Stanley currently uses approximately 0.4 MGD and is projected to increase its usage to ' approximately 2.1 MGD in the future. The purpose of this project is to expand the capacity of the structure to 13.5 million gallons per day (MGD) from its currently permitted capacity of 3.0 MGD. Deed Fla Ko-- L Ml - 1122) ' 0 ' 9 ' STATE OF NORTH CAROLINA ) COUNTY OF GASTON E A S E M E N T ' THIS AGREEMENT Made r? and entered into as of the day 'of ' /o/.P -13c e , 1981, by and between DUKE POWER COMPANY, a corporation organized under the laws of the State of North Carolina, Grantor, and TOWN OF MOUNT HOLLY, a municipal corporation, Grantee; W I T N E S S E T H ' WHEREAS, Grantor owns a dam on the Catawba River in Gaston, and Mecklenburg Counties, North Carolina, which forms Mountain Island ' Lake and is used in connection with the Grantor's hydroelectric generating station known as the Mountain Island Hydroelectric Station, ' a part of the Catawba-Wateree Project licensed by the Federal Power Commission as FPC Project No. 2232 for a period of 50 years effective ' as of September 1, 1958; and, WHEREAS, Grantee requires a source of raw water and desires to build a water supply pumping station together with intake pipes, ' pipelines and other facilities appurtenant thereto at a site located in and on Mountain Island Lake for this purpose; and, ' WHEREAS, the Grantor desires to cooperate with Grantee to make a public water supply available from this reservoir so long as ' such action is compatible with the primary purpose of said Catawba- Wateree Project and the license issued therefor by the Federal Power Commission. Said easement herein shall be used for the construction, operation and maintenance of a water supply pumping station together with intake pipes, pipelines and associated facilities (hereafter collec- tively referred to as the "Facilities"), upon the following terms and conditions: 1: It is understood and agreed that the Catawba-Wateree Project is and will be operated as a part of the Grantor's electric system, and that the water in the reservoir will be raised or lowered. from time to time and at any time and in any manner deemed necessary, desirable or advisable by the Grantor without notice to Grantee and in the same manner and to the same extent as if this agreement had not been entered into; provided, however, that said Catawba-Wateree Project will be operated so as not to materially interfere with the operation of Grantee's pumping station, except that if in case of emergency or repair ' it `ecemes necessary to lower the water level to such a level that it will interfere with operation of the Facilities, Grantee will be given ' reasonable notice,and the work incident to such emergency or repair will be completed by the Grantor in a reasonable time. ' 2. Grantee shall be responsible for any and all construction, operation, maintenance, use and removal of the Facilities, and does hereby release and agree to indemnify and save harmless the Grantor, its ' successors and assigns, from and against any and all claims, demands, suits and damages to persons or property resulting from flooding, water ' withdrawals, riparian claims or in anywise connected with the construction, operation, maintenance, use and removal of the Facilities. ' 3. The Grantor shall be under no obligation to Grantee to maintain or continue to operate the Catawba-Wateree Project (FPC Project ' No. 2232) and should said project be damaged or destroyed, the Grantor shall be under no obligation to restore or rebuild same. 4. The right to use the land which is the subject of this ' agreement for project purposes is hereby reserved to the Federal Energy Regulatory Commission (FERC) project licensee, its successors and assigns. 1 -2- Deed File No. 21C C i 4 5. Grantee agrees that in its use of the easement area as herein provided, Grantee will comply with Order No. 313 of the FERC and all other applicable state, federal and local laws as well as all ordinances, rules, regulations and sanctions of any regulatory body or governmental agency (state, federal or local) having jurisdiction in the premises, and Grantee's use of the aforesaid lands will not endanger health, create a nuisance or otherwise be incompatible with the overall recreational use of the Mountain Island Lake, IFERC Project No. 2232. 6. All necessary precautions shall be taken during con struction and subsequent operation and maintenance of the activity to protect and enhance the environmental values of any affected lands and waters of Project No. 2232. 7. If any archaeological resources are discovered during construction, construction shall be halted and the State Historic Preservation Officer shall be contacted to determine what measures, if any, are needed to protect or salvage the resources. 8. This agreement shall be binding upon and inure to the benefit of the parties hereto and their successors in interest provided, however, that neither this agreement nor any interest therein may be assigned by Grantee except with the prior written consent of the Grantor. 9. The term of this agreement shall run from the date hereof until September 1, 2008, and thereafter for such period of time as the Grantor remains as Licensee of the Catawba-Wateree Project, FPC Project No. 2232, pursuant to authority vested in the Federal Power Commission or any other regulatory bodies or governmental agencies having juris- diction in the premises, or continues to utilize said Catawba-Wateree Project. 