After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3400, which can be downloaded from our web site at hfti)://h2o.enr.state.nc.us/ncwetlands. This Certification allows you to use your CAMA Permit when issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed, Coastal Stormwater and U.S. Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us anew application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed below: 1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401 Certification has been completed; 2. Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. 3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Preconstruction Notice Application. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur; N. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project; 5. Sediment and erosion control measures shall adhere to the design standards for sensitive watersheds [15A NCAC 4B .0024]; see NCDOT publication, Best Management Practices for the Protection of Surface Waters (March 1997); 6. The elevated walkway shall be located greater than 3 feet above the substrate, and no wider than 6 feet. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. PROJECT SUMMARY: The applicant proposes to construct a 20-slip boat docking facility with upland parking on an open space area and on Pailin Creek. PROJECT SETTING The site for the proposed development is a 50,276 square feet open space area located between lots 27 and 28 in Pailin Creek Landing, a 33 lot subdivision located at the end of Toxey Road, SR 1126, in Pasquotank County and on Pailin Creek, which is a tributary of Newbegun Creek. The property is mostly flat, has an elevation of approximately 6 feet above Normal Water Level (NWL), and was previously a farm field. The property has a Cypress swamp wetland fringe ranging from approximately 40 feet to 100 feet wide bordering the shoreline of Pailin Creek. Prior to subdividing, the property was approximately 44 acres in size. The current lot size is approximately one acre. The soils on the upland part of the property consist of sandy loam type soils. Vegetation on the upland area consists of indigenous grasses. Vegetation in the wetland area consists mostly of Cypress, with Red Maple, Pine, and Oak also present. Adjacent property to the north consists of an abandoned railroad right of way with a train trestle crossing Pailin Creek, and to the south, a residential building lot that has riprap for shoreline stabilization. Pailin Creek has water depths in this area ranging from -11/z feet to -3 feet below NWL, and the bottom consists of silt. The waters of Pailin Creek are classified as C SW by the Division of Environmental Management and are closed to shellfish taking. DEVELOPMENT PROPOSAL In order to provide water access and docking space to interior lots, the applicant proposes to construct a 20- slip marina on Pailin Creek offshore from the open space area. The proposed 20-boat slip marina consist of the following: • Accessing from Dockside Road, proposed on the "open space lot" between lots 27 and 28, • Construction of a 20 feet by 133 feet asphalt driveway, • 60 feet by 105 feet asphalt parking area (20 spaces), • 8 feet by 62 feet gravel walkway on high ground, and • 8 feet by 92 feet elevated wooden walkway to access 8 feet by 184 feet boat dock with 10 finger piers. Finger piers are proposed 12 feet in length and taper from the width of 3 feet to 1 foot. One 6 inch mooring piling will be placed at the end of each of the 10 finger piers, along with 34 additional mooring pilings (44 mooring pilings total) to assure safe portage. The proposed maximum distance from shore for the project is 38 feet. 4 FIELD INVESTIGATION REPORT Pailin Creek Landing AEC 02-010; Storm of Pasquotank, Inc. t Page 3 This project does not include dredging or filling. The applicant indicates that current water depths are sufficient to accommodate boats up to 20 feet in length. Submerged vegetation was not observed during the site visit. The opposite shoreline is approximately 168 feet away from the proposed project. Asphalt will be trucked in and spread for the driveway (8 feet by 133 feet) and parking (60 feet by 105 feet). Gravel for the walkway will be trucked in and spread (8 feet by 62 feet). The wooden walkway (8 feet by 92 feet), dock (8 feet by 184 feet), finger piers, and mooring pilings ([44] 6 feet by 16 feet) will be constructed using hydraulic pump and hand tools. Mooring pilings ([44] 6 inch diameter and 16 feet in length) will be driven in substrate using a hydraulic pump and spaced 14 feet apart for safe portage. The elevated walkway will the constructed at a minimum of 36 inches from the wetland substrate. ANTICIPATED IMPACTS The proposed 20-slip marina will result in the shading of approximately 1,744 square feet of Public Trust Area, Area of Environmental Concern (AEC). The walkway leading from the proposed upland parking area, over the Cypress swamp wetland and to the dock, will result in the shading of 320 square feet of 404 wetlands and 240 square feet of 404 wetlands located in the Public Trust Shoreline AEC. Proposed upland impacts as a result of the construction of the parking area consists of approximately 8,960 square feet of impervious surface. Temporary water turbidity will occur during construction. There are no other active piers or water access sites on Pailin Creek. (?? 2 c??P PROJECT NARRATIVE - CAMA MAJOR PERMIT JUN 2 0 1(f i Palin Creek Landing - Pasquotankc County, North Carolina COASTAL MANAGt;MIEN T The proposed 20 slip day dock "marina" is located within a 44 acre parce?T or, kin Creek off SR1126 (Toxey Road), Elizabeth City, Pasquotank County. A 33 lot subdivision is proposed and has been accepted by the planning board as Palin Creek Landing. The purpose of the proposed 20 slip marina is to accommodate the interior lot owners of Palin Creek Landing to access Palin Creek. The location of the 20 slip marina is proposed at the "open space" lot (50,276 s.f) located between lots 27 and 28 on Palin Creek and currently has no structures or impervious areas on site. The highground portion of this lot is currently agricultural farmland. The wetlands on this lot consist of cypress swamp. Coastal wetlands do not exist on this 44 acre parcel and has been verified by DCM field representative, Ed Harrell. Water depths were also taken by DCM field representative, Ed Harrell and Hyman & Robey, PC staff. The proposed 20 boat slip marina consist of the following: Accessing from Dockside Road, proposed on the "open space lot" between lots 27 and 28, construction of a 20'x 133' asphalt driveway, 60'x 105' asphalt parking area (20 spaces), 8'x 62' gravel walkway on higbground, 8'x 92' elevated wooden walkway to access 8'x 284' boat dock with ten (10) finger piers. Finger piers are proposed 12 feet in length and taper from the width of three feet to I foot. One 6" mooring piling will be placed at the end of each of the ten finger piers, along with 34 additional mooring pilings (44 mooring pilings total) to assure safe portage. This project does not include dredging or filling. Current water depths are sufficient to accommodate boats up to 25 feet in length. Submerged vegetation was not present during site visits and when water depths were taken. The adjacent shoreline is 168 feet away from the proposed project, therefore, this.project is consistent with the with 15A NCAC 07H.0208 (b)(6)(iii). Asphalt will be trucked in and spread for the driveway (8'x 133') and parking (60'x 105'). Gravel for walkway will be trucked in and spread (8'x 62'): Wooden walkway (8'x 92'), dock (8'x 184'), finger piers and mooring pilings ((44) 6"x 16') will be constructed using hydraulic pump and hand tools. Mooring pilings ((44) 67dia. 16' in length) will be driven in substrate using a hydraulic pump and spaced 14 feet apart for safe portage. Elevated walkway will be constructed at a minimum of 36" from the wetland substrate. Total impervious area for this project is 9,584 s.f. which includes the asphalt driveway, parking and gravel walkway. Total disturbance within 30' buffer: 8'x 30' = 240 s.f. (portion of walkway) Total decking over open water: boat dock 8'x 184'= 1,472 s.f. and portion of walkway 8'x 5'= 32 s.f. Total decking area over open water =1,504 s.f.
