Arran Lakes West SiD, #91709 Cumberland County FROM: SUBJECT: As a result of street construction in the subject development, fill material has been placed in wetlands adjacent to an intermittent stream and in a swampy area near Little Rockfish Creek. The filled area will likely be used for residential construction (portions of 5 or 6 building lots). Mr. R. A. Rumbough of Biltwell Construction has indicated that the COE has required on-site mitigation for the loss of wetlgnd. Removal of some fill has also been required. A small upland area has been excavated and temporarily seeded. Natural wetland vegetation has already overtaken portions of this area. Considering the relatively low value of the wetlands impacted and the mitigation presently in place, it is the recoIIUllendation of this office that the appropriate after-the-fact certification be granted. However, the applicant should be required to address the area of wetland fill at the end of Lakeway Drive. This area may have been meant for inclusion in this certification, though neither the application nor the supporting drawings indicate such. Our fIles show that the permit issued to Arran Lakes West Subdivision in December, 1991 required mitigation. The information I found in the file is not complete. This subdivision has been under construction since the late 1980's and this is the final section. We are requesting 401 certification for the area shown in yellow on the plot plan. Rivermeade Drive was constructed in 1990 and the resulting spoil was placed in the 404 Wetlands. The Corps has reviewed and approved our delineation. Mr. R. A. Rumbough of Biltwell Construction has indicated that the COE has required on-site mitigation for the loss of wetland. Removal of some fill has also been required. A small ~land area has been excavated and temporarily seeded. Natural wetland vegetation-nas already overtaken portions of th~s area. ~ Considering the relatively low value of the wetlands impacted and the mitigation presently in place, it is the reconnnendation of this office that the appropriate after-the-fact certification be granted. However, the applicant should be required to address the area of wetland fill at the end of Lakeway Drive. This area may have been meant for inclusion in this certification, though neither the application nor the supporting drawings indicate such.
