Reference the application of Seaside Developers' for a Department of the Army permit to
construct two piers at Seaside Village Subdivision, adjacent to the Atlantic Intracoastal
Waterway, just east of 9t' Street, on Highway 210, just north of Surf City, Onslow County, North
Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.

3. Except as specified in the plans attached to this permit, no excavation, fill or
mechanized land-clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
4. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land-clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. . This permit does
not authorize temporary placement or double handling of excavated or fill material within waters
or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
5. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Quality at (919) 733-5083,
Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
6. The authorized structure and associated activity must not interfere with the public's
right to free navigation on all navigable waters of the United States. No attempt will be made by
the permittee to prevent the full and free use by the public of all navigable waters at or adjacent
to the authorized work for reason other than safety.
7. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U. S. Coast Guard, through regulations or otherwise, on authorized facilities.
For further information, the permittee should contact the U.S. Coast Guard Marine Safety Office
at (910) 772-2191.
8. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work, he will immediately notify the Wilmington District
Engineer who will initiate the required coordination procedures.
9. The Permittee will maintain the authorized work in good condition and in
conformance with the terms and conditions of this permit. The Permittee is not relieved of this
requirement if he abandons the permitted activity without having it transferred to a third parry.
10. Approval of the structure was based on determinations that there would be no
obstruction to navigation. The structure may be damaged by wave wash from passing vessels.
Issuance of this permit should not be construed, as relieving the permittee of taking proper steps
to insure the structure and moored boats will not be damaged by wave wash.
11. The permittee shall advise the Corps in writing at least two weeks prior to beginning
the work authorized by this permit and again upon completion of the work authorized by this
permit.

12. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
13. The permittee shall employ all sedimentation and erosion control measures necessary
to prevent an increase in sedimentation or turbidity within waters and wetlands outside the
permit area. This shall include, but is not limited to, the immediate installation of silt fencing or
similar appropriate devices around all areas subject to soil disturbance or the movement of
earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must
remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973
(North Carolina General Statutes Chapter 113A Article 4).
14. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction-related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant. -
15. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will, without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct,
restore the water or wetland to its pre-project condition.
16. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.
17. The West Indian manatee (Trichechus manatus), which is listed as a federally
endangered species, has been reported in the waters in Onslow County. In order to protect the
West Indian manatee all work should be done during the period from November 1 to May 31. If
work must be done during the period from June through October the enclosed guidelines,
entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian
Manatee in North Carolina" must be followed.

9. PROJECT DESCRIPTION
Charles F. Riggs and Associates, Inc., on behalf of Seaside Developers, LLC, has requested that the attached application be
processed under the Express Permit Review Pilot Program.
The applicant's project is located along N.C. State Highway 210, just north of 9' street, approximately 0.2 miles north of
the Town line of Surf City and North Topsail Beach, adjacent to Stump Sound, in North Topsail Beach, Onslow County. To
find the property, take Highway 17 North from Wilmington and turn right on N.C. State Highway 50 (approximately 30
miles from Wilmington). Head east on Hwy 50 and turn left onto Hwy 210 at the intersection of Hwy 210 and Hwy 50. The
property is located on the western side of Hwy 210, approximately 2.6 miles from the intersection of Hwy 210 and Hwy
50. Scotch Bonnet Enterprises, Inc. borders the property to the south and Sound Side Park Developers borders the tract to
the north.
Seaside village is a 2.90 acre portion of a 22.621 acre tract that is dominated by both coastal wetlands and "404" type
wetlands. The applicant has submitted a subdivision plat to develop the high ground portion of the tract (approximately 2.9
acres) located between Highway 210 and the AIWW, adjacent to Stump Sound. The high ground portion of the tract is
mostly cleared of vegetation and is relatively flat with an elevation of 5.0' above Normal Low Water (NLW). Several
small stands of Southern Wax Myrtle (Merica cerifera), Yaupon (Ilex vomitm ia), and Red Cedar (Juniperus virginiana)
exist on water ward side of the site, bordering the AIWW. There is an existing dirt road located on the southern side of the
tract, that enters the property from the east and continues across the high ground section approximately 3400 feet towards
the AIWW. The property also contains three (3) single-family residences, which are currently being constructed. The
existing dwellings were individually permitted through the Town of North-Topsail Beach under CAMA Minor Permits.
The 2.9 acre tract has approximately 292 linear feet of shoreline along Stump Sound. As previously mentioned, vegetation
along the high ground portion of the tract consists primarily of Southern Wax Myrtle (Merica cerifera), Yaupon (Ilex
vomitoria), and Red Cedar (Juniperus virginiana). The high ground vegetation is bordered by transitional species including
Sea Oxeye (Borrichia frutescens) and Grounsel-bush (Baccharus halimifolia). High coastal marsh vegetation, including,
Black Needle Rush (Juncus roemarianus), Spike Grass (Distichlis spicata), Sea Lavender (Limonium, spp.), and Salt
Meadow Grass (Spartina patens) complete the transition to the waters edge where Smooth Cordgrass Marsh (Spartina
alterniflora) is the predominant species. The shoreline in this areas is not bulk-headed. The proposed development
averages approximately 105 feet landward of mean high water (MHW), along the western edge of the property.
The waters of the AIWW adjacent to the project are classified as SA by the North Carolina Division of Water Quality. They
are designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are CLOSED to the
harvest of shellfish. The subject property is located within the High Hazard Flood Area, as indicated by Zone VE (elevation
16) on the Flood Insurance Rate Map. The High Hazard Flood Area (VE Zone) associated with the subject property is
contiguous to the Atlantic Ocean.
PROPOSED PROJECT
The applicant proposes to develop a 121ot subdivision. Development would include grading and filling, approximately 2.4
acres of the property, for road construction and lot preparation. Individual lots sizes would average 8,031 square feet - a
density of 4.14 units/acre. Access to the lots will be provided by the construction of a single road (Seaside Lane). The
road would provide the subdivision with one entrance and exit from Highway 210. The asphalt road would circle the
common area containing the pool and pool house. Seaside Lane would consist of a 24 foot right-of-way and a 12 foot paved
asphalt surface with an ABC stone sub-base. The road would be constructed with curb and gutter, utilizing curb breaks and
vegetated swales to control stormwater. The applicant has submitted an Express Low Density Stormwater Permit to the
North Carolina Division of Water Quality. The Express Stormwater permit application was received on

