near Wanchese, North Carolina, has applied to the North
Carolina Division of Environmental Management for a.Water Quality
Certification pursuant to Section 401 of the Federal Clean Water
Act and Environmental Management Commission rules in 15A NCAC 2H
.0500 and 15A NCAC 2B .0109. The activity for which the
certification is sought is construct a flood protection dike
around the Clinton Wastewater Treatment Plant, in 2.4 acres of
wetlands near the confluence of Dollar Branch and Williams Old
Mill Branch in Sampson County.
The public is invited to comment on the above mentioned
application to the Division of Environmental Management.

CLINTON WASTEWATER TREATMENT PLANT

Flooding and inadequate drainage are persistent problems at the Clinton
Wastewater Treatment Plant (WTP) which is located at the confluence of Dollar
Branch and Williams O1d.Mill Branch, a tributary to Great Coharie Creek in
Sampson County, North Carolina (see Figure 1). Floodwaters entering the
facility create extraneous flows-which must be treated as wastewater,
increasing the plants operating costs and reducing its treatment capacity.
Flooding also results in damages to buildings and equipment and in saturation
of-the facility's sand treatment beds, rendering them useless until repairs
are completed.
The Wilmington District, U.S. Army Corps of Engineers, proposes to
'construct a dike around the Clinton WTP (see Figure 2). This.project will be
constructed under the authority of Section 205 of the 1948 Flood Control Act,
as amended.
This project was originally proposed as a component of the Great Coharie
Creek Project as-described in the Draft Environmental Impact Statement (DEIS),
Great Coharie Creek Project, Sampson County, North Carolina, dated June 1992
and circulated for public comment in July of 1992. In addition to the
proposed dike construction as described herein, the Great Coharie Creek
Project included clearing and snagging along 18 miles of the lower Great
Coharie Creek. However, the'propos'ed"'clearing and snagging has been dropped
.from present consideration at the request of the-local-sponsor. Further
action on the clearing and snagging of Great Coharie Creek would require
reinitiation of the NEPA process.
A Draft Detailed Project Report and-Environmental Assessment on Flood
Damage Reduction, Clinton Wastewater Treatment Plant, City of Clinton, North
Carolina, dated August 1993, has been prepared and is being circulated for a
30-day review period.
PROJECT DESCRI-"?TION
66t?:"' The'p"roposed plan is the construction and maintenance of an earth dike
around the Clinton WTP (Figure 2) providing 100-year flood protection. The
dike would•have:a length of 2,200 feet, a 10-foot top width with 3 horizontal
to 1 vertical „side slopes. An 8-foot-wide by 2-foot-deep keytrench would be
excavated and backfilled under the dike to reduce seepage. A ramp would be
built to allow the service road to be built over the dike.
The top of dike elevation is determined by the existing water surface
profile and is designed to protect against a 100-year flood event. Freeboard
for the dike was set at 2 feet. The maximum heights of the dike are 6.5 feet
along Williams Old Mill Branch and 5.7 feet along Dollar Branch. The dike
centerline would be set parallel to and 35 feet away from the Clinton WTP
perimeter fence. The dike would be angled away on the west side to allow
construction of the service road ramp. The ends of the dike are at high
ground near the northeast and southeast sides of the Clinton WTP.
About 800 linear feet of Williams Old Mill Branch adjacent to the Clinton
WTP perimeter fence would be realigned 95 feet away from the fence to allow
construction of the dike outside the fence. The new channel would be 10 feet
wide and 2 feet deep. This new channel is only intended as a relocation, not
as a channel improvement project.
Interior drainage would be collected at two shallow sumps. One would be
located between the sludge drying beds and the north fence. A second sump
would be located on the west side between the dike and the existing drainage
,ditch.
ENVIRONMENTAL CONSIDERATIONS
Environmental impacts associated with the construction of the proposed
..project are discussed in the previously referenced August 1993 Draft Detailed
Project Report and Environmental Assessment.
The project is not expected to affect prime farmland, cultural resources,
endangered species, or hazardous materials. Insignificant impacts to
fisheries resources, flood plains, important farmland, and wildlife resources
were identified. Dike construction will result in the loss of 2.4 acres of
wetlands, which would be mitigated by the proposed restoration of 4.8 acres of
former wetlan'ds'that have been converted to farmland. Although temporary
impacts to water quality in Williams Old Mill Branch may occur during
construction, long-term improvements in water quality in Williams Old Mill
Branch are expected. Socioeconomic benefits associated with reduced.flood
damages at the Clinton WTP are-also-expected.
A Section 404 (b)(1) (P.L. 95-217) evaluation was prepared for the
placement of fill material in waters of the United States, including wetlands,

