+ 24) The construction and/or operation of the authorized facilities shall not directly result in any closure of
any waters that are open to the taking of shellfish. Any such closure directly attributable to the

remedial actions to remedy the situation.. Such actions include, but are not limited to, a removal of any x
unauthorized slips or mitigative measures to reduce or eliminate the cause(s) of the closure.

25) It is possible that the authorized structure may be damaged by wavewash from passing vessels. The
issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity
of the permitted structure and the safety of moored boats. The permittee will not hold the State of North V
Carolina nor the United States liable for any such damage.

NOTE: The permittee is advised that should the total number of boat slips originating from the Cedar
Point Subdivision exceed ten (10) slips, a closure of shellfish waters may be required, which
would violate State water quality standards.

26) In accordance with the requirements of the U.S. Army Corp of Engineers, in developing the property,
the 3,543 square feet of enhancement mitigation area, shall be maintained in their natural or mitigated
- condition as stated in the deed restriction (other than permitted filled area). No person or entity shall fill ,
grade, excavate, or perform any other land disturbing activities; nor construct any structures, nor allow
a
animal grazing or watering or any agricultural us on such conservation area.
27) In accordance with the requirements of the U. S. Army Corp of Engineers, the deed restriction for the
enhanced mitigated area, should follow the enclosed example labeled "Provisions Relating To
Wetlands", detailing property control on further wetland disturbance, must be executed and recorded
with Pender County Register of Deeds prior to the selling or developing the property. This record must
include the COE's verified wetland survey depicting the location of all waters and wetlands within the
t boundary of the lots. The permittee shall provide the COE and DCM with a copy of the recorded plat as
soon as possible. For more information, please refer to the "Provisions Relating to Wetlands" located on
page 6 of 7. .;

Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina" must be
followed.

28405.
Water Quality and Stormwater
The Division of Water Quality's approval of this project under stormwater management rules of the
Environmental Management Commission is covered by way of Stormwater Permit No. SW8030526,
which was issued on 10/03/03. Any violation of the permit approved by the DWQ will be considered a
violation of this CAMA permit.

Provisions Relating to Wetlands
1 35) "All of the Properties subject to these Declarations, Conditions, Covenants and Restrictions shall also be
subject to the following Special Provisions Relating to Wetlands. In developing the property, the
$ Declarant has agreed with the State of North Carolina and the Department of the Army Corps of
Engineers (pursuant to a
permit issued by the State of North Carolina and the Corps of Engineers) to
restrict and prohibit any future filling or other detrimental activities in the wetland areas which presently
exist within the identified area of the property. Accordingly, all wetlands shown and delineated on the
wetland survey plat dated 4/1/2003, as depicted and verified by the Corps of Engineers on 4/29/2003,
shall be maintained in perpetuity in their natural or mitigated condition (other than the permitted
wetlands filled for the road crossing). No person or entity shall fill, grade, excavate, or perform any
other land disturbing activities; nor cut, remove, or harm any vegetation; nor construct any structures,
nor allow animal grazing or watering or any other agricultural use on such conservation area. Benign
structures, such as pile-supported walkways, may be permissible only after reviewed and written consent
1 is provided by the U.S. Army Corps of Engineers. This covenant is intended to ensure continued i
x compliance with the mitigation condition of authorizations issued by the United States of America, U.S.
Army Corps of Engineers, Wilmington District, Action ID 200300697, and therefore may be enforced
by the United States of America. This covenant is to run with the land, and shall be binding on the
Owner, and all parties claiming under it." The above paragraph (number) cannot be amended or modified without the express written consent of x
the U.S. Army Corps of Engineers, Wilmington District.

36) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause r

unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon F
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions s
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be {
made against the United States or the state of North Carolina on account of an y such removal or a

37) In issuing this permit, the State of North Carolina and/or the Federal Government does not assume
liability for:
a.) Damages to the permitted project or uses thereof as a result of other permitted or unpermitted
activities or from natural causes.
b.) Damages to the permitted project or uses thereof as a result of current or future Federal activities
initiated on behalf of the general public.

of the mean high water (MHW) elevation contour and any regularly or irregularly flooded vegetated
wetlands.

is located in the R-5 zoning district. As such, only single duplex units are allowed on lots 19 and
t 20. No condominiums will be allowed on lots 19 and 20.

