APPROVAL of 401 Water Quality Certification and "Exempt" Use per the Neuse River Buffer Protection Rules (15A
NCAC 213.0233) with ADDITIONAL CONDITIONS
Dear Mr. Winckelmann:
You have our approval, in accordance with the attached conditions and those listed below, to place fill within or otherwise
impact 20 feet of streams and 2,500 square feet (ft) of protected riparian buffers for the purpose of installing a driveway
at the subject property, as described within your letter dated February 20, 2004. After reviewing your application, we have
decided that the impacts are covered by the N.C. Division of Water Quality (DWQ) General Water Quality Certification
Number(s) 3402 (GC3402). The Certification(s) allows you to use Nationwide Permit(s) 18 or 39 when issued by the US
Army Corps of Engineers (USAGE). This letter shall also act as confirmation that the proposed activity is classified as
"exempt" from to the protected riparian buffers per 15A NCAC 26 .0233. In addition, you should .obtain. or otherwise
comply with any other required federal, state or local permits before you go ahead with your-projeet. including. (butnot r
limited to) Erosion and Sediment Control and Water Supply regulations. Also, this approval w-il1,expire: when the
accompanying 404 permit expires unless otherwise specified in the General Certification. f.:
This approval is only valid for the purpose and design that you described in your application: -If you change your project,
you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be
given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total
fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation
may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions
listed in the attached certification and any additional conditions listed below.
Conditions:
1. Water Quality Certification(s)
The proposed project must comply with all of the conditions of General Water Quality Certification (s) (GC) 3402.
2. Diffuse Flow
An additional condition is that all constructed stormwater conveyance outlets shall be directed as diffuse flow at non-
erosive velocities through the protected stream buffers such that it will not re-concentrate before discharging into the
stream as identified within 15A NCAC 2B .0233 (5). If this is not possible it may be necessary to provide stormwater
facilities that are considered to remove nitrogen. This may require additional approval from this Office.

Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or
civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the
Federal 404 and/or coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or
CAMA permit.
If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts),
you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a
hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and
binding unless you ask for a hearing.
Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts)
shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in
Articles 3 and 4 of G.S. 1506.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act and the Neuse
riparian buffer protection rule as described within 15A NCAC 26 .0233. If you have any questions, please telephone John

Thank you for taking the time today to review the proposed division of my property. As
we discussed, I am enclosing a recent survey of the property, with the creeks and stream
buffers identified. I have colored in yellow the allowable building area, and potential
driveway location.
The building area allows for a minimum of fifty feet from all stream banks, while still
allowing ample area for a home construction.
The driveway is drawn to offer a potential location that crosses the stream buffers using a
minimum square footage. The driveway crosses the buffer for approximately 100 feet at
a perpendicular angle. This will allow the impact to remain substantially below the 2500
sq foot target.
Based on your review today, I believe this meets all the necessary state requirements for
protection of the streams. I would like to request a letter of approval for this property
division. Please send a copy of the approval letter to each of the following:

Dear Mr. Wincklemann:
I have reviewed the information submitted for the project referenced by the Raleigh Regional
Office as NBR 03-254. An evaluation of the stream and pond features present on the property
was performed on October 24, 2003 to determine whether or not the site would require
compliance with the Neuse River Basin: Nutrient Sensitive Waters Management Strategy;
Protection and Maintenance of Existing Riparian Areas, Administrative Code 15A:20B.0233.
The features represented on the Wake County Soils and the Bayleaf USGS topographic maps
were evaluated to determine their subjectivity to the Rule. It was determined that there are two
stream features depicted within the property boundaries. As a result of the site visit, it was
determined that these features are subject to the Neuse Buffers throughout the property as
depicted on the attached map.
This letter addresses only those issues involving the riparian area designation. For information
relative to buffer impacts, water quality permitting, 401/404, or wetland issues, please contact Mr.
