We are currently working on the last item we need to fully respond to Ross' request for additional information, which is our wetlands delineation drawing. We have completed a detailed delineation of all jurisdictional features on the entire property, and we have located all of those features with our GPS. We are currently working on the drawing to illustrate those features, and I anticipate that will be complete before end of day Friday. Regarding the requirement for rip-rap at the culvert outlet, Johnston County has approved the stormwater plan as-is, with no rip-rap apron. See the attached stormwater management plan approval letter from Johnston County. Regarding the dwarf wedgemussel, John Ellis with the USFWS responded: "The Service does not have concerns with the proposed crossing specifically however due to the proximity to several endangered aquatic species, we encourage the development be extra diligent in controlling erosion and sedimentation at the crossing as well as throughout the property as it is developed." I will forward his email to you directly, so you have the entire chain for your records. I will email the wetlands delineation drawing to you as soon as it is complete, but don't hesitate to reach out to me with any questions or needs for additional information in the meantime. I have reviewed the information and need clarification before proceeding with verifying the use of Nationwide Permit (NWP) 29. Please submit the requested information below (via e-mail is fine) within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the NWP or consider your application withdrawn and close the file: 1. Section C.5a. of the PCN Application states that a "[d]elineation [was] completed only for [the] proposed stream crossing." However, the 2017 Nationwide Permit General Condition 32(b)(5), requires that the PCN include a delineation of the project site. The project site in this case would be the entire residential subdivision, any associated utilities/transportation infrastructure, and any other work related to and dependent upon the proposed project. Please provide a full delineation of any potential waters of the United States within the proposed project site and coordinate with the USACE for concurrence on the delineation. 2. Can you confirm the stream crossing identified as impacts S1 and S2 in the PCN application would not require a riprap dissipator pad at the culvert outlet? 3. Given the known occurrence of the dwarf wedgemussel (Alasmindonta heterodon) which is a federally endangered species within 1 mile of the project area, informal consultation with the USFWS may be required for this project. Please provide further information on the stream crossing such as photos, data forms, and detailed description of substrate and flow regime for the stream to assist the USACE in making an effects determination regarding the dwarf wedgemussel. Please note that the Corps cannot verify the use of a NWP until Section 7 consultation is complete. Alternatively, the applicant or their agent may choose to coordinate with the USFWS regarding their proposed project's potential impacts to any federally listed endangered/threatened species; if this route is taken, please provide the results of the coordination to the USACE along with the other items requested in this email. Based upon the information submitted, the plans have been approved with the following conditions: 1. Please provide a copy of the recorded restrictive covenants and a note on the Final Plat limiting the impervious area to a maximum of 5,401 SF for each of the 63 lots. 2. Please provide a copy of the recorded restrictive covenants noting who will be responsible for maintenance of all drainage facilities located outside of the proposed NCDOT right of way. 3. Please indicate all drainage easements, riparian buffers, jurisdictional wetlands, and flood hazard areas on the Final Plat. 4. A stormwater certification by the engineer of record will be required at the completion of the project. A letter of credit or bond certified by the engineer of record must be submitted for any outstanding work prior to final plat recordation.
