Ortosky, Jr. Soil and Environmental Consultants, Inc. 1125 Cedarhurst Drive Raleigh, North Carolina 27609 Dear Mr. Ortosky: Subject: Proposed Fill in Headwaters or Isolated Wetlands North Summit Square Forsyth County Upon review of your request for Water Quality Certification to place fill material in 2.08 acres of wetlands for commercial development, we have determined that the proposed fill can be covered by General Water Quality Certification No. 2176 issued November 4, 1987. A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 26. Deed restrictions shall be placed on wetlands in the floodplain east of the shopping center to prevent future fill. The stormwater pond should be designed to draw water from middepth (siphon design). A water quality pond is to be constructed on the site. The dam should be a siphon type. The WSRO believes that the 401 certificate should be issued only to the area west of the U.T. to Mill Creek. In this way, the impact on the wetlands is minimized. In addition, the site plans do not call for construction in this area. The WSRO recommends that a 401 certificate be issued with the above conditions. The project is located north of Winston-Salem, N.C. near the inter- section of University Parkway and Highway 52 as shown on the enclosed plans. May 17, 1991 NRCD - DEM Attn: Mr. John Dorney P.O. Box 27687 Raleigh, NC 27611 The Corps approved detailed wetland delineation is shown on the attached map. These delineations have been approved by Mr. John Thomas of the US Army Corps of Engineers. Upon receiving our Water Quality Certification, we will then proceed with obtaining the necessary Corps permits. Fill in a portion of the wetlands will be required to utilize the property for a retail shopping area including parking, etc. (see attached map). As you can see, available uplands have been utilized as much as possible so that wetland fills have been minimized. It will be necessary to fill 2.08 acres (see map) of jurisdictional wetlands above headwaters for placement of the proposed facilities. A majority of the wetlands to be filled (1.21 acres) are contained within an old drained farm pond and are comprised of sediment deposited there in the past, now overlying upland soil, but still technically qualifying as jurisdictional wetland. This area within the old pond site does not appear to be a high quality wetland and may change over time, if left alone, to a non-wetland condition.
