Thanks for the clarification, Kim.
The final Mitigation Plan for Arabia Bay was finalized this week, and included the final signed PJD by Beecher. Per the
requirements in the eApproval letter from the IRT, the final document was posted to our project page, along with the
summarized errata sheet with response to comments.
It is available here: https://deq.nc.gov/about/divisions/mitigation-services/dms-projects
DMS/RS will not submit a PCN Application, but ensure construction activities will occur 30 days after this email notice,
and that any other required permits are in place as necessary.

Correct, if you are not placing fill in a jurisdictional feature, you do not need a permit. I only have the JD request from
Axiom in my copy of the Draft Mitigation Plan --do you have the JD paperwork from the USACE PM, I think it's Gary
Beecher? I assume that will arrive with the final mitigation plan.

DMS has several wetland only projects involving filling ditches, such as Arabia Bay. However, those ditches are non -
jurisdictional. Do we need to obtain 401/404 for those wetland only projects? Thank you very much for your time and