10. Grantee agrees not to cut any trees in the right- of-way that are not reasonably necessary for the construction or maintenance of the project, and further agrees that any wood from any trees cut by Grantee ' shall be the property of Grantor. The easement and right-of-way herein granted is for the construction of a water line at the approximate locatiod in upon and over the above- described realty of Grantor as shown on that map or plat prepared by O'Brien & Gere, P.E., dated February, 1981, and entitled "City of Mount Holly Water ' Facilities", a copy of which is marked Exhibit "A" and attached hereto and incorporated herein by reference, said easement and right-of-way extending from State Road 1933 to the Raw Water Pumping Station property shall be thirty ' (30) feet in width for and during construction and thereafter shall be twenty- five (25) feet in width. In addition, we have read and agree to comply with Duke Power's Shoreline Management Guidelines (SMG) and understand that written authorization must be obtained from Duke's Lake Management office prior to beginning any activity/construction within the project boundary. The construction will be completed as described in the approved application and with (18) months from the date of approval by Lake Management. Failure to complete construction within the build-out or extension period will require the applicant to file a new application within the then- current guidelines. The filing will include any applicable fees and security deposits. We attest to be the owner or leaseholder of the tract of land immediately adjoining the project boundary. We agree to be fully responsible for the permitted reservoir use including maintaining structures in good repair. If the facility is deemed unsafe by a Lake Management Representative, we agree to repair or remove the facility at our own expense and within the specified timeframe. This responsibility is considered to transfer automatically along with ownership and leases of the adjoining tract. We understand that we must execute this user's agreement letter and enter into a conveyance agreement for the area within the project boundary. The proposed Instrument of Conveyance (Permit) for the project land will be provided by Duke Power. We understand that the proposed facilities will be used only for the purpose described in ' the information submitted for approval by Lake Management and other appropriate governing bodies as applicable. ' We understand that the information provided in the application and reviewed by the agencies includes all activities within the reservoir boundary that support this project and ' subsequent additional activities will not be submitted for incorporation on the original proposal without filing a new application, and incurring additional filing fees and deposits. ' If during construction an extension period is needed, we must file a written request with Lake Management explaining why the additional time is needed. If the extension is ' granted, the new construction may be required to comply with any additional guidelines which are imposed due to regulatory and/or business requirements. t We understand that this lake is open for use by the general public and that maintaining safe and lawful public use is one of the primary lake management objectives of Duke ' Power. We understand that the use for which we are applying must not interfere with the general ' public's safe and lawful use of the lake. ' We understand that interbasin transfers do impact the project and that such transfers should be kept to the lowest practical levels. ' We agree that excavation will not occur during the months of March, April, May and June because of potential impact to fish spawning areas. The ecological impact ' the vegetation has on the fish and wildlife habitat is necessary to ensure a sound and healthy lake environment. The plant's ' permitted monthly average discharge is 4.0 MGD. For the year from July 2001 through June 2002, the average daily flow was 1.81 MGD. The Town of Stanley operates one wastewater treatment plant that discharges into Mauney ' Creek. The plants permitted monthly average discharge is 0.5 MGD. (2) A description of the applicant's ongoing programs to support the efficient use of the water withdrawn and any information quantifying the effectiveness of those programs. (3) A summary describing the applicant's construction plan and schedule throughout the forecasted period to modify equipment to achieve the capacity as noted in Item (1) b), and including identification of the ultimate capacity. (4) A description of the applicant's drought management program, including ' voluntary and mandatory water conservation measures and any information quantifying the effectiveness of the program. (S) A summary (including at least a brief description and cost comparison of the assessment of available alternatives that the applicant considered to meet the raw water demands forecasted in Item (1) a) above, before deciding upon the chosen ' alternative. (6) A flowchart and supporting documentation showing how the raw water will be used once it is withdrawn from the Duke Power lake, including percentages of the intake volume that will be: a) Lost due to consumptive uses b) Lost from the subject river system due to inter-basin transfers at specified wastewater discharge stations. c) Returned to the subject river system via specified wastewater discharge stations. (7) (For the portions of the withdrawn water that will ultimately return to a Duke Power lake only) A summary of the wastewater stream chemical limits as specified in the NPDES permit for the subject wastewater treatment station(s) and a quantification of any discharge stream chemical improvements achieved by treatment processes that exceed