and has been included in the EA. A Section 401 (P.L. 95-217) Water Quality
Certificate has been requested from the North Carolina Division of
Environmental Management.
The proposed project has been evaluated in accordance with the Coastal
Zone Management Act of 1972, as amended. This project will not be conducted
within the coastal area of North Carolina and will not result in significant
impacts on the portions of the Cape Fear River Basin that are located in the
coastal area down stream of the project. Therefore, it has been concluded
that a consistency determination is not required. State review of this
finding is being conducted in conjunction with review of the EA.
It has been determined that the proposed project will have no impact on
significant cultural resources. This determination has been coordinated with
the State Historic Preservation Officer.
The.proposed project is in compliance with Executive Order 11988 (Flood
Plain Management), dated May 24, 1977. There are no practicable alternatives
to constructing the dike in the flood plain.
The proposed project has been evaluated and judged to be in compliance
with Executive Order 11990 (Protection of Wetlands). The placement of fill
material associated with dike construction will have an adverse impact on
wetlands. This is considered to,be a significant loss and will be mitigated
through restoration.of former wetlands that have been previously converted to

farmland. 4az-=significant impacts to wetlands are expected as a result of
fearing. and- snagging. t

Several alternative plans for the proposed project were developed and
presented in the EA. There are no practicable alternatives that have less

impact on wetlands (the selected plan has the least impact on wetlands).
No residences or businesses will be displaced by the proposed project.
However, the project sponsor (Sampson County) will be required to obtain about
4.8 acres of private land, proposed for mitigation.
The decision whether to perform this work will be based on an evaluation
of the probable impact, including cumulative impacts, of the proposed activity
on the public interest. That decision will reflect the national concern for
both protection and utilization of important resources. The benefit which
reasonably may be expected to accrue from the proposal must be balanced
against its reasonably foreseeable detriments. All factors which may be
relevant to the proposal will be considered, including the cumulative effect
thereof; among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, historic properties, fish and wildlife
values, flood hazards, flood plain values, land use, navigation, shoreline
erosion and accretion, recreation, water supply and conservation, water
quality, energy needs, safety, food and fiber production, mineral needs,
considerations of property ownership, and in general, the needs and welfare
of the people.

Any person who has an interest which may be affected by the proposed work
may request a public hearing. The request must be submitted in writing to the
District Engineer within 30 days of the date of this notice and must clearly
set forth the interest which may be affected and the manner in which the
interest may be affected by this activity. In order for such a request to be
given appropriate consideration, it should be mailed to the U.S. Army Engineer
District, Wilmington, Post Office Box 1890, Wilmington, North Carolina 28402-
1890, in time to be received on or before DATE. All correspondence should
refer to the title, number, and date of this notice.
This public notice is being provided to Federal, State, and local agencies
and known interested individuals and organizations.

