Based on our records, there are no Federally-listed endangered or
threatened species which may occur within the project impact area.
The attached page(s) list(s) the Federally-listed species which
may occur within the project impact area.
If the proposed project will be removing pines greater than or equal
to 30 years of age in pine or pine/hardwood habitat, surveys should
be conducted for active red-cockaded woodpecker cavity trees in
appropriate habitat within a 1/2 mile radius of project boundaries.
If red-cockaded woodpeckers are observed within the project area or
active cavity trees found, the project has the potential to
adversely affect the red-cockaded woodpecker, and you should contact
this office for further information.
The Service concurs that the proposed project is not likely to
adversely affect Federally-listed endangered or threatened species,
their formally designated critical habitat, or species currently
proposed for Federal listing under the Endangered Species Act, as
amended.
Staffing limitations prevent us from conducting a field inspection
of the project site. Therefore, we are unable to provide you with
site specific recommendations at this time.

Upon review of your request for 401 Water Quality
Certification to place fill material in 1.21 acres of wetlands or
waters which are tributary to Tar River for a residential
development located at Emerson Drive near SR 1717 in Nash County
as described in your submittal dated 25 June 1993, we have
determined that the proposed fill can be covered by General Water
Quality Certification Numbers 2664, 2732 and 2671 issued January
21, 1992. Copies of the General Certifications are attached.
These Certifications may be used in qualifying for coverage under
Corps of Engineers' Nationwide Permit Numbers 12, 14 and 26.
If this Certification is unacceptable to you, you have the
right to an adjudicatory hearing upon written request within
thirty (30) days following receipt of this Certification. This
request must be in the form of a written petition conforming to
Chapter 150B of the North Carolina General Statutes and filed
with the Office of Administrative Hearings, P.O. Box 27447,
Raleigh, N.C. 27611-7447. Unless such demands are made, this
Certification shall be final and binding.

Dear Mr. Whitley:
Reference your application of June 14, 1993, submitted on your behalf by
Appian Consulting Engineers, for Department of the Army authorization to
discharge fill material within waters of the United States, causing impact to
a total of 1.16 acres of wetlands adjacent to Grape Branch and above
headwaters of an unnamed tributary to the Tar-River, for construction of the
proposed-Millbrook Phase 2 residential development, on a 25.19-acre tract
northwest of S.R. 1717 (Westmount Drive), in Rocky Mount, litash County; North
Carolina.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization,
pursuant to Section 404 of the Clean Water Act, was provided for the discharge
of material for backfill or bedding for utility lines, including outfall and
intake structures, provided there is no change in pre-construction contours.
Authorization was also provided, pursuant to Section 404 of the Clean
Water Act, for discharges of dredged or fill material into headwaters and
isolated waters provided:
a. the discharge does not cause the loss of more than 10 acres of waters
of the United States;
b. the permittee notifies the District Engineer if the discharge would
cause the loss of waters of the United States greater than one acre in
accordance with the "Notification" general condition. For discharges in
special aquatic sites, including wetlands, the notification must also include
a delineation of affected specific aquatic sites, including wetlands; and
c. the discharge, including all attendant features, both temporary and
permanent, is part of a single and complete project.
Authorization, pursuant to Section 10 of the Rivers and Harbors Act of
1899 and Section 404 of the Clean Water Act, was further provided for fills
for roads crossing waters of the United States (including wetlands and other
special aquatic sites) provided:

a. The width of the fill is limited to the minimum necessary for the
actual crossing;
b. The fill placed in waters of the United States is limited to a filled
area of no more than one-third acre. Furthermore, no more than a total of 200
linear feet of the fill for the roadway can occur in special aquatic sites,
including wetlands;
c. The crossing is culverted, bridged or otherwise designed to prevent
the restriction of, and to withstand, expected highflows and the movement of
aquatic organisms;
d. The crossing, including all attendant features, both temporary and
permanent, is part of a single and complete project for crossing of a water of
the United States; and
e_ For fills in special aquatic sites, including wetlands, the permittee
notifies the-District Engineer in accordance with the "Notification" general
condition.
As discussed in a-conversation between Mssrs. Eric Alsmeyer of my staff
and Shawn Joyner and Michael Stocks of Appian Consulting Engineers on July 16,
1993, because of the restrictions of the nationwide permits, only.0.11 acre of
impacts can be authorized under the road crossing general permit, and
therefore, 1.03 acres of impact must be authorized under the headwaters-fills
general permit, with 0.02 acre utility line impacts and the total impact
remaining 1.16 acres.
--Your work-is authorized by these nationwide permits provided it is
accomplished in strict accordance with the enclosed conditions and provided
you receive a Section 401 water quality certification from the North Carolina
Division of Environmental Management. You should contact Mr. John Dorney,
telephone (919) 733-1786, regarding water quality certification. These
nationwide permits do not relieve you of the responsibility to obtain other
required State or local approval.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain
authorized provided the activity is completed within 12 months of the date of
the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.

Please note that this authorization is valid for the work described above
only, and impacts of subsequent projects on this property would have to be
considered cumulatively with these impacts, regardless of future subdivision