the minimal wastewater treatment standards. In order to meet future raw water demands, the City wishes to expand the capacity of its raw water intake structure to 13.5 MGD from its currently permitted flow of 3.0 MGD. 2.0 Projected Demand ' Presented in Figure 1 is a graph showing the average and peak annual raw water projections for the next forty years. The current average demand is approximately 2.92 MGD, and the current peak demand is approximately 4.38 MGD. The demand projections assume an annual growth ' rate of 2.9%. Also shown on Figure 1 is the current raw water intake facility capacity along with the requested capacity. Month _2002-Peak 2002-Avg. 3.0 Usage Efficiency One of the most effective ways to ensure that raw water withdrawn is being used efficiently is the implementation of a leak detection and repair program. The largest component of an effective leak detection and repair program is a water audit. This involves a routine compilation of the amount of water sold, used for flushing, fire fighting, etc. for a certain period of time. This value can then be compared to the amount of water produced by the water plant and a percent loss calculated. Due to meter inaccuracies, inaccurate flow estimates, unmetered connections, billing cycles, and other reasons, a 100% accurate figure cannot realistically be achieved. Generally, if the percent loss of water in a distribution system is less than 10%, the program is considered successful. The American Water Works Association's Leak Detection and Water Accountability Committee suggested this value as a goal for water utilities. If the percent of water loss exceeds 15%, then additional measures such as performing a water system survey with listening devices may be necessary. The City plans to calculate and review the water accountability on a quarterly basis. 2 In addition to performing water accountability calculations, the City's repair and meter reading crews monitor areas around water mains for "wet spots". Shutoff and reconnection fee. 5 6.0 Alternative Raw Water Supplies C The City considered three alternative raw water supply sources: modifying the existing intake facility on Mountain Island Lake to increase its capacity, installing multiple groundwater wells, and constructing a new intake facility on the Catawba River. Below is a brief discussion of each alternative along with its total estimated construction cost. Existing Facility Modifications Modifying the existing facility on Mountain Island Lake was selected from the three available alternatives for two basic reasons: 1) it provides the most reliable raw water source and 2) it is the most cost-effective to construct. The City already has the required structure in place that is capable of withdrawing the needed water from the lake. The modifications will be fairly simple with the only structural modification being the addition of new intake screens to keep intake velocities at acceptable levels. The total estimated construction cost for the required intake facility modifications is $150,000 (one hundred and fifty thousand dollars). Groundwater Well Installation The second raw water supply alternative considered by the City was the installation of groundwater wells. Assuming that the average well yield is approximately 50 gallons per minute (gpm) and constrained by the fact that wells are only allowed to be pumped for 1000 minutes per day, it would take 270 wells to meet the required yield of 13.5 MGD. This option is impractical for a number of reasons: • Wells are very unreliable as a public water supply because they are subject to severe ' shortages during droughts. • Wells are more susceptible to unknown contamination. ' • The City does not own sufficient property to install 270 wells. • The maintenance of the piping on 270 separate wells would be overwhelming. • The construction cost is unreasonable. ' The estimated construction cost for 270 wells excluding property acquisition and maintenance is $5,400,000 (five million four hundred thousand dollars). ' Catawba River Intake Facility ' The final supply alternative investigated by the City was constructing a raw water intake facility on the Catawba River below the Mountain Island Lake Dam. This alternative also proved to be less desirable than the intake facility modifications. Some of the reasons the possibility of a new ' intake structure was rejected were: • The water supply would be less reliable than the lake because the river is subject to ' greater fluctuations in elevation, particularly during a drought. 1 6 • The water would still be removed from the same river basin as the existing station. • Constructing an entire new station was cost prohibitive. The estimated construction cost of a new raw water intake facility is $3,000,000 (three million dollars). 7.0 Raw Water Usage Refer to Figure 3 for a flow chart of raw water usage after it is withdrawn from Mountain Island Lake. As the Figure 3 indicates, the City sells treated water to the Town of Stanley to meet a portion of their potable water needs. The City also treats a portion of the wastewater generated by the Town of Stanley. 8.0 Wastewater Stream Limits The City operates one wastewater treatment plant with a single discharge point in the Catawba River below the Mountain Island Lake Dam. Table 1 below details the wastewater treatment ' plant's effluent limitations (NPDES Permit No. N00021156). Table 1 - City of Mt. Presented in Table 2 are the results of the chemical analysis for August 2002. A review of this data shows that the monthly average for each of these chemical constituents is less than 50% of the permitted limit.