CAMA EXPRESS Permit Application Amendment
The subject field investigation report was circulated on February 19, 2004. During initial review of the
application, several review agencies discovered discrepancies pertaining to information reported on the applicant's
permit application and work plat drawings that were originally submitted on February 3, 2004. As such, the
applicant was notified and was informed that the application and the work plat drawings would need to revised. The
permit application was prepared for the Cedar Point Subdivision property located off South Shore Drive (NC 50),
adjacent to Banks Channel and Topsail Sound, in Surf City, Pender County. At the request of the applicant, the
permit application was routed under the EXPRESS permitting program. The appropriate changes to the work plat
drawings and permit application have been documented and are attached for your review. The twenty-one (21) day
commenting period for the review agencies will expire on March 24, 2004.
Please disregard the previously submitted application package circulated on February 19, 2004. The new permit
application, revised on March 2, 2004, should be used for commenting purposes.

8. PROJECT SUMMARY: The applicant is proposing the construction of an 18 lot subdivision with
maintenance dredging within an existing canal and connecting chan nel. The applicant has also proposed the
construction of multiple docking facilities, bulkhead, rip-rap, boat ramp and piers for the potential lot owners.
9. PROJECT DESCRIPTION: The proposed Cedar Point Subdivision is located offNC Hwy 50 (South Shore
Drive) in the town of Surf City in Pender County. The project is located adjacent to Topsail Sound and Banks
Channel. To get to the proposed subdivision from Wilmington, head north on US Hwy 17. At the intersection
of US Hwy 17 and NC Hwy 210, turn right onto NC Hwy 210 towards Surf City. Cross the AIWW in Surf
City and turn right at the stoplight onto NC Hwy 50. Travel approximately 2.9 miles south and the property
will be located on the right hand side of the road. The site is located just past the existing Maritime Plantation
Subdivision and just before the Channel Bend Subdivision. The property extends from NC Hwy 50,
approximately 1,300' to Topsail Sound. The property is approximately 230' wide, as measured along NC Hwy
50. The Ocean Hazard Area of Environmental Concern (AEC) (a distance of 255' landward of the first line of
stable natural vegetation on the ocean front in the area of the project) extends onto the property approximately
95' and encompasses the majority of Lots 1-4.
Existing development on the property includes an existing man-made canal. The property has some
topographic relief for this area. The tract has an approximate elevation of 4 feet above MSL. The property
consists of approximately 5.26 acres with a variety of vegetation covering the tract. The highground portion of
the tract (going from NC Hwy 50 towards the sound) has vegetation that consists of Live Oaks (Quercus
virginiana), Red Bays (Persea borbonia), Carolina Laurel Cherry (Proms caroliniana), Catbriar (Smilax sp.),
grape vines (Vitis sp.), Red Cedar (Juniperus virginiana) Wax myrtles (Myrica cerifera), Yaupon (Ilex
vomitoria) and Beauty Berry (Callicarpa americana). From the highground adjacent to NC Hwy 50, the
property gently slopes down into "404 type" vegetation (see wetland delineation signed by the U.S. Army
Corps of Engineers USACE) and coastal wetlands. The property extends out as a peninsula and is bisected by
a man-made canal that extends into the property for a distance of approximately 800 feet. The canal averages
approximately 60 feet in width, measured from the normal high water line. The north side of the peninsula
adjacent to the canal is dominated by "404" wetlands, as shown on the USACE delineation map. On the
southern portion of the peninsula, the property consists of an upland finger that extends into the peninsula
surrounded by a section of "404" wetlands and coastal marsh. Vegetation in the "404" type wetland areas
consists primarily of. Southern Wax Myrtles (Myrica cerifera), Yaupon (Ilex vomitoria), Red Bay (Persea
borbonia), Red Cedars (Juniperus virginiana), Dog Fennel (Eupatorium capillifoliuml briars (Rubus sp.),
Catbriar (Smilaxsp.), Poison Ivy (Rhos radicans), grape vines (Vitis sp.) and Seashore Mallows (Kosteletskya
virginica). The coastal marsh varies in width along the shoreline. Adjacent to the canal there are small fringes
of coastal marsh consisting of Smooth Cordgrass Marsh (Spartina alterniflora) along with a few live oaks
(Quercus virginiana) leaning over the canal. Along the peninsula and towards the southern portion of the
property, the coastal marsh varies from approximately 5 feet to approximately 75 feet in width. Vegetation in
this area consists primarily of Spartina alterniflora. The marsh then grades up to include such species such as
Salt Grass (Distichlis spicata), interspersed with Sea Lavender (Limoium carolinanum), Salt Meadow Hay
(Spartina patens), Sea Ox-eye (Borrichia frutescens). Landward of this, the vegetation consists of Marsh elder
(Ivafrutescens) and Myrtles.
The manmade canal that bisects the property extends off of Banks Channel in the area known as "Channel
Bend". Inspection of aerial photography indicates that the connecting channel to the Federally maintained
Banks Channel, was dredged prior to 1978. In addition to serving the manmade canal at the applicant's site,
the channel continues past the applicant's property and serves the subdivisions to the north including: Maritime
Forrest, Pirates Cove, Pleasant Cove, Island Oaks and ultimately Sandy Ridge. The applicant's canal is one of
;? a series of four (4) canals that is located off of the main connecting channel.

The waters of the Topsail Sound and Banks Channel, adjacent to the proposed project area, are classified "SA"
by the Division of Water Quality. This section of Topsail Sound is NOT designated as a Primary Nursery
Area by the Division of Marine Fisheries. According to maps provided by Shellfish Sanitation, the area is
OPEN to the harvesting of shellfish.
PROPOSED PROJECT: The applicant is proposing to develop the 5.26 acre tract into an 18-lot subdivision.
The applicant is proposing the installation of a driveway/access road that would begin at the entrance of the
property, along NC Hwy 50. The driveway would continue straight through the center of the property and dog-
leg to the east just beyond Lot 9. The access road would then follow the eastern property line and terminate in a
"hammer-head" cul-de-sac located on Lot 17. A private entrance for Lots 18, 19 and 20 would extend
northward from the end of the cul-de-sac. As proposed, a portion of the "hammer-head" cul-de-sac would be
located in "404" Wetlands. Impacts to this area, and mitigation for the disturbance, are discussed in the
Anticipated Impacts.
The applicant is also proposing to perform maintenance dredging in the existing canal and access channel to
adequately access the boat ramp area and for adequate water depth for proposed piers. The applicant proposes
to use a bucket and barge to complete maintenance excavation of a 450' X 30' stretch within the existing canal,
as well as dredging a 20' wide by 400' long by -5' (MLW) deep channel to maintain the existing access
channel into the canal. The applicant is requesting a final project depth of -5 feet at normal low water (NLW)
or the existing depth of the connecting channel. The project would generate approximately 1,700 cubic yards
of spoil material. The spoil disposal area would be located adjacent to the south side of the canal area, where,
once dried, it will be used to fill the area behind the proposed bulkhead. The dimensions of the disposal area
are to be 850' x 60'. The applicant is also proposing to construct 2,000 linear feet of bulkhead landward ofthe
coastal marsh within the canal, and install approximately 1,400 linear foot of rip-rap water ward of the coastal
wetlands. The width of the rip-rap would average 5' offshore from NHW and in no case would the rip-rap
extend further than 10' offshore of the coastal wetlands. The applicant is also proposing to construct a 40' X
12' boat ramp with a 34' X 4' handling pier, install 5 piers (20' x 4') within the canal. One of the five (5) piers
would have a 20' X 6' T-head platform. In addition, the applicant is proposing to build a 4-slip pier into
Banks Channel from the northwestern tip of the peninsula. The pier would measure 100' long X 6' wide. The
water ward end of the pier would include a 20'X 20' covered platform with two 4' X 15' floating docks, one
on each side of the platform and two 4' X 15' floating docks off the landward side of the,platform, adjacent to
the pier. Water depths at the entrance to the canal from the main channel run from -1.0' to -5.0' at NLW.
Water depths within the existing man made canal average -3.0' to -11.0' at NLW. Water depths in the area
surrounding the proposed pier extending into Banks Channel average -2.0' to -1.0' at NLW.
10. ANTICIPATED IMPACTS
The proposed canal and channel maintenance dredging would impact approximately 13,500 sq ft of previously
dredged shallow bottom area within the man-made canal and approximately 8,000 sq. ft of shallow bottom area
outside of the canal. The construction of the boat ramp will impact approximately 99 square feet of "404"
wetlands. The construction of the proposed access road into the subdivision and driveway access to lots 18-20,
and the grading of the property for lot preparation, would result in the disturbance of approximately 1.7 acres
of high ground and the filling of 1,543 sq. ft. of "404" wetlands. A 3,575 sq. ft. area of disturbed "404" type
wetlands adjacent to the "hammer-head" cul-de-sac would be graded and mitigated to support the growth of
coastal wetlands, specifically, Spartina alterniora. The mitigated vegetation would be sprigged throughout
the area on approximately 6" centers as mitigation for the loss of approximately 1,543 sq. ft. of "404"
wetlands. The proposed bulkhead and tie-back installation would impact an additional 30,000 sq ft of high
ground. The disposal area for the dredging would impact approximately 50,000 sq ft of high ground, and the
proposed rip-rap within the canal would impact approximately 14,000 sq ft of shallow bottom area. Some of
the areas of disturbance for bulkhead construction and grading and lot preparation would overlap. The
proposed piers within the canal would incorporate approximately 656 sq ft of estuarine waters and public trust
area. The proposed pier and four (4) slip docking system extending into Banks Channel would incorporate an
additional 1,240 sq. ft. of estuarine waters and public trust area.

revisions to the above-cited application as follows:
1. A plan view (Sheet 1) is now included showing the entire project and all of the proposed
work On that sheet,'the limits of all high ground disturbance is shown as well as all of the
various jurisdiction lines (404, Coastal Marsh, mean high water, and coastal buffer). As
requested in our 2126 meeting, I am also providing (i) a separate plan view (Sheet 2) at a
larger scale of the water related work area showing the mean high water, location of the rip-
rap, and the location of the bulkhead; and (ii) a separate plan view (Sheet 3) showing the
canal and access channel dredging and the piers.
2. 26 copies of Sheets 1, 2, and 3 are provided.
3. The proposed mitigation area is a sparsely vegetated highly disturbed wetland that likely
became jurisdictional when small trees were uprooted by recent hurricanes. The soils are
poorly established fill material cast onto the area when the existing canal was dug. It is
proposed that the area shown be graded to an elevation that would support the vitality of
Dwarf Spattina Alterniflora resulting in a 2±11 enhancement of this area to a productive
wetland which it would likely never be if left alone. This idea came out of discussion with the
Corps of Engineers who agreed that this proposed enhancement would be satisfactory.

6. The previous line in question was removed.

8. PROJECT SUMMARY: The applicant is proposing the construction of an 18 lot subdivision with
maintenance dredging within an existing canal and connecting channel. The applicant has also. proposed the
construction of multiple docking facilities, bulkhead, rip-rap, boat ramp and piers for the potential lot owners.
9. PROJECT DESCRIPTION: The proposed Cedar Point Subdivision is located offNC Hwy 50 (South Shore
Drive) in the town of Surf City in Pender County. The project is located adjacent to Topsail Sound and Banks
Channel. To get to the proposed subdivision from Wilmington, head north on US Hwy 17. At the intersection
of US Hwy 17 and NC Hwy 210, turn right onto NC Hwy 210 towards Surf City. Cross the AIWW in Surf
City and turn right at the stoplight onto NC Hwy 50. Travel approximately 2.9 miles south and the property
will be located on the right hand side of the road. The site is located just past the existing Maritime Plantation
Subdivision and just before the Channel Bend Subdivision. The property extends from NC Hwy 50,
approximately 1,300' to Topsail Sound. The propertyis approximately 230' wide, as measured along NC Hwy
50. The Ocean Hazard Area of Environmental Concern (AEC) (a distance of 255' landward of the first line of
stable natural vegetation on the ocean front in the area of the project) extends onto the property approximately
95' and encompasses the majority of Lots 1-4.
Existing development on the property includes an existing man-made canal. The property has some
topographic relief for this area. The tract has an approximate elevation of 4 feet above MSL. The property
consists of approximately 5.26 acres with a variety of vegetation covering the tract. The highground portion of
the tract (going from NC Hwy 50 towards the sound) has vegetation that consists of. Live Oaks (Quercus
virginiana), Red Bays (Persea borbonia), Carolina Laurel Cherry (Primus caroliniana), Catbriar (Smilax sp.),
grape vines (Vitis sp.), Red Cedar (Juniperus virginiana) Wax myrtles (Myrica cerifera), Yaupon (Ilex
vomitoria) and Beauty Berry (Callicarpa americana). From the highground adjacent to NC Hwy 50, the
property gently slopes down into "404 type" vegetation (see wetland delineation signed by the U.S. Army
Corps of Engineers USACE) and coastal wetlands. The property extends out as a peninsula and is bisected by
a man-made canal that extends into the property for a distance of approximately 800 feet. The canal averages
approximately 60 feet in width, measured from the normal high water line. The north side of the peninsula
adjacent to the canal is dominated by "404" wetlands, as shown on the USACE delineation map. On the
southern portion of the peninsula, the property consists of an upland finger that extends into the peninsula
surrounded by a section of "404" wetlands and coastal marsh. Vegetation in the "404" type wetland areas
consists primarily of. Southern Wax Myrtles (Myrica cerifera), Yaupon (Ilex vomitoria), Red Bay (Persea
borbonia), Red Cedars (Juniperus virginiana), Dog Fennel (Eupatorium capillifoliuml briars (Rubus sp.),
Catbriar (Smilax sp.), Poison Ivy.(Rhus radicans), grape vines (Vitis sp.) and Seashore Mallows (Kosteletskya
virginica). The coastal marsh varies in width along the shoreline. Adjacent to the canal there are small fringes
of coastal marsh consisting of Smooth Cordgrass Marsh (Spartina alterniora) along with a few live oaks
(Quercus virginiana) leaning over the canal. Along the peninsula and towards the southern portion of the
property, the coastal marsh varies from approximately 5 feet to approximately 75 feet in width. Vegetation in
this area consists primarily of Spartinaalterniora. The marsh then grades up to include such species such as
Salt Grass (Distichlis spicata), interspersed with Sea Lavender (Limoium carolinanum), Salt Meadow Hay
(Spartinapatens), Sea Ox-eye (Borrichiafrutescens). Landward of this, the vegetation consists of Marsh elder
(Iva frutescens) and Myrtles.._
The manmade canal that bisects the property extends off of Banks Channel in the area known as "Channel
Bend". Inspection of aerial photography indicates that the connecting channel to the Federally maintained
Banks Channel, was dredged prior to 1978. In addition to serving the manmade canal at the applicant's site,
the channel continues past the applicant's property and serves the subdivisions to the north including: Maritime
Forrest, Pirates Cove, Pleasant Cove, Island Oaks and ultimately Sandy Ridge. The applicant's canal is one of
a series of four (4) canals that is located off of the main connecting channel.

The waters of the Topsail Sound and Banks Channel, adjacent to the proposed project area, are classified "SA"
by the Division of Water Quality. This section of Topsail Sound is NOT designated as a Primary Nursery
Area by the Division of Marine Fisheries. According to maps provided by Shellfish Sanitation, the area is
OPEN to the harvesting of shellfish.
PROPOSED PROJECT: The applicant is proposing to develop the 5.26 acre tract into an 18-lot subdivision.
The applicant is proposing the installation of a driveway/access road that would begin at the entrance of the
property, along NC Hwy 50. The driveway would continue straight through the center of the property and dog-
leg to the east just beyond Lot 9. The access road would then follow the eastern property line and terminate in a
"hammer-head" cul-de-sac located on Lot 17. A private entrance for Lots 18, 19 and 20 would extend
northward from the end of the cul-de-sac. As proposed, a portion of the "hammer-head" cul-de-sac would be
located in "404" Wetlands. Impacts to this area, and mitigation for the disturbance, are discussed in the
Anticipated Impacts.
The applicant is also proposing to perform maintenance dredging in the existing canal and access channel to
adequately access the boat ramp area and for adequate water depth for proposed piers. The applicant proposes
to use a bucket and barge to complete maintenance excavation of a 450' X 30' stretch within the existing canal,
as well as dredging a 20' wide by 400' long by -5' (MLW) deep channel to maintain the existing access
channel into the canal. The applicant is requesting a final project depth of -5 feet at normal low water (NLW)
or the existing depth of the connecting channel. The project would generate approximately 1,700 cubic.yards
of spoil material. The spoil disposal area would be located adjacent to the south side of the canal area, where,
once dried, it will be used to fill the area behind the proposed bulkhead. The dimensions of the disposal area
are to be 850' x 60'. The applicant is also proposing to construct 2,000 linear feet of bulkhead landward of the
coastal marsh within the canal, and install approximately 1,400 linear foot of rip-rap water ward of the coastal
wetlands. The width of the rip-rap would average 5' offshore from NHW and in no case would the rip-rap
extend further than 10' offshore of the coastal wetlands. The applicant is also proposing to construct a 40' X
12' boat ramp with a 34' X 4' handling pier, install 5 piers (20' x 4') within the canal. One of the five (5) piers
would have a 20' X 6' T-head platform. In addition, the applicant is proposing to build a 4-slip pier into
Banks Channel from the northwestern tip of the peninsula. The pier would measure 100' long X 6' wide. The
water ward end of the pier would include a 20'X 20' covered platform with two 4' X 15' floating docks, one
on each side of the platform and two 4' X 15' floating docks offthe landward side of the platform, adjacent to
the pier. Water depths at the entrance to the canal from the main channel run from -1.0' to -5.0' at NLW.
Water depths within the existing man made canal average -3.0' to --4.0' at NLW. Water depths in the area
surrounding the proposed pier extending into Banks Channel average -2.0' to -4.0' at NLW.
10. ANTICIPATED EWPACTS
The proposed canal and channel maintenance dredging would impact approximately 13,500 sq ft of previously
dredged shallow bottom area within the man-made canal and approximately 8,000 sq. ft of shallow bottom area
outside of the canal. The construction of the proposed access road into the subdivision and driveway access to
lots 18-20, and the grading of the property for lot preparation, would result in the disturbance of approximately
1.7 acres of high ground and the filling of 1,543, sq. ft. of "404" wetlands. A 3,575 sq. ft. area of disturbed
