On June 18, 2019, the Division received your response to our request for additional information issued on May 23, 2019. The Division has determined that your application remains incomplete and cannot be processed without additional information. The information provided June 18, 2019, does not adequately address the Division's May 23, 2019, request for additional information. Per 15A NCAC 02H .0506(b)(2), the applicant for a 401 Water Quality Certification must demonstrate the discharge to surface waters will minimize adverse impacts to fish and wildlife resources. The information provided thus far does not demonstrate that the discharge will minimize adverse impacts to fish and wildlife. The application is on hold until the following item is addressed: Please provide a thorough plan for aquatic life relocation. The plan must include information regarding anticipated duration and anticipated labor force. The plan should demonstrate the applicant is adequately prepared to relocate species from the dewatered reservoir, the 290 feet of Bradley Creek below the impoundment, and the bypass channel once water is returned to the mainstem. [15A NCAC 02H .0506(b)(2)] Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received, the Division will be unable to approve the application and it will be returned. In Section C of the attached Maintenance Plan, we have addressed WRC's comment 4 regarding the rescue and relocation of aquatic wildlife.