2/20/2004. Municipal water would be provided to the subdivision by Onslow County Water. Sewer service would be
provided by North Topsail Utilities, Inc. under sewer permit # WQ0021522.
Within the center of the subdivision, the applicant is proposing to construct a community swimming pool (approximately
18' x 31'), including a 12' x 21'pool house with restrooms. The pool facility would be located within a 0.597 acre
open space surrounded by lots 1-12. The proposed bathhouse (including eaves) and side walks, within the common area,
would total approximately 3389 sq. ft. As proposed, no portion of the subdivision, including but not limited to the
dwellings, eaves, access roads, driveways, streets and/or sidewalks will impact any portion of coastal wetlands or "404"
type wetlands.
10. ANTICIPATED IMPACTS:
The initial grading of the property would result in the disturbance of approximately 2.4 acres of high ground. The proposed
dwellings, street, pool and pool house, walkways and drives would result in the creation of approximately 31,811 square
feet of impervious surface. Total impervious surface coverage within the 75' Estuarine Shoreline AEC would be 0.0%.
The applicant has applied for an Express State Stormwater Permit with the Division of Water Quality, however a State
Stormwater Number has not yet been issued. The applicant anticipates that once issued under the low-density (25 %) option,
the Stormwater Permit would restrict the total maximum built-upon area of the subdivision to 31,811 sq. ft. or an average of
7,952 sq. ft./lot. Future development of individual lots and would require individual lot owners to obtain CAMA Minor
Development Permits from the Town of North Topsail Beach.

NARRATIVE FOR SEASIDE VILLAGE
Seaside Village is a 2.900 acre portion of a 22.621 acre tract located on the northern side
of N.C. Highway 210, lying 0.2 miles east of the Town Line of Surf City and North
Topsail Beach. The tract has a with of 292.20 feet and an average depth of 417 feet from
the northern right-of-way line of N.C. Highway 210 to the normal high water line of
Banks Channel.
Seaside Developers, LLC purchased this tract in January 31, 2003 as recorded in Deed
Book 1964, Page 922 of the Onslow County Registry, copy enclosed. At the time of
purchase, this property served as a mobile home park, servicing approximately 24
homsites. All mobile homes have been removed to date. It is the intention of Seaside
Developers, to construct 12 single family dwellings with asphalt street, Onslow County
water, North Topsail Utilities, Inc. sewer, common area with rest room facilities and
pool. Seaside Developers, LLC will construct all improvements as shown on the enclosed
plan.
Seaside Developer, LLC was able to commence construction on three (3) of the twelve
(12) dwellings utilizing the Minor CAMA Process. The Major CAMA Permit is required
for the completion of the project. This application is for the construction of all the items
within the proposed subdivision with the exception of the proposed single family
dwellings. These dwellings will be permitted by the Minor CAMA Permit Process.
All development will lie completely upon uplands. The 404 wetland delineation and
coastal wetland delineation have been performed and approved by both the U. S. Army
Corps of Engineers and Division of Coastal Management, respectively, and is illustrated
on the plan.
This property is presently zoned Manufactured Housing Residential. This allows for the
construction of the plan as submitted. This plan is also consistent with the Town of North
Topsail Beach Land Use Plan.
This project has received preliminary approval from both the North Tom..sail i;Beac`
Planning Board and the North Topsail Beach Board of Aldexman: Finaf A

A sedimentation and erosion control plan will be required for this project and will be
submitted for review during the week of December 15, 2003.
This property does not fall within the area of environmental concern of Outstanding
Resource Water, however is adjacent to SA waters. Therefore, the impervious surface
will not exceed 25% of the area above the normal high water line of Banks Channel.
A storm water plan will be required for this project and the Low Density Approach will
be utilized. This will be submitted for review during the week of December 15, 2003.
A Sewer Permit has been issued by the State of North Carolina, copy enclosed.
A Waterline Extension Permit will be required by the State of North Carolina. This
application has been submitted and approval is pending.
This property is located in a High Hazard Flood Area and a properly executed AEC
Hazard Notice is enclosed.
This property is located in Flood Zone VE with a base flood elevation of 12' + 2'.
Therefore, the lowest horizontal member of each structure must be constructed at an
elevation of at least 14'. This will be addressed individually with Minor CAMA Permits.
This Property is eligible for Federal Flood Insurance. The average elevation of the site is
5' (NGVD 1929).
The adjoiners have been contacted by certified mail return receipt requested and the green
cards are attached.
Application for Minor CAMA Permits for the remaining nine (9) dwellings will
commence upon receipt of the approval of all requested permits.
