Sullins, Deputy Director Division of Water Quality April 23, 2004 DWQ# 04-0393 Dare County Town of Kill Devil Hills C/o Mr. Steve Albright 101 Veterans Memorial Drive Kitty Hawk, NC, 27949 APPROVAL of 401 Water Quality Certification with Additional Conditions Dear Mr. Albright: You have our approval, in accordance with the attached conditions, to construct 7.5 acres of berms in Ocean Hazard Area in order to construct two sections of "Emergency Five Year Berm" along 1.2 miles of ocean beach in the Town of Kill Devil Hills in Dare County, as described in your application received by the Division of Water Quality on March 12, 2004. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3400, which can be downloaded from our web site at fiftp://h2o.enr.state.nc.us/ncwetiands. This Certification allows you to use your CAMA Permit when issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed, Coastal Stormwater and U.S. Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for. complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed below: 1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401 Certification has been completed; 2. Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. 3. No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Preconstruction Notice Application. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur; A N. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project; 5. Sediment and erosion control measures shall adhere to the design standards for sensitive watersheds [15A NCAC 4B .0024]; see NCDOT publication, Best Management Practices for the Protection of Surface Waters (March 1997). If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. One segment will extend from1527 N. Virginia Dare Trail to 1803 N. Virginia Dare Trail. The second segment will commence at 2407 N. Virginia Dare Trail and extend to 3319 N. Virginia Dare Trail. The berm has been designed for 6 cubic yards of sand material per each linear foot of berm structure. The project will result in 7.5 acres of berm and utilize 38,016 cubic yards of sand material. Town of Kill Devil Hills Emergency FEMA Berm Field Report Page 2 PROJECT SETTING The project area extends from 1527 N. Virginia Dare Trail to 1803 N. Virginia Dare Trail, and then includes a second area from 2407 N. Virginia Dare Trail to 3319 N. Virginia Dare Trail. The properties adjacent to the ocean beach project area are a mixture of residential, commercial and public properties. These areas include 8 Public Beach Access Areas, however, there are no dune-beach walk-over structures in the alignment within these access areas. Vegetation along these beaches is sparse to nonexistent within the project area. Where it exists, a mix is present of American beach grass, sea oats, salt meadow cord grass, and seashore elder. While beach amaranth is known to inhabit shorelines such as Kill Devil Hills, no specimens were observed during the site visits. The beaches in Kill Devil Hills sustained erosion and overwash during Hurricane Isabel, which damaged or destroyed many dwellings and businesses during the event. Many of the remaining structures are threatened and susceptible to additional erosion from winter storms. Dune systems in the project area have been severely damaged or destroyed leaving no protective barrier between the ocean and the adjacent residential structure(s). According to the application, the existing adjacent elevations vary from 2 to 15 feet above mean high water. A few residential cottages are located within the berm alignment. At this time, it is anticipated that the berm will terminate adjacent to these structures and then commence on the other side of the structures. It is not anticipated that the proposed berm alignment will be placed waterward or under these existing dwellings. PROJECT DESCRIPTION FEMA has approved the construction by Town of Kill Devil Hills of an "Emergency Five Year Berm" along a total of approximately 1.2 miles of ocean beach as an eligible cost recovery project to protect vulnerable property. The berm work will be in two locations. One segment will extend from 1527 N. Virginia Dare Trail to 1803 N. Virginia Dare Trail. The second segment will commence at 2407 N. Virginia Dare Trail and extend to 3319 N. Virginia Dare Trail. The berm has been designed for 6 cubic yards of sand material per each linear foot of berm structure. The berm will vary in height between 8 and 12 feet above NGVD. The berm has a width of 51 feet at its base, and will have a 15 foot wide crest area. The seaward slope will be 6 to 1 and will extend 30 feet beyond the `seaward' crest of the berm. The landward slope will be built to a 1.2 to 1 slope and will extend 6 feet landward of the `landward' crest. These constructed berms will align with the adjacent dunes to the north and south at the ends of each segment. The project will result in 7.5 acres of berm and utilize 38,016 cubic yards of sand material. Although this project is being described as one that will not result in any sand being placed waterward of the MHW level, some sand may be pushed from below MHW. Sand will come from existing sand washed over streets, under structures, stockpiled screened sand, and compatible outside sources. Although beach bulldozing from a low tide beach could be utilized, it is anticipated that due to the existing beach width and profile, this source of sand is unlikely to be utilized to any significant degree. Town of Kill Devil Hills Emergency FEMA Berm Field Report Page 3 ANTICIPATED IMPACTS • The filling of 7.5 acres of Ocean Erodible Area would occur if the berm/dune project were approved. • Temporary loss of existing flora and fauna within the projects fill area is anticipated if the project is approved. • Temporary reduction of the population of fauna residing within the intertidal zone, due to land disturbing activities and beach bulldozing, would occur if the project were approved. • Placement of the proposed berm and dune would provide limited enhanced protection from erosion. • Temporary turbidity is anticipated should sand be bulldozed or placed within the near shore and intertidal zone. Representatives from the Federal Emergency Management Agency (FEMA) toured the beach after the storm and proposed a protective beach berm. The proposal included the construction of a sacrificial berm on the dry sand area of the beach to protect property and infrastructure from a "five year" storm as determined by ACOE data. Specifically, the project-consists of approximately +/- 1.2 miles of emergency beach berm construction. The profile, of the berm will be 5' tall with a 15' wide top; and a 3 0' wide fore slope on a 1:6 slope. The profile of the berm has been designed to utilize 6 cubic yards of sand per linear foot. The project is separated into the southern and northern areas. The southern project area consists of approximately +/- 0.5 miles and begins at 1527 North Virginia Dare Trail and continues north until transitio=* g into the existing beach profile just north of the Mariner Motel at 1809 North Virginia Dare Trail. The northern project area consists of approximately +/- 0.7 miles beginning at 2407 North Virginia Dare Trail and continuing to the northern Town of Kill Devil Hills limit at 3319 North Virginia Dare Trail. The constructed beach berm will be positioned to locate the entire section landward of the mean high waterline (1.8' MSL). The project will be field monitored and maybe adjusted based on the topography and profile of the beach at the time of construction.