"404" type wetlands adjacent to the "hammer-head" cul-de-sac would be graded and mitigated to support the
growth of coastal wetlands, specifically, Spartina alterniora. The mitigated vegetation would ge sprigged
throughout the area on approximately 6" centers as mitigation for the loss of approximately 1,543 sq. ft. of
"404" wetlands. The proposed bulkhead and tie-back installation would impact an additional 30,000 sq ft of
high ground. The disposal area for the dredging would impact approximately 50,000 sq ft of high ground, and
the proposed rip-rap within the canal would impact approximately 14,000 sq ft of shallow bottom area. Some
of the areas of disturbance for bulkhead construction and grading and lot preparation would overlap. The
proposed piers within the canal would incorporate approximately 656 sq ft of estuarine waters and public trust
area. The proposed pier and four (4) slip docking system extending into Banks Channel would incorporate an
additional 1,240 sq. ft. of estuarine waters and public trust area.

This notice is intended to make you, the applicant, aware
of the special risks and conditions associated with
development in this area, which is subject to natural
hazards such as storms, erosion and currents. The rules of
the Coastal Resources Commission require that you
receive an AEC Hazard Notice and acknowledge that
notice in writing before a permit for development can be
issued.
The Commission's rules onbuilding standards, oceanfront
setbacks and dune alteration are designed to minimize,but
not eliminate, property loss from hazards. By granting
permits, the Coastal Resources Commission does not
guarantee the safety of the development and assumes no
liability for future damage to the development.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual ocean
ere:ton rate for the area where your property is located is
feet per year.
The rate was established by careful analysis of aerial
photographs of the coastline taken over the past 50 years.
Studies icate that the shoreline could move as
much aset landward in a major storm.
The flood waters in a major storm are predicted to be about
feet deep in this area.
Preferred oceanfront protection measures are beach
nourishment and relocation of threatened structures.
Hard erosion control structures such as bulkheads,
seawalls, revetments, groins, jetties and breakwaters are
prohibited. Temporary devices, including sand bags, may
be allowed under certain conditions.
This structure shall be relocated or dismantled within two
years of becoming imminently threatened.
The applicant must acknowledge this information and
requirements by signing this notice in the below space.
Without the proper signature, the application will not be
complete.

SPECIAL NOTE: This hazard notice is required for
development in areas subject to sudden and massive
storms and erosion. Permits issued for development in this
area expire on December 31 of the third year following the
year in which the permit was issued. Shortly before work
begins on the project site, the Local Permit Officer will
determine the vegetation line and setback distance at your
site. If the property has seen little change and the proposed
development can still meet the setback requirement, the
LPO will inform you that you may begin work. It is impor-
tant that you check with the LPO before the permit expires
for official approval to continue the work after the permit
has expired. Generally, if foundation pilings have been
placed and substantial progress is continuing, permit
renewal may not be necessary. If substantial progress has
not been made, the permit must be renewed and a new
setback line established. It is unlawful to continue work
after permit expiration without this approval.