7. DESCRIPTION OF PROPOSED WORK: The proposed plan is the construction and
maintenance of an earth dike around the Clinton Wastewater Treatment Plant (WTP)
(see attached figure) providing 100-year flood protection. The dike would have
a length of 2,200 feet, a 10-foot top width with 3 horizontal to 1 vertical side
slopes. An 8-foot-wide by 2-foot-deep keytrench would be excavated and
backfilled under the dike to reduce seepage. A ramp would be built to allow the
service road to be built over the dike.
The top of dike elevation is determined by the existing water surface profile and
is designed to protect against a 100-year flood event. Freeboard for the dike
was set at 2 feet. The maximum heights of the dike are 6.5 feet along Williams
Old Mill Branch and 5.7 feet along Dollar Branch. The dike centerline would be
set parallel to and 35 feet away from the Clinton WTP perimeter fence. The dike
would be angled away on the west side to allow construction of the service road
ramp. The ends of the dike are at high ground near the northeast and southeast
sides of the Clinton WTP.
About 800 linear feet of Williams Old Mill Branch adjacent to the Clinton WTP
perimeter fence would be realigned 95 feet away from the fence to allow
construction of the dike outside the fence. The new channel would be 10 feet
wide and 2 feet deep. This new channel is only intended as a relocation, not as
a channel improvement project.
Interior drainage would be collected at two shallow sumps. One would be located
between the sludge drying beds and the north fence. A second sump would be
located on the west side between the dike and the existing drainage ditch.

8. PURPOSE OF PROPOSED WORK: The purpose of the dike is to provide protection
from flood damage to the Clinton WTP on Williams Old Mill Branch and Dollar
Branch.

Several alternative plans for the proposed project were developed and presented
in the Environmental Assessment. There are no practicable alternatives that have
less impact on wetlands (the selected plan has the least impact on wetlands).
Dike construction will result in the loss of 2.4 acres of wetlands, which would
be mitigated by the proposed restoration of 4.8 acres of former wetlands that
have been converted to farmland. Although temporary impacts to water quality in
Williams Old Mill Branch may occur during construction, long-term improvements
in water quality in Williams Old Mill Branch are expected.

NPDES Permit Application
Sampson County
On July 9, 1992, the Fayetteville Regional Office received a copy of a
letter in which a citizen of Clinton expressed concern over the proposed
expansion of that City's municipal wastewater treatment plant. Mr. Jeff Riley
of 900 Jasper St., Clinton, North Carolina lives adjacent to the headwaters of
Williams Old Mill Branch. During heavy rainfall events, floodwaters inundate
much of the low lying area around his home and have caused serious damages to
a neighbors now vacant house. Mr. Riley is concerned that additional waste
flow from the treatment plant into Williams Old Mill Branch will increase the
chances of flood damage to his property and further impede flow in an already
slow drainage system.
Staff from this office visited Mr. Riley at his home on Wednesday, August
12th. It is readily apparent that he has a bona fide concern over flooding on
and near his property. However, as it was explained to him at the time, it is
unlikely that any changes in the flow at the treatment plant would affect his
property. The Clinton Wastewater Treatment Plant is located approximately one
mile downstream from Mr. Riley's residence. According to information provided
by the Corps of Engineers, stream slopes in this area are very low, one to two
feet per mile. Utility lines and highway construction have further restricted
the flow in several locations, creating broad, wet flats. Deadfall from trees
and other vegetation, sediment, and a reportedly flourishing beaver population
have combined to cause serious- obstructions to the stream flow. This results
in flooding during periods of heavy rainfall, even in the upper reaches of the
stream near Mr. Riley.
In order to prevent flooding at the Clinton Wastewater Treatment Plant,
the City has proposed a dike which should satisfactorily exclude the storm
flow. This will require relocation of a small segment of Williams Old Mill
Branch at existing grade. Consideration has been given to applying for a
permit to dredge the stream channel, although it is unlikely that the Corps or
this Division would support this action. However, a draft Environmental Impact

Statement is currently being reviewed in which the Corps of Engineers discuss
a major clearing and snagging effort along 44 miles of Great Coharie Creek,
which receives flow from Williams Old Mill Branch. Improvement to the flow in
the Great Coharie should accelerate drainage in the tributaries, at least to a
minor degree. Mr. Riley was informed of this proposal, but at the same time
advised that the time period involved may be several years, if it is approved
and funded.

