This notice shall also be provided to all new tenants in their written leases. A sample copy
of the lease and posted notice shall be provided to the City prior to the issuance of the Certificate of Occupancy.
13. The subject properties must be combined prior to final zoning approval.
14. The project shall comply with all conditions outlined in the TRC staff report.
15. All exterior lights shall meet the outdoor lighting standards in Section 7-10-11 of the UDO.
16. The building design site design and orientation on site shall substantially comply with the approved site plan,
which is incorporated herein by reference. Any major deviations from these plans may require a rezoning by the
City Council. The building materials indicated on the plans is illustrative in nature. Not more than 20% of external
building materials will consist of vinyl, utility grade concrete masonry unit or synthetic stucco.
17. Final planning inspection is required prior to the completion of the project — scheduled through DSC
inspection line.
18. Zoning permit expires within 3 years if a building permit has not been obtained within that time

For NPDES (1 acre or greater disturbed area) projects:
1. Retain Certificate of Compliance, from NCDEQ on site.
2. Maintain compliance with NCG01 Stormwater Pollution Prevention Permit.
3. Maintain and coordinate self -inspection, recordkeeping, and reporting per NCG01. Including a minimum of
weekly Inspection log shall be retained on site.
4. NPDES Permit and approved plans shall be on -site.
General Comments:
1. City of Asheville, under the authority G.S 113A-60, certificate of approval provides this notice of the right to
inspect, to ensure compliance with NC G.S.113A Article 4.
2. Site must stay in compliance with all federal, state and local regulations. Failure to maintain compliance for any
of the agency's stated above may result in issuance of a Notice of Violation against the project or revocation of
the Grading Permit.
3. If any of the minimum best management practices fail to adequately keep sedimentation or stormwater on the
site, it shall be the responsibility of the professional designer of record to supply the Contractor/Owner with a
correction, as well as submit correction to the Development Services Department for approval.
4. For sites with greater than 25,000 square feet of disturbance, a contract is required between the person
financially responsible and a licensed professional for the initial inspection ensuring erosion and sediment control
measures have been installed consistent with the approved plan. A notarized certificate of inspection agreement
on a form has been received and approved by the Stormwater administrator and a copy is included as part of this
grading and stormwater permit is issued.
a. The initial and signed inspection report must be filed with the stormwater administrator prior to the
commencement of any land disturbing activity.
b. A licensed professional shall conduct weekly inspections for all sites where Hillside, Steep Slope and/or
Mountain Top Protection regulations apply and bi-weekly for all other sites.
c. All weekly inspections and bi-weekly inspections must be kept on inspection logs and retained at the site.
5. For constructed slopes with a grade of 50% (2:1) and greater than five feet in height, inspection and submittal
of a Slope Stability Certificate are required by a North Carolina registered professional engineer with geotechnical
expertise sufficient to perform the inspection and stability analysis.
6. Please note that Temporary Ground Cover must be established, prior to release of grading approval for
issuance of a Temporary Certificate of Occupancy. Permanent Ground Cover must be established, prior to
grading approval for the issuance of a Certificate of Occupancy.
7. Contractor must provide proof of active grading permits for any offsite borrow or waste areas.

8. Grading Permit expires in one (1) year from date of permit issuance. A one-time, one-year extension can be
granted, for a fee. Please submit the extension application form to the Permit Application Center, 161 S.
Charlotte Street, Asheville NC 28801, within 60 days prior to permit expiration.
Stormwater documents are required when the project is complete and before a permanent Certificate of
occupancy can be issued. An Operation and Maintenance Agreement and Maintenance and Access Easements
shall be recorded at the Register of Deeds office along with the As -built drawings and O&M Exhibit. See the City
of Asheville Standard specifications manual for the forms and drawings required. See Section 9E for specifics for
the as -built drawing of the system. These include:
