determined that the proposed fill can be covered by General Water
Quality Certification No. 2176 issued November 4, 1987. .A copy
of the General Certification is attached. This Certification may
be used in qualifying for coverage under Corps of Engineers'
Nationwide Permit No. 26. An additional condition is that the
cleared right of way should be kept to the minimum needed for
road construction.

This Office has reviewed the subject 401 Certification
request and recommends it be approved. However, Mr. Jerry
McCrain, consultant, states in a letter that it should be assumed
that a 500 foot wide corridor will be cleared during
construction. This Office believes this is extremely oversized
considering that a forty-six (46) foot median and four (4) lanes
of traffic are proposed. It is recommended that the 401
Certification, if issued, limit the cleared area to only what is
needed.

Re: Derita Road/US 29 Connector, Cabarrus County, N.C.
Dear Steve:
Interstate Combined Ventures, in cooperation with the North
Carolina Department of Transportation, proposes to construct a 3.2
mile connector road on new location from US 29 opposite the
Charlotte Motor speedway to Derita Road (SR 1445) in Cabarrus
County (Fig. 1). The roadway will be a two lane facility on four
lane right-of-way with a 46-foot median. A diamond interchange is
proposed at the I-85 flyover, and intersection improvements will
be undertaken at terminal ends of the alignment (US 29 and Derita
Road).
Environmental Services, Inc. has been retained to assist with
planning efforts. Our staff visited the project area on October
28, 29, and 30, 1991. The alignment was walked and jurisdictional
areas subject to Section 404 of the Clean Water Act (33 U.S.C.
1344) were documented. Our field meeting with you on November 8,
1991 confirmed preliminary determinations.
A concerted effort has been made to avoid significant infringement
on the Rocky River and associated floodplain wetlands. For the
most part, the alignment has been positioned on high ground sites
above the 600-ft. contour. Encroachment will be limited to partial
takings near the upper limits of several headwater tributaries
which occur in the corridor (Fig. 2A; Table 1). Jurisdictional
boundaries are generally confined to defined channel margins.
Based on our discussions with you during the November 8 field
review, we understand that Nationwide Permit #14 (33 CFR
330.5 (a) (14)) will apply at individual sites where perpendicular
crossings are anticipated (Sites #1,2,3,4,6,7). Lateral
encroachment at sites #5 and 8 (total: 0.76 acres) is permitted
under Nationwide Permit #26 (33 CFR 330.5(a)(26)). It is our
understanding that General 401 Water Quality Certifications are
currently in effect for both nationwide permits.

proceed with development of the proposed connector road under
existing regulations, unless informed otherwise by your office.