Dike Construction. This project would require the filling of 2.1 acres of
"wetlands including marsh, stream, and wooded,-habitat for dike construction.
Excavation of about 0.3 acre of marsh would be required for stream channel
relocation to allow for dike placement. Fill material will be sandy clay
material suitable for dike construction and riprap. The material is not
considered to be contaminated or polluted. The placement of fill for
construction is a one-time event;. however, periodic maintenance would be
required to repair dike damage due to floods or erosion. The loss of
wetlands will be mitigated through land acquisition with restoration of
wetlands.
Clearing and Snagging. The residue from clearing and snagging operations
is proposed for disposal in wetlands. This material is primarily organic
but will also include manmade debris. The material is not considered to
be contaminated or polluted and would not result in significant impacts to
.wetland resources. Some minor vegetative clearing and temporary fill in
wetland areas would be required at bridge crossings that do not have
sufficient clearance to allow for the passage.of equipment required for
clearing and snagging. Any fill material placed in wetlands for access
will be removed upon project completion. Periodic clearing and snagging
for project maintenance is expected to be required about every 3 years and
after each, major flood.
PROJECTED FUTURE.VARIATIONS IN THE NATURE OF THE DISCHARGE: None
TYPE. DIAMETER OR CROSS-SECTION AND LENGTH OF CONVEYANCE OF DISCHARGE:
Fill material for dike construction will be removed from the borrow.areas
by dragl,ine or other heavy equipment and will be transported by earth-moving
vehicles to the fill site.
The type of equipment used by the contractor for clearing and snagging will
not be specified; however, the right-of-way clearing and access restrictions
are expected to limit the contractor to the use of equipment that can operate
from the stream channel. It is expected that debris will be dragged by winch
to the disposal area. Terrestrial access between snags will not be allowed.
The contractor would be required to operate within the easement without
clearing of trees with the following two exceptions. The clearing of small
trees and brush (less than 4" dbh) would be allowed if needed for material
disposal and access. Clearing of trees and other vegetation will be allowed
at bridge crossings only if instream bridge clearance is not adequate for
equipment passage. All trees or saplings to be removed that have roots or
a root mass below ground level will be cut off above ground level to prevent
disturbance of the ground and unexposed tree-roots.

FLOOD DAMAGE REDUCTION
GREAT COHARIE CREEK
SAMPSON COUNTY, N.C.
TO WHOM IT MAY CONCERN:
Flooding along the Great Coharie Creek has caused crop damage and
restricted timely planting of crops in flood-prone fields. Along Williams Old
Mill Branch, a tributary to Great Coharie Creek, high-water table prevents the
efficient operation of the Clinton Wastewater Treatment Plant (WTP) and
flooding damages the plant and plant equipment almost annually and results in
degradation of water quality in Williams Old Mill Branch.
The Wilmington District, Corps of Engineers, Wilmington, North Carolina,
proposes to conduct selective clearing and snagging along the lower Great
Coharie Creek from SR 1214 to the Black River downstream (about 18 Miles), and
to construct a dike around the Clinton WTP (see figure 1). This project will
be constructed under the authority of Section 205 of the 1948 Flood Control
Act, as amended.
A Draft Detailed Project Report and Environmental Impact Statement on
Flood Damage Reduction, Great Coharie Creek, Sampson County, N.C., dated June
1992, has been prepared and is being circulated for a 45-day review period.
PROJECT DESCRIPTION
The proposed plan includes the
dike around the Clinton WTP (figure
of Reach 1 (about 18 miles) of the
Dike Construction, Clinton WTP
construction and maintenance of an earth
2) and the selective clearing and snagging
Great Coharie Creek (figure 3).
The dike, designed to provide 100-year protection, will have a length of
2,200 feet, a 10-foot top width with 3 horizontal to 1 vertical side slopes.
An 8-foot-wide by 2-foot-deep keytrench will be excavated and backfilled under
the dike to reduce seepage. A ramp will be built to allow the service road to
be built over the dike.