You have our approval, in accordance with the attached conditions (WQC # 3400) to conduct the
following activity adjacent to your property located off South Shore Drive (NC 50) in Surf City in Pender
County. This approval allows you to:
1. Using the clam bucket to barge method for maintenance excavation of 450' X 20'section in the
existing canal and a 20' X 400' area to maintain the existing access channel to -5' (MLW) for a
total of 17,000 sq ft. of dredging impacts;
2. Construct 2,000 linear feet of bulkhead landward of all 404 and coastal wetlands (except where
permitted to fill 404 wetlands);
3. Construct a 40' X 12' boat ramp (fill 99 sq ft of 404 wetlands) with a 34' X 4' handling pier;
4. Construct 5 (20' X 4') piers within the canal with one pier having a 20' X 6' T-head platform. To
construct a 4-slip pier (100' X 6') into Banks Channel on the northwestern tip of the peninsula with
a 20' X 20' covered gazebo and four (4) 4' X 15' floating docks;
5. Fill 1,543 sq ft of 404 wetlands for a hammerhead cul-de-sac;
6. 3,575 sq ft of 404 wetlands are to be "enhanced" as 404 type wetlands by sprigging area with
indigenous 404 wetland species.
This approval is only valid for the purpose and design that you described in your completed CAMA
application received by the Division of Water Quality (DWQ) on March 19, 2004. After reviewing
your application, we have determined that General Water Quality Certification Number 3400 covers

Permit when the NC Division of Coastal Management issues it. Keep in mind that there may be
additional Federal, State or Local regulations applicable to your project, such as (but not limited to)
Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations and Coastal
Stormwater. In addition, this approval will expire when the accompanying CAMA Permit expires
unless otherwise specified in the General Certification
This approval is only valid for the purpose and design that you described in your completed 401
Express Permit application received by the Division of Water Quality on March 19, 2004. If you change
or modify your project, you must notify the Division (DWQ) in writing and you may be required to send
us a new application for a new certification. If the property is sold, the new owner must be given a copy
of the Certification and approval letter and is thereby responsible for complying with all conditions. If
total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may
be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow
the conditions listed in the attached certification and the additional conditions listed below:
1. Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to this office and a copy to the 401/Wetlands Unit, North Carolina Division
of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650;
2. No excavation and no waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or
riparian areas beyond the footprint of the impacts depicted in the CAMA Major Application.
All construction activities, including the design, installation, operation, and maintenance of
sediment and erosion control Best Management Practices (turbidity curtains as necessary),
shall be performed so that no violations of state water quality standards, statutes, or rules
occur.
Please notify this Office at the number listed below if any problem arises during the
construction of the project that may affect water quality.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and
its conditions are final and binding unless you ask for a hearing.

Thank you and Noelle Lutheran for meeting with me this morning to go over our request for a 401
Certification for the above cited project. At your request, I have made the following revisions:
1. The request for riprap. along the canal shoreline has been eliminated. Sheets 2 and 5 of the
drawings have been revised accordingly.
2. Sheet 2 has also been revised to illustrate more clearly that the proposed bulkhead will be
located upland of both the coastal wetland line and the 404 line.
3. The proposal to convert a freshwater 404 area to tidal wetlands has been eliminated.
Mitigation in the form of enhancement of the area detailed on sheet 4 will be accomplished by
planting and sprigging the area with native species.

Construct an 18-lot subdivision with water access to an existing canal and to Topsail Sound. Project will _
involve maintenance excavation of an existing canal and channel to a depth of - 5.0' mlw utilizing either a _
trackhoe or dragline. The excavated material will be placed behind a bulkhead constructed prior to the
excavation. Access piers and a boat ramp are proposed within the existing canal. 0.04 acres (1642 SgFt) of
404 freshwater wetlands are proposed to be filled in connjunction with the construction of the subdivision -
access road (1543 SgFt) and the boat ramp (99 SgFt). RipRap is proposed to be placed along the canal

VII. Impact Justification (Avoidance and Minimization)

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
htta://h2o.enr.state.nc.us/ncwetlands/strmgide.html.
Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
