Gilmore, P.E., Manager Planning and Environmental Branch North Carolina Department of Transportation Post Office Box 25201 Raleigh, North Carolina 27611-5201 Dear Mr. Gilmore: 50" -.1.- On February 24, 1997, and again on January 29, 1998, Mr. Bill Biddlecome and I met representatives of your staff and with representatives of the North Carolina Department of Transportation (NCDOT) Division IV staff regarding our regulatory responsibilities and how they would affect your plans to relocate approximately 800' of Billy Branch Creek from private property to NCDOT right-of-way along U.S. 13/70 Bypass in Goldsboro. This relocation will subsequently drain wetlands adjacent to Stoney Creek, in Goldsboro, Wayne County, North Carolina. As discussed with NCDOT representatives at the site, the subject work and the secondary impacts resulting from the work will require an individual Department of the Army (DA) permit before the work can proceed. On February 6, 1990, the DA and the U.S. Environmental Protection Agency (EPA) signed a memorandum of agreement (MOA) establishing procedures to determine the type and level of mitigation necessary to comply with the Clean Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding impacts to waters and wetlands through the selection of the least damaging, practicable alternative; second, taking appropriate and practicable steps to minimize impacts on waters and wetlands; and finally, compensating for any remaining unavoidable impacts to the extent appropriate and practicable. To enable us to process your application in full compliance with this MOA, we request that you provide the following information with your application to relocate Billy Branch Stream and drain wetlands on the Lewis property. a. Permits for work within wetlands or other special aquatic sites are available only if the proposed work is the least environmentally damaging, practicable alternative. Please ? ?. -2- furnish information regarding any other alternatives, including upland alternatives, to the work for which you are applying and provide justification that your selected plan is the least damaging to waters or wetlands. b. It is necessary for you to have taken all appropriate and practicable steps to minimize wetland losses. Please indicate all that you have done, especially regarding development and modification of plans and proposed construction techniques, to minimize adverse impacts. c. The MOA requires that appropriate and practicable mitigation will be required for all unavoidable adverse impacts remaining after all appropriate and practicable minimization has been employed. Please indicate your plan to mitigate for the projected, unavoidable loss of waters or wetlands or provide information as to the absence of any such appropriate and practicable measures. This information is essential to our processing of your application. This information must also be sent to the North Carolina Division of Water Quality to enable them to adequately evaluate your application for a Water Quality Certification pursuant to Section 401 of the Clean Water Act. As we understand the proposal, the channel would be relocated into the roadside ditch in order to divert flow from an existing wetland area in the floodplain of Billy Br nch/Stoney Creek. Based on our understanding of this proposal and site visits made by DWQ Regional and Central Office staff, DWQ could not approve this channel relocation. This proposal would be denied by DWQ based on the 1) the Neuse River buffer rules (15A NCAC 2B .0233) which require protection of buffers with existing forest vegetation along all streams in the Neuse River basin, 2) our Antidegradation water quality standard (15A NCAC 2B .0201) which requires protection of existing uses of the wetlands adjacent to Billy Branch and Stoney Creek and 3) alternatives for development on nearby upland rather than on the wetland site in accordance with our rules for the 401 Water Quality Certification Program (15A NCAC 2H.0506). Finally extensive and costly wetland mitigation would be required for any activity which would affect these wetlands as a result of the channel diversion. As we understand the proposal, the channel would be relocated into the roadside ditch in order to divert flow from an existing wetland area in the floodplain of Billy Branch/Stoney Creek. Based on our understanding of this proposal and site visits made by DWQ Regional and Central Office staff, DWQ could not approve this channel relocation. This proposal would be denied by DWQ based on the 1) the Neuse River buffer rules (15A NCAC 2B .0233) which require protection of buffers with existing forest vegetation along all streams in the Neuse River basin, 2) our Antidegradation water quality standard (15A NCAC 2B .0201) which requires protection of existing uses of the wetlands adjacent to Billy Branch and Stoney Creek and 3) alternatives for development on nearby upland rather than on the wetland site in accordance with our rules for the 401 Water Quality Certification Program (15A NCAC 2H.0506). Finally extensive and costly wetland mitigation would be required for any activity which would affect these wetlands as a result of the channel diversion. Gordon had asked the DWQ to review a proposed project. The proposed project is to relocate the drainage from an existing "blue-line" stream to a drainage ditch proposed to be excavated adjacent to Hwy. 70 by the NCDOT. The stream has been modified since the 1983 photo revised USGS. Maps are attached to show the original stream as well as the previous relocation. Concerns of this office are as follows: • The natural stream channel is protected by a natural wooded buffer. If the channel is relocated there will not be a wooded buffer to protect the stream prior to discharge to Stoney Creek. The Neuse River Buffer Requirements do not allow relocation of a buffered stream. • The applicant proposes to connect the ditch to Stoney Creek. If trees are proposed to be removed to construct the ditch, the Neuse River Buffer Requirements will not allow this removal. A variance may be required to remove any trees. • Mike Bell and Bill Biddlecome of the USACOE met us on site. Mike stated that the impacts to wetlands which would result from the relocation would be greater than one (1) acre due to removal of the hydrology from the "blue-line" stream. • The Neuse River Buffer Requirements require that stormwater be discharge sheet flow prior to entering the stream. This will allow treatment for the nutrients. The proposed project will not be sheet flow. The proposed project will discharge directly to Stoney Creek through the ditch. • The proposed project will be removing a natural "blue-line" stream. Unless the relocation replaces all the attributes of the "blue-line" stream it would be considered a violation of the State Antidegradation Policy because it is a loss of use and function. In conclusion, it is the opinion of this office that the proposed project will violate State AJL ?