The top of dike elevation is determined by the existing water surface
PA' le- Freeboard for the dike was set at 2 feet. The maximum heights of
th`'dike,are 6.5 feet along Williams Old Mill Branch and 5.7 feet along Dollar
Branch. The dike centerline will be set parallel to and 35 feet away from the
Clinton WTP,perimeter fence. The dike will be angled away on the west side to
allow construction of the service road ramp. The ends of the dike are at high
`.4. ro nd near the northeast and southeast sides of the Clinton WTP.
About 800 linear feet of Williams Old Mill Branch adjacent to the Clinton
WTP perimeter fence will be realigned 95 feet away from the fence to allow
construction of the dike outside the fence. The new channel will be 10 feet
wide and 2 feet deep. This new channel is only intended as a relocation, not
as a channel improvement project.
Interior drainage will.be collected at two shallow sumps. One will be
located between the sludge drying beds and the north fence. A second sump
will be located on the west side between the dike and the existing drainage
ditch. The west fence will be relocated between the dike and the sump. The
sump would normally drain to Williams Old Mill Branch via a culvert fitted
with a flapgate to prevent backflow during high stages on Williams Old Mill
Branch. It will be necessary to install a pumping station to prevent runoff
and ground water infiltration from overflowing the sump while the flapgate is
closed.
Clearing and Snagging, Great Coharie Creek
Clearing and snagging will be performed along Reach 1 of the Great Coharie
Creek, from its mouth at Black River upstream to the SR 1214 bridge (see
figure 3). Clearing and snagging will consist of the removal of fallen trees,
logs, limbs, debris, and selected live trees from the stream channel and a
25-foot-wide corridor on each side of 'the stream channel. This project does
not include sediment removal, and no work is required in backwater areas.
Embedded Logs, limbs, etc., and unembedded materials which are less than
6 feet long would be left in place to limit the loss of fish habitat; however,
embedded logs and limbs would be trimmed of branches exposed above the water
to reduce"the potential for accumulation of other debris.
Live and standing dead trees occurring within or adjacent to the stream
channel will not be cut unless they are at immediate risk of falling into the
Creek. These trees will be identified and marked by the Corps prior to
construction. The U.S. Fish and Wildlife Service (USFWS) and the North
Carolina Division of Water Resources will be provided an opportunity to assist
in tree identification and marking. Stumps will not be removed; however,
where roots are undercut, exposed portions of roots will be trimmed. No live
cypress trees or their knees will be removed from the channel or islands
within the stream channel.
Manmade items not in their intended place of use are considered debris and
will be removed to an adjacent disposal area or if located within 150 feet of
the centerline of any public road crossing will be disposed of in an approved

offsite solid waste disposal site. Any remnants of public highway bridges,
including piles, foundations, substructure, diving boards, swings, boats, and
docks in their intended place of use will not be removed.
A 100-foot-wide right-of-way will be provided on both banks for disposal
and access. Residue of the clearing and snagging operation will be
intertwined between trees within the right-of-way to prevent reentry into the
channel. Terrestrial access between snags will not be allowed. The
contractor will be required to operate within the easement without clearing of
trees with the following two exceptions. The clearing of small trees and
brush (less than 4" DBH) would be allowed if needed for material disposal and
access. Clearing of trees and other vegetation will also be allowed at bridge
crossings if instream bridge clearance is not adequate for equipment passage.
All trees or saplings to be removed, that have roots or a root mass below
ground level, will be cut off above ground level to prevent disturbance of the
ground and unexposed tree roots. Herbicides will not be used to prevent stump
sprouting. Felling of trees or saplings by pushing will not be allowed.
The type of equipment used by the contractor will not be specified;
however, the right-of-way clearing and access restrictions are expected to
limit the contractor to the use of equipment that can operate in the stream
channel. No work would be performed in the creek during the dates of February
1 through May 31. Periodic clearing and snagging for project maintenance is
expected to be required about every 3 years and after each major flood.
ENVIRONMENTAL CONSIDERATIONS
Environmental impacts associated With the construction of the proposed
project are discussed in the previously referenced Draft Detailed Project
Report and Environmental Impact Statement (DEIS) on Flood Damage Reduction,
Great Coharie Creek, dated June 1992.
A Section 404 (b)(1) (P.L. 95-217) evaluation was prepared for the
placement of fill material in waters of the United States, including wetlands,
and has been included in the DEIS. Approximately 2.4 acres of wetlands would
be filled for dike construction. The residue from clearing and snagging
operations is also proposed for disposal in wetlands. This material is
primarily organic but will also include manmade debris. This disposal would
not result in significant impacts to wetland resources. Clearing and snagging
would not be expected to significantly affect existing ground water
conditions, drain hydric soils, or result in the elimination of hydrophytic
vegetation in adjacent wetlands; therefore, no loss of wetlands would be
anticipated as a result of the proposed clearing and snagging.
A Section 401 (P.L. 95-217) Water Quality Certificate has been req ested -?'

