Wetland and Stream Standard Violations
Wayne County
On July 2, 2019, Anthony Scarbraugh of the Division of Water Resources (DWR) inspected the restoration
activities on a stormwater outfall and associated receiving unnamed tributary of Jimmy Prong located
between Lots 69 and 70 of the Planters Ridge Subdivision near Pikeville, Wayne County. Messrs. Bryan
Jones with Bryan K. Jones, Consulting Engineers, PA and Wyatt Brown with Brown's Environmental Group,
LLC were present during the inspection. The inspection was conducted to verify the restoration activities
was conducted in compliance with the conditions of the Restoration Plan approved via regulatory
correspondence issued by this Office on June 4, 2019.
During the inspection, DWR observed instream sediment had been removed and disposed of on high
ground. In addition, this Office observed that rip -rap had been installed at the outlet of the stormwater
outfall and areas disturbed during restoration activities had been stabilized with groundcover and seeding.
Please note, this Office has previously approved the restoration of sediment with jurisdictional wetlands
via natural assimilation. Therefore, the requested corrective actions to abate the violations have been
completed and the NOVRE is considered closed.
Thank you for your attention to this matter. Please remember these violations and any future violations
are subject to a civil penalty assessment of up to $25,000.00 per day for each violation. Should you have
