Dear Mr. Alger:
You have our approval, in accordance with the attached conditions, to impact 0.09 acres of wetlands or
waters for .the purpose of filling area to provide for adequate setbacks as you described in your
application dated March 10, 2004. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 3402, which may be viewed on our website at
http://h2o.enr.state.nc.us/ncwetlands. This certification allows you to use Nationwide Permit Number
18 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion
Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval
will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the
General Certification.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a
new application. If the property is sold, the new owner must be given a copy of this Certification and
approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as
described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding
Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to
be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed below.

Violations of any condition herein set forth may result in revocation of this Certification and may result

M. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,

No further fill requests will be possible, since the remaining 5667 SF of 404 wetlands will be
placed under a conservation easement to NC EEP.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken. to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The house location and driveway are constrained by the minimum buildin 1! imits set by Dare
County Zoning. Several plans were created to fit the modest 3 bedroom house and amenities on
the lot, but each plan resulted in an area which needed wetland fill to gain adequate setbacks for
the conventional septic system. The attached plan represents the most desirable option for the
house and deck to lie completely on uplands reducing the need for land clearing on the rear
portion of the property.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9. 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this. project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/stringidt.-himi.

Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
A permanent conservation easement to the NC EEP will be placed on the remaining
5667 SF (0.13 ac) of wetlands on the property. This easement will be recorded prior to fill
activities.
2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration
Program (NCWRP) with the NCWRP's written agreement. Check the box indicating that
you would like to pay into the NCWRP. Please note that payment into the NCWRP must be
reviewed and approved before it can be used to satisfy mitigation requirements. Applicants
will be notified early in the review process by the 401/Wetlands Unit if payment into the

The top of the ridge will have to be leveled and graded to make room for the ground floor of the

Attached you will find the Preliminary Site Assessment and Improvement Permit by the County of Dare for
sewage improvements on Lot 51, Swan View Shores, 109 Soundshore Drive, which is the subject of the
application made on behalf of Mr. Daniel Alger, DWQ No. 04-0387. You will note on the attached plat
that allowances have been made for a 100% repair area which will meet the setbacks required by the State
of North Carolina in their sewage improvement regulations. You will also find attached a copy of the letter
that has been forwarded to Ms. Carol Shaw of the North Carolina Ecological Enhancement Program
requesting NCEEP's willingness to accept the conservation easement for the remaining undisturbed 1,366
square feet and 4,301 square feet of wetland areas. We have not received a response from Ms. Shaw but
will provide you with the conservation easement that will be executed on the property as soon as we have
received a provisional authorization from your office. We would expect that this provisional authorization
would allow for the permit to be issued provided that the appropriate documents are executed regarding the
conservation easement.
Please contact my office should you have any questions with regards to this matter. We appreciate your
expeditious response to this request so that Mr. Alger can proceed with the construction at his site.

A representative of the Dare County Health Department made an on-site visit to
the above referenced property. Our comments are indicated below:
IMPROVEMENT PERMIT
1. If an Improvement Permit is desired, a current registered survey is required
showing the property boundaries, proposed location of house or business (drawn
to scale), decks, driveway, parking area and any pertinent landscape feature,
easements or other factor that might effect the location and the function of the
septic disposal system. This permit becomes a non-expiring site approval for the
eventual installation of an on-site wastewater system. The Improvement Permit
shall not be effected by transfer of the property or change in ownership, provided
all of the specific conditions are met.
A. This permit does not relieve you of any other State, Federal or Local Permit
that may be needed.
WASTEWATER SYSTEM AUTHORIZATION PERMIT
11.1f an Authorization for Wastewater System Construction (C.A.) is desired, any
required site/fill work must be completed and approved by this department, Two
(2) sets of house plans must be submitted. If the property is located in an area
served by the Dare County Water System, proof of public water by a paid receipt
must be submitted. Finally, a copy of your improvement Permit must be
submitted.
A. This permit does not relieve you of the responsibility to obtain any other
State, Federal or Local Permits.

RECOMMENDATIONS:
The above referenced lot was evaluated and found to be provisionally suitable for
a septic system.
The following requirements must be met before a permit can be issued:
1. We will need a survey showing any wetlands and the house location so
the septic system area can be designated. The system must be located
50' from any wetlands.
2. Because of the lots topography, the septic area will need to be leveled
and rechecked.
3. A 100% repair area will be required.
4. We will need to review and approve your house plans.
5. We will need verification form the Dare County Water Department that the
water tap has been purchased.

your plan to fill wetlands or waters for the purpose of filling the area for adequate setbacks in Dare County.
Approval from DWQ is required to disturb these areas. Please provide 7 copies of the following information and
refer to the DWQ # listed above in your reply. Please show these on maps of suitable scale (for instance 1" = 100
feet) so we can begin to determine your projects' compliance with 15A NCAC 2H .0500.
1. Please provide a letter from the Ecou)g sa1,Enhancement Program stating that they are willing to
accept the conservation easement.
2. Please provide a letter from the Dare County Heath Department stating that they are willing to
approve the septic permit based on the proposed filling of wetlands to provide the required setbacks.
