WETLANDS GROUP WATER UAUTY SECTION Dear Mr. Pridgen: The North Carolina Division of Coastal Management has reviewed the above referenced application for a Nationwide Permit dated November 17, 1993 pursuant to Section 307 of the Coastal Zone Management Act of 1972 as amended. Based upon our review, we have determined that the proposed activity is consistent with the North Carolina Coastal Management Program provided the following conditions are met: 1. The activity described in the above referenced application qualifies to receive one of the Nationwide Permits described in 33 CFR Part 330 with the exception of Numbers 17, 21, 24, and 34 which were found inconsis- tent with the North Carolina Coastal Management Program. 2. A 401 Water Quality Certification is received, where required, from the North Carolina Division of Environmental Management. This letter does not relieve you of the responsibility to insure that all other State authorization and/or permit requirements are met prior to implementation of the project. Ii f; COP, March 4, 1993 Mr. Doug Douglas 405 Oakmears Crescent Suite 2 Virginia Beach, VA 23462 Dear Mr. Douglas: ~t RE: Water Quality Monitoring Marantha Island Project Camden County Recently Ms. Deborah Sawyer of our Washington Regional Office asked me to propose a water quality monitoring plan for your plan to connect several existing canals to the Turner's Cut Canal near South Mills, N.C. As you are probably aware our main concern is that water quality standards not be violated in the Canal. Turner's Cut Canal is classified as WS-III Sw since it is a water supply for Elizabeth City, N.C. The following parameters should be measured at several locations in the small existing canals as well as in Turner's Cut Canal: Physical: Depth of system - present and future Wind direction pattern Sediment description - texture and particle size, settleability Lunar or wind tidal amplitude Retention (turnover) time Chemical: Dissolved oxygen Total dissolved gases Temperature pH Turbidity Sediment oxygen demand ..-; ."A ."" Mr. Doug Douglas March 4, 1993 Page 2 Biological: Chlorophyll ~ and biovolume Bacteria - fecal and total coliform Aquatic fauna survey Aquatic macrophytes - species and densities Samples should be taken at several locations in the canal system; at the surface, mid-depth and bottom; and conducted throughout the summer at least weekly with a more intensive daily study for diurnal trends. A model will also need to be run to determine whether water quality standards will be violated in Turner's Cut Canal and the internal canal system by the connection of the canal system to Turner's Cut Canal. This model will have to be a nontidal model since lunar tides are inconsequential in this area. As you can tell, the necessary data collection requirements would be quite extensive for you to demonstrate that no violation of water quality standards would result from connecting the smaller canals to Turner's Cut Canal. If you are still interested in pursuing this project, please prepare a detailed water quality sampling plan and submit it in triplicate to me. After it is reviewed by the Central and Regional Office staff to determine its adequacy, I will notify you of any changes needed prior to your initiation of the study. (DEC) is assisting with environmental matters associated with Marantha Island Development. The Marantha Island development is proposing to connect approximately 6000 feet of their existing canal system (excavated more than 10 years ago) to the Turners Cut Canal. By removing an earthen "plug" at the mouth of the canal system navigational access will be established between the Marantha Island canals and Turners Cut. The "plug" is approximately 15 to 20 feet wide. A culvert, which runs through the plug, allows water to run both in and out of the canal system. Actual flow depends ~n wind driven tides, runoff from storms and other events which affect water levels. Therefore, the canal system is already hydrologically connected to Turners Cut. In addition, the owner reports sheet flow of runoff waters from the canal system, through the adjacent swamps and into Turners Cut. The water quality monitoring plan proposed in your letter of 04 Match 1993 will cost many tens-of-thousands of dollars. We hope to design and perform the study in a manner that will keep the costs down. To this end, we request information on threshold levels for the various parameters which you have asked us to study. Specifically, please provide the levels which are acceptable and the levels which are unacceptable for the following canal system parameters: 1) total phosphorus, 2) biological oxygen demand, 3) retention (turnover) time, 4) dissolved oxygen, 5) chlorophyll, 6) and bacteria-fecal and total coliform. 405 Oak Mears Crescent. These parameters are relatively inexpensive to measure as compared to the detailed study outlined in your letter. By comparing the values from the above evaluations with the water quality parameter threshold levels which we have requested, we will be able to reach important decisions about the project regarding state water quality standards and not incur the great expense of the detailed study. You indicated that Turners Cut Canal is classified as a WS-III SW waterway since it is a water supply for Elizabeth City, NC. If available, please provide the water quality standards associated with this designation, existing water quality conditions in Turners Cut and any standards for discharge into Turners Cut. This information will also assist us in designing and performing the necessary studies. The Specific Use Standards found at Section .0208 of your State Guidelines for Areas of Environmental Concern states that canals must be designed to "provide adequate water circulation" and that "Canals shall be either straight or meandering with no right-angle corners." The configuration of the canals at the Marantha Island project appear to be in conflict with these standards, If conflict with these standards is of great enough concern to warrant denial of this proposal then please advise us of that fact so that we will not waste money on water quality studies. Also, we believe that it is important to remember that the canal system has been open to Turners Cut by way of the existing culvert for more than 10 years. Therefore, our request is not to open the canal system to Turners Cut but to increase the opening to accommodate boat traffic as well as water circulation which presently exists. We request that you consider this in your evaluation of the proposal. By providing us with the information which we have requested above we will be able to perform the required water quality stu'mS in a economical manner and possibly avoid unnecessary work.