A list of federally-listed threatened and endangered species that could tt''
occur within the project area was provided by the USFWS and the National

Marine Fisheries Service, pursuant to the Endangered Species Act of 1973, as ' 0
amended. The proposed project is not expected to have an adverse effect on
any species currently listed.

The proposed project has been evaluated in accordance with the Coastal
Zone Management Act of 1972, as amended. This project will not be conducted
within the coastal area of North Carolina and will not result in significant
impacts on the portions of the Cape Fear River Basin that are located in the
coastal area down stream of the project. Therefore, it has been concluded
that a consistency determination is not required. State review of this
finding is being conducted in conjunction with review of the DEIS.
It has been determined that the proposed project will have no impact on
significant cultural resources. This determination has been coordinated with
the State Historic Preservation Officer.
The proposed project is in compliance with Executive Order 11988 (Flood
Plain Management), dated May 24, 1977. There are no practicable alternatives
to constructing the dike or conducting clearing and snagging in the flood
plain.
The proposed project has been evaluated and judged to be in compliance
with Executive Order 1'1990 (Protection of Wetlands). The placement of fill
material associated with dike construction will have an adverse impact on
wetlands. This is considered to be a significant loss and will be mitigated
through restoration of former wetlands that have been previously converted to
farmland. No significant impacts to wetlands are expected as a result of
clearing and snagging.
Several alternative plans for the proposed project were developed and
presented in the DEIS. There are no practicable alternatives that have less
impacts on wetlands (the selected plan has the least impact on wetlands).
No residences or businesses will be displaced by the proposed project.
However, the project sponsor (Sampson County) will be required to obtain about
3 acres of private land, proposed for mitigation and a 100-foot-wide
construction and maintenance easement along each side of Great Coharie Creek
within the project area. The proposed easement will allow clearing and
snagging, material disposal and access, and include conservation restrictions
which would regulate future timbering within the easement area.
The decision whether to perform this work will be based on an evaluation
of the probable impact, including cumulative impacts, of the proposed activity
on the public interest. That decision will reflect the national concern for
both protection and utilization of important resources. -The benefit which
reasonably may be expected to accrue from the proposal must be balanced
against its reasonably foreseeable detriments. All factors which may be
relevant to the proposal will be considered, including the cumulative effect
thereof; among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, historic properties, fish and wildlife
values, flood hazards, flood plain values, land use, navigation, shoreline
erosion and accretion, recreation, water supply and conservation, water
quality, energy needs, safety, food and fiber production, mineral needs,
considerations of property ownership, and in general, the needs and welfare
of the people.

may request a public hearing. The request must be submitted in writing to the
District Engineer within 30 days of the date of this notice and must clearly
set forth the interest which may be affected and the manner in which the
interest may be affected by this activity. In order for such a request to be
given appropriate consideration, it should be mailed to the U.S. Army Engineer
District, Wilmington, Post Office Box 1890, Wilmington, North Carolina 28402-
1890, in time to be received on or before August 6, 1992. All correspondence
should refer to the title, number, and date of this notice.
This public notice is being provided to Federal, State, and local agencies
and known interested individuals and organizations. A copy of the mailing
list is available upon request.
