Dear Mr. McKittrick:
The Division of Water Resources has received your June 18,2019 request for a second extension
of the Division's January 28th 90-day notice,to allow until September 2nd to complete all actions
required under the notice. Considering Lowell Investment I's track record with this site,the first
extension was itself an exceptional allowance.Therefore,the Division refuses to consider your
request for a second extension. Lowell Investment I must satisfy the terms of the 90-day notice
no later than 5:00 p.m.,July 2,2019,in order to retain its NPDES permit and the associated
nutrient allocations.
We also received your May 29,2019,request to modify the monitoring requirements set forth in
the permit,last issued effective January 1,2013. The Division approves your request to monitor
and discharge from each tank individually rather than from the aggregated waters as specified
in the permit.The discharge remains subject to all other provisions of the permit,and the
discharge from each tank is subject to the effluent limitations and the monitoring and reporting
requirements for Outfall 001. The Permittee is required to notify the Division's Mooresville
Regional Office,Surface Water Protection Section,at least 48 hours prior to discharge to allow
for their inspection or observation of the wastewater discharge. Suggested contacts are Ori